About approval of Rules of the admission of the operator to aviation works

1. Approve the enclosed Rules of the admission of the operator to aviation works.

2. This resolution becomes effective after ten calendar days from the date of the first official publication, except for Item 7 of Rules of the admission of the operator to aviation works which becomes effective since January 27, 2011.

Rules of the admission of the operator to aviation works

1. General provisions

1. These rules of the admission of the operator to aviation works (further - Rules) are developed according to the subitem 21) of article 13 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft", appendix 6 to the Convention on international civil aviation (Chicago, 1944) and determine procedure for the admission of the operator to aviation works.

2. In these rules the following main terms and determinations are used:

1) the request - the written appeal of the applicant to authorized body in the field of civil aviation for passing of the procedure of certification;

2) the applicant - the physical person or legal entity which addressed to authorized body in the field of civil aviation for receipt of the certificate on accomplishment of aviation works;

3) certified inspection - the check of means, the equipment, operational procedures, engineering procedures performed by authorized body in the field of civil aviation, documentation, organizational structure, competence of administrative, flight and land personnel of the applicant on compliance to certified requirements;

4) certified requirements - the requirements established by regulatory legal acts in the field of certification of civil aviation;

5) management on production of flights - the document regulating procedure, the organization, providing and accomplishment of flights;

6) the operator's management on maintenance reaction - the document containing the description of procedures of the operator which provide possibility of management of timely and satisfactory accomplishment of all planned and not planned works on maintenance of aircrafts of this operator;

7) the certificate on accomplishment of aviation works - the document issued by authorized body in the field of civil aviation, certifying the operator's compliance to requirements of these rules and to certified requirements;

8) the program of maintenance - the document containing the description of specific planned works on maintenance and frequency of their accomplishment, and also the related procedures necessary for ensuring safe operation of those aircrafts which it concerns.

3. The certificate on accomplishment of aviation works is granted for a period of three years and is not subject to transfer to other person.

4. For certification of the operator performing aviation works collection according to the procedure and the sizes determined by the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" the Republic of Kazakhstan is levied. Certification of the operator performing aviation works is performed after payment in the government budget of the specified collection.

5. The operator observes the operational requirements and restrictions established by the certificate on accomplishment of aviation works.

2. Procedure for carrying out certification

6. Certification is performed in the following procedure:

1) giving by the applicant in authorized body in the field of civil aviation of the request with documents;

2) provisional estimate and decision making according to the request authorized body in the field of civil aviation;

3) carrying out by authorized body in the field of civil aviation of certified inspection;

4) decision making and issue (refusal in issue) certificates on accomplishment of aviation works.

7. Aggregate term of certification shall not exceed two months.
