I ORDER:

1. Approve the Instruction about work of law-enforcement bodies on control of turnover of office and civil weapon and about procedure for opening of shooting galleries, shooting ranges, shooting and hunting stands, weapon repair shops with appendices it (is applied).

2. To chiefs of the Department of Internal Affairs of areas and Bishkek:

2.1. Provide studying by staff of the Law of the Kyrgyz Republic "About weapon", "Rules of turnover of civil and office weapon and ammunition to it in the Kyrgyz Republic", No. approved by the Order of the Government of the Kyrgyz Republic of November 21 721, of requirements of this order.

2.2. Take measures for creation of necessary conditions for reception of citizens concerning licensed and allowing work. The rooms allocated for these purposes to equip with stands with materials of regulations about traffic in weapons, samples of necessary documents.

2.3. By means of mass media to carry out work on informing the population on requirements of regulatory legal acts concerning acquisition, storages, transportations and uses of weapon.

2.4. Carry out at the companies, in the organizations and organizations storing and using weapon, inventory count of all weapon which is available for them and ammunition, check of ensuring their safety. To report UOB Ministry of Internal Affairs of the Kyrgyz Republic till 01.07.2002 on results.

3. UOB Ministry of Internal Affairs (to Esenkozhoyev K. Zh.), and Bishkek to provide to chiefs of the Department of Internal Affairs of areas development and step-by-step implementation of the single automated complex of accounting of turnover of office and civil weapon in the territory of the Kyrgyz Republic.

4. FHU Ministry of Internal Affairs (to Cholushev K. T.) till November 1, 2002 to provide centralized production of necessary number of forms of licenses and permissions, having provided in them the corresponding details of documents of the strict reporting and several levels of protection.

5. Cancel operation of the order of the Ministry of Internal Affairs of the USSR No. 246 of 01.12.87.

6. To impose control over the implementation of this order on UOB Ministry of Internal Affairs of the Kyrgyz Republic.

The instruction about work of law-enforcement bodies on control of turnover of office and civil weapon and about procedure for opening of shooting galleries, shooting ranges, shooting and hunting stands, weapon repair shops

1. GENERAL PROVISIONS

1.1. This Instruction according to the Law of the Kyrgyz Republic "About weapon" and the Rules of turnover of office and civil weapon and ammunition to it in the Kyrgyz Republic approved by the Order of the Government of the Kyrgyz Republic of November 21, 2001 No. 721, regulates work of law-enforcement bodies on control of turnover of office and civil weapon in the territory of the Kyrgyz Republic.

1.2. Performing authorization system, law-enforcement bodies according to the current legislation grant licenses on:

- production, repair, trade in office and civil weapon and ammunition to them (appendix No. 1).

Permissions on:

- sale, acquisition, storage, carrying, use, transportation, import and export (appendices No. 6, of 7, of 10, of 11, of 14, of 15, of 17) of office and civil weapon, ammunition to it, control observance of statutory rules of their turnover.

The weapon permitted to turnover in the territory of the Kyrgyz Republic as office and civil is determined by the Law of the Kyrgyz Republic "About weapon".

The authorization system extends also to weapon of the following types:

okholoshchenny fire to which the weapon which is specially adapted for firing by blank cartridges when the shot service cartridge is impossible belongs;

educational fire to which the weapon brought to the state excluding production of shot without special repair work belongs.

1.3. Law-enforcement bodies when implementing of the functions assigned to them on control of traffic in weapons according to the current legislation have the right:

demand from legal entities and physical persons of submission of the relevant documents and the written or oral information necessary for accomplishment of control functions;

in case of identification of violations to give written warnings of elimination of these violations, obligatory for execution by citizens and officials;

in the presence of the bases to stop action or revocation of license, cancellation of permission, to withdraw weapon, to prohibit the activities of the companies, organizations and organizations connected with traffic in weapons;

take other measures, stipulated by the legislation.

2. COMPETENCE OF LAW-ENFORCEMENT BODIES ON ISSUE OF LICENSES AND PERMISSIONS TO OFFICE AND CIVIL WEAPON

2.1. The Departments of Internal Affairs of areas and Bishkek, gorrayorgana of internal affairs issue permissions:

on acquisition, transportation, storage of hunting smooth-bore guns and ammunition to them, gas weapon of self-defense to citizens of the Kyrgyz Republic;

on shipment of firearms with rifle barrel to the companies, the organizations and organizations. Extend it the validity of permission to storage and use of firearms with rifle barrel;

on export abroad and import to the Kyrgyz Republic of single copies of the hunting smooth-bore guns and ammunition to them which are in private use at citizens;

2.2. Management of public safety of the Ministry of Internal Affairs of the Kyrgyz Republic, performing in full functions on control of traffic in weapons, along with listed in item 2.1. to this Instruction permissions, issues:

license for production, repair, arms trade and ammunition

permission to acquisition abroad office and civil weapon to the companies having the license for production or trade of weapon and also the companies, the organizations and organizations having permission to acquisition of office and civil weapon in the territory of the Kyrgyz Republic;

permission to acquisition in the territory of the Kyrgyz Republic of civil weapon to foreign citizens;

permission to acquisition, storage and carrying civil and office weapon with rifle barrel;

the export permit abroad and import to the Kyrgyz Republic of firearms and ammunition to citizens of the Kyrgyz Republic, the companies, the organizations and organizations, and also foreign citizens;

permission to storage of the firearms in private collections and the firearms acquisition permit intended for collections;

permission to acquisition in the territory of the Kyrgyz Republic of office and civil weapon to the companies, the organizations and organizations.

Licenses are signed by the Minister of Internal Affairs of the Kyrgyz Republic or his deputy supervising Management of public safety of the Ministry of Internal Affairs.

In case of registration of permissions the chief of UOB Ministry of Internal Affairs of the Kyrgyz Republic or person replacing it has right to sign.

2.3. Materials on issue of licenses are considered till one month, on issue of permissions - up to two weeks from the date of filing of application.

3. CONTROL OF SALE OF WEAPON

3.1. Have the right to perform sale of office and civil weapon:

3.1.1. The companies which are engaged in development, testing and production of weapon - based on the licenses for production granted by the Ministry of Internal Affairs of the Kyrgyz Republic.

3.1.2. The sales of weapon of trade enterprise (shops) having the status of the legal entity which are specially created for implementation based on the licenses for trade granted by the Ministry of Internal Affairs of the Kyrgyz Republic.
