The Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Procedure for conducting check of reliability of data on application of the prohibitions provided by parts three and the fourth article 1 of the Law of Ukraine "About cleaning of the power";

the list of bodies which perform reliability of data on application of the prohibitions provided by parts three and the fourth article 1 of the Law of Ukraine "About cleaning of the power".

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. To the Ministry of Justice:

1) to inform the Cabinet of Ministers of Ukraine on results of accomplishment by public authorities and local government bodies, other state bodies, their device (secretariat) of Item 2 of Final and transitional provisions of the Law of Ukraine "About cleaning of the power" concerning dismissal of the persons working in such bodies and holding (holding) the corresponding positions according to the criteria determined by part one of article 3 of the specified Law;

2) to provide placement on the website of the Ministry of information on own postal and e-mail address and contact phone number, and also the postal and e-mail address and numbers of contact telephone numbers of the Ministry of Internal Affairs, the Public fiscal service, Security service, the Prosecutor General's Office of Ukraine, Public judicial administration that in one-day time from the date of entry into force of this resolution moves the specified bodies to the Ministry of Justice.

4. To the Ministry of Finance to approve within ten days from the date of entry into force of this resolution procedure for conducting check of reliability of data, stipulated in Item 2 parts five of article 5 of the Law of Ukraine "About cleaning of the power", and form of the conclusion about results of the specified check.

Procedure for conducting check of reliability of data on application of the prohibitions provided by parts three and the fourth article 1 of the Law of Ukraine "About cleaning of the power"

1. This Procedure determines the mechanism of conducting check of reliability of the data represented official and officials of public authorities and local government bodies, and also persons who apply for occupation of the corresponding positions, by application of the prohibitions provided by parts three and the fourth article 1 of the Law of Ukraine "About cleaning of the power" (further - check).

2. It is performed relatively:

1) the Prime Minister of Ukraine, the First vice-Prime Minister of Ukraine, the vice-Prime Minister of Ukraine, and also ministers, heads of the central executive bodies which are not part of the Cabinet of Ministers of Ukraine, the Chairman of National Bank, the Chairman of the Antimonopoly Committee, the Chairman of Fund of state-owned property, the Chairman Goskomteleradio, their first deputies, deputies;

2) Attorney-General, Chairman of the SSU, Chairman of Service of foreign intelligence, head of department of the state protection, Minister of Finance, Chairman of GFS, chief of tax police, Minister of Internal Affairs, Chairman of GSChS, their first deputies, deputies;

3) military officials of Armed Forces and other military forming formed according to the law, except the military personnel of compulsory military service and the military personnel of military service on mobilization;

4) high councilors of justice, members of the Highest qualification commission of judges of Ukraine, judges, Chairman of GSA, his first deputy, deputy;

5) Chief of Presidential Administration of Ukraine, Head of Public administration by cases, head of the Secretariat of the Cabinet of Ministers of Ukraine, Government representative for anti-corruption policy, their first deputies, deputies;

6) the commanding structure of law-enforcement bodies, the central executive body which realizes state policy in the field of execution of criminal penalties, Gosspetssvyaz, the Ministry of Finance, GNS, State Customs Service, tax police, the Ministry of Internal Affairs, GSChS;

7) official and officials of bodies of prosecutor's office of Ukraine, SSU, Service of foreign intelligence, Management of the state protection, National Bank;

8) members of Central Election Commission, National council concerning television and broadcasting, chairmen and members of the national commissions performing state regulation of natural monopolies, state regulation in spheres of communication and informatization, the security markets and financial services;

9) heads state, including state, the companies of defense industry complex, and also the state companies which belong to the sphere of management of the subject of provision of administrative services;

10) others official and officials (except elective offices) public authorities, local government bodies;

11) the persons applying for holding the posts, specified in subitems 1-10 of this Item.

3. The Ministry of Justice for ensuring implementation of public control over process of conducting check forms advisory public body on lustration.

4. The organization of conducting check is assigned to the head of relevant organ to which powers dismissal from position of person concerning whom it is performed (further - the head of body or the head of public service), or on the head of public service in state body to which powers dismissal from position of person concerning whom it is performed (further - the head of public service) belongs belongs.
