According to the subitem 110) of Item 16 of the Regulations on the Ministry of Emergency Situations of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 23, 2020 No. 701, I ORDER:

1. Approve the enclosed Rules of determination of general level of danger of hazardous production facility.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (to Erzhanov A. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction of the copy on official publication in mass media and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the Internet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the vice-minister of investments and development of the Republic of Kazakhstan Rau A. P.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of determination of general level of danger of hazardous production facility

Chapter 1. General provisions

1. These rules of determination of general level of danger of hazardous production facility (further - Rules) are developed according to the subitem 110) of Item 16 of the Regulations on the Ministry of Emergency Situations of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 23, 2020 No. 701 and determine procedure for determination of general level of danger of hazardous production facility.

2. Determination of general level of danger of hazardous production facility is carried out for the purpose of assessment of condition of security of physical persons and legal entities, the environment from harmful effects of the dangerous production factors by monitoring of industrial safety performed by the responsible person of hazardous production facility and territorial subdivision of department of authorized body in the field of industrial safety.

3. In these rules the following terms with the corresponding determinations are applied:

1) the general level of danger – complex indicator of condition of industrial safety on hazardous production facility;

2) disabled (emergency) condition – the technical condition of structures of factory buildings and technological constructions testimonial of loss of the bearing capability, and in case of rejection of the measures conducting to collapse;

3) operating state – technical condition of structures of factory buildings and technological constructions in case of which it meets requirements of industrial safety;

4) labor accident – harmful effects on the worker of the dangerous production factors arising in case of accidents, incidents on hazardous production facilities in case of accomplishment by it of labor (office) obligations or tasks of the employer from whom the industrial injury, sudden deterioration in health or poisoning of the worker which led it to temporary or permanent disability, or death resulted;

5) the factory building – the construction system consisting from bearing and protecting or combined (bearing and protecting) the designs forming the closed amount intended for placement of industrial productions, providing necessary conditions for work of people and operation of processing equipment, dangerous technical devices;

6) technological construction – the volume, plane or linear land or underground construction system consisting from bearing, and in some cases and the protecting designs and intended for accomplishment of production processes of different type, storage of materials, products, the equipment, for temporary stay of people, movement of people and loads.

Chapter 2. Procedure for determination of general level of danger

4. General level of danger of hazardous production facility characterizes condition of security of physical persons and legal entities, the environment from harmful effects of dangerous production factors of this hazardous production facility.

5. General level of danger of hazardous production facility is determined by the following indicators:

1) conditions of factory buildings, technological constructions;

2) conditions of technical devices;

3) conditions of dangerous technical devices;

4) the happened accidents;

5) the occurred incidents;

6) frequencies of labor accidents;

7) the taken place labor accidents from the death.

6. General level of danger of hazardous production facility is determined by the organization operating hazardous production facility, once a year calculation of general level of danger of hazardous production facility according to appendix 1 to these rules.

7. Information on the general level of danger of hazardous production facility annually is submitted the organization operating hazardous production facility in territorial subdivision of department of authorized body in the field of industrial safety no later than January 15 of the following after accounting year, in form according to appendix 2 to these rules.

Appendix 1

to Rules of determination of general level of danger of hazardous production facility

Calculation of general level of danger of hazardous production facility

1. The CCD – indicator of condition of factory buildings, technological constructions of hazardous production facilities is determined by formula:

CCD = (n1-n 2)/n3

where: n1 – the number of factory buildings, technological constructions in disabled (emergency) condition or more than 50% having depreciation for the beginning of accounting year;

n2 – the number of factory buildings and technological constructions with the recovered operability of designs for the end of accounting year;

n3 – total quantity of factory buildings, technological constructions of hazardous production facility.

2. Technical training college – the indicator of condition of technical devices, is determined by formula:

Technical training college = (n4-n 5)/n6

where: n4 – the number of the technical devices which fulfilled the normative service life (operation) established by manufacturing plant for the beginning of accounting year;

n5 – the number of the replaced technical devices from fulfilled the normative service life for the end of accounting year;

n6 – total quantity of the technical devices staying on the registry in the organization.

3. To sweat – the indicator of condition of dangerous technical devices is determined by formula:

To sweat = (n7-n 8)/n9

where: n7 – the number of the dangerous technical devices which fulfilled normative service life for the beginning of accounting year;

n8 – the number of the dangerous technical devices which underwent special inspection regarding prolongation of service life, having positive results of engineering certifications (hydraulic testing, complete engineering certification) and the conclusion of the expert organization about possibility of further safe operation for the end of accounting year;

n9 – total quantity of the dangerous technical devices staying on the registry in the organization.

4. The pas – indicator of the happened accidents is determined by formula:

Pas =n10/10

where: n10 – the number of the accidents which happened on hazardous production facility for the current year.

5. Pi – indicator of the occurred incidents is determined by formula:

Pi =n11/100

where: n11 – the number of the incidents which took place on hazardous production facility for accounting year, led to idle time of separate processing lines or technologies for the term of more than 6 hours.

6. Пнс – the indicator of frequency of labor accidents is determined by formula:

Пнс =n12/N

where: n12 – the number of the labor accidents which took place on hazardous production facility for the current year as a result of accident (incident);

N – the average number of technological personnel of hazardous production facility in year.

7. Пст – the indicator of the taken place labor accidents from the death is determined by formula:

Пст =n13/10

where: n13 – the number of the labor accidents from the death within year which resulted from accident (incident) on hazardous production facility.

8. Uop – the general level of danger of object is determined by formula:

Uop = CCD + Technical training college + Sweat + Pa + Pi + Pns + Pst
