About approval of standards of rendering special social services in the fields of education and protection of the rights of children

According to the subitem 2) of article 10 of the Law of the Republic of Kazakhstan "About special social services" I ORDER:

1. Approve:

1) the Standard of rendering special social services in the fields of education and protection of the rights of children granted by the organizations of education according to appendix 1 to this order;

2) the Standard of rendering special social services in the fields of education and protection of the rights of children granted by the centers according to appendix 2 to this order;

3) the Standard of rendering special social services in the fields of education and protection of the rights of children provided by persons which accepted orphan children and children without parental support on education in the families according to appendix 3 to this order.

2. To committee on protection of the rights of children of the Ministry of Education and Science of the Republic of Kazakhstan (Orazaliyeva Z. Zh.) provide:

1) in accordance with the established procedure state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on official Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-Minister of Education and Science of the Republic of Kazakhstan Imangaliyev E. N.

4. This order becomes effective after ten calendar days after its first official publication.

The standard of rendering special social services in the fields of education and protection of the rights of children granted by the organizations of education

Chapter 1. General provisions

1. The standard of rendering special social services in the fields of education and protection of the rights of children granted by the organizations of education (further - the Standard) is developed according to the subitem 2) of article 10 of the Law of the Republic of Kazakhstan of December 29, 2008 "About special social services".

2. This Standard establishes quality, amount and conditions of provision of special social services in the organizations of formation of the state and non-state patterns of ownership (further - the organizations) intended for the round-the-clock, permanent or temporary stay:

1) orphan children;

2) children without parental support;

3) children, with deviant behavior;

4) the children sent to the special organizations of education or to the organizations of education with specific mode of content;

5) children, with special educational needs;

6) the children suspected of crime execution whom under the terms of life and education it is impossible to leave in the former residence;

7) pupils of houses of youth.

The categories stated above jointly hereinafter are referred to as as receivers of services.

3. Treat the subjects providing special social services:

1) the organizations of education for orphan children and children without parental support (orphanage, orphanage for children with special educational needs, boarding school for orphan children and children without parental support, boarding school for orphan children and children without parental support, with special educational needs, orphanage of family type, the children's village of family type, shelter, the house of youth and others);

2) the special organizations of education (психолого - medico-pedagogical consultation, the rehabilitation center, office of psychology and pedagogical correction, special boarding school);

3) the special organizations of education and the organization of education with specific mode of content, and also other organizations performing functions on protection of the rights of the child.

Chapter 2. Conditions of provision of special social services in the organizations

4. Provision of special social services in the organization is performed on the basis:

- decisions of local executive bodies of areas, cities of regional and republican value, the capital or the direction of the bodies performing functions on guardianship or custody concerning the children specified in subitems 1), 2) and 7) of Item 2 of this Standard;

- court resolutions concerning the children specified in subitems 3), 4) and 5) of Item 2 of this Standard;
