About approval of Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan

According to the subitem 11) of article 13 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan.

2. Declare invalid:

1) the order of the Government of the Republic of Kazakhstan of December 27, 2002 No. 1386 "About approval of the Rule of issue of the certificate of the flight validity of civil aircrafts of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2002, Art. No. 46 472);

2) the order of the Government of the Republic of Kazakhstan of December 12, 2006 No. 1193 "About modification of the order of the Government of the Republic of Kazakhstan of December 27, 2002 No. 1386" (SAPP of the Republic of Kazakhstan, 2006, No. 47, the Art. 501).

3. This resolution becomes effective after ten calendar days from the date of its first official publication.

Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan

1. General provisions

1. Rules of certification and issue of the certificate of the flight validity of civil aircrafts of the Republic of Kazakhstan (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and requirements of International Civil Aviation Organization (ICAO).

2. Rules establish procedure for certification and issue of the certificate of the flight validity of the civil aircraft, except for aircrafts of extralight aircraft. At the same time the certificate of the flight validity of the civil aircraft is the document certifying compliance of the civil aircraft to airworthiness standards.

Certification of the flight validity of the aircraft which does not have the approved standard design is performed by authorized body in the field of civil aviation with involvement of the non-profit organizations combining operators of aircrafts.

3. The certificate of the flight validity is issued:

1) for 1 year;

2) in case of individual prolongation of service life of glider of the aircraft for the term established by developer of the aircraft, but no more 1,5 of year;

3) to the new aircraft or the aircraft after passing of capital repairs of glider for 2 years.

4. The aircrafts occupied in production of flights have the certificates of the flight validity issued or recognized by the state in which this aircraft is registered. Without the existing certificate of the flight validity the aircraft is not allowed to operation.

5. These rules provide issue of the following types of certificates:

1) certificate of the flight validity;

2) export certificate of the flight validity;

3) permission to accomplishment of special flight (special certificate of the flight validity);

6. In these rules the following terms and determinations are used:

1) authorized body in the field of civil aviation - the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

2) the applicant - the physical person or legal entity which addressed to authorized body for receipt of the certificate of the flight validity, the special certificate of the flight validity, the export certificate of the flight validity, the certificate on noise;

3) the request - the written appeal of the applicant to authorized body in the field of civil aviation for receipt of the certificate;

4) the flight validity - the technical condition of the aircraft corresponding to flight technical characteristics which ensure its safety and flight quality;

5) the certificate of the flight validity - the document issued by authorized body in the field of civil aviation, certifying compliance of the civil aircraft to airworthiness standards;

6) the certificate of type - the document confirming compliance with airworthiness standards of design like the civil aircraft;

7) permission to accomplishment of special flight (the special certificate of the flight validity) - the document issued by authorized body in the field of civil aviation for carrying out flight testing or flight to the venue of maintenance and repair of the aircraft;

8) the export certificate of the flight validity - the document issued by authorized body in the field of civil aviation, intended for export of the aircraft excluded from the state register of civil aircrafts of the Republic of Kazakhstan;

9) the certificate on noise - the document issued by authorized body in the field of civil aviation, certifying compliance of the civil aircraft on noise on the area;

10) operational documentation of aircrafts - documentation regulating flight and technical operation of aircrafts, including its maintenance and repair, and also containing service conditions and operational restrictions;

11) the form of the aircraft, engines and the main aggregates - the main documents for accounting of operating time (calendar resource, hour resource, resource on landings) the aircraft equipment and its technical condition;

12) the directive of the flight validity - the document determining aviation products which condition is unsafe, or in which such condition can take place or can develop in other products of the same standard design, and ordering corrective actions which shall be undertaken, or conditions or restrictions in case of which further operation of such products is allowed.

7. The following procedure for certification is established:

1) giving by the applicant in authorized body in the field of civil aviation of the request with documents for receipt of the certificate of the flight validity;

2) carrying out certified inspection of the flight validity of the aircraft by authorized body in the field of civil aviation and creation of the appraisal report about serviceability of the civil aircraft;

3) issue by authorized body in the field of civil aviation (refusal in issue) the certificate of the flight validity of the aircraft.

2. Procedure for certification and issue of the certificate of the flight validity

8. For issue of the certificate of the flight validity of civil aircrafts the request according to appendix 1 to these rules is drawn up. The following documents are attached to the request:

1) the inspection statement of technical condition and determination of the validity of the aircraft to flights according to appendix 2 to these rules;

2) copies of the lease and the acceptance report if the aircraft is leased;

3) the copy of the document confirming payment of collection for certification of the flight validity of the aircraft;

4) the copy of the certificate of type with indication of applicable modifications or the equivalent document confirming design compliance to airworthiness standards;

5) adopted agenda (regulations) of maintenance;

6) information on re-equipment of the aircraft (in case of re-equipment);

7) the certificate of manufacturer confirming compliance of the new aircraft to the certificate of type;

8) this about additional amount of works on transition of the program (regulations) of maintenance of the previous operator to the new program (regulations) of maintenance approved by authorized body in the field of civil aviation;

9) data on weighing of the aircraft in the existing configuration, with indication of centering and loading data;

10) the approved list of the minimum equipment which is constituted by the operator in the presence of the main list of the minimum equipment constituted by the organization responsible for standard design;

11) status of directives of the flight validity;

12) the status of aggregates with limited resources;

13) the status of the executed modifications.

Data in the documents specified in subitems 1), 11), 12) and 13) of this Item shall be provided to authorized body in the field of civil aviation not earlier than before 30 calendar days about day of registration of the request.
