About approval of the Method of calculation of expense budget on content of common property of object of condominium

According to subitem 10-4) of article 10-2 of the Law of the Republic of Kazakhstan of April 16, 1997 "About the housing relations", I ORDER:

1. Approve the enclosed Method of calculation of expense budget on content of common property of object of condominium.

2. To provide to development department of infrastructure of economy of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) of Item 2 of this order.

3. Recognize invalid some orders in the field of the housing relations according to appendix to this order.

4. To impose control of execution of this order on the supervising Vice-Minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Method of calculation of expense budget on content of common property of object of condominium

1. General provisions

1. This Method of calculation of expense budget on content of common property of object of condominium (further - the Technique) is developed for the purpose of establishment of single approaches to forming of costs of governing bodies of object of condominium (further - OUOK) and the amount of payment of owners of rooms (apartments).

2. The technique is applied when calculating costs for content of common property of the apartment apartment house, proceeding from the provisions of the law of the Republic of Kazakhstan of April 16, 1997 "About the housing relations".

3. The technique provides that the list of services and functioning on content of common property of object of condominium which provision ensures of OUOK are determined by the agreement of management of object of condominium.

The offered Technique does not assume availability of the exhaustive list of expenses of subjects of service activities for content of common property.

4. On content of common property of object of condominium the following expenses join:

1) on operation and repair of common property of object of condominium;

2) on content of the parcel of land;

3) on acquisition, installation, operation and checking of all-house metering devices of consumption of utilities;

4) on payment of the utilities consumed on content of common property of object of condominium;

5) accumulating on the forthcoming capital repairs.

5. Maintenance costs of common property of object of condominium are incurred by owners of rooms (apartments) in proportion to their share in common property if other is not provided by the agreement of owners.

6. On operation and repair of common property of object of condominium the following expenses join:

1) services in disinfection, detarization, disinsection of basements and other places public;

2) services on fire-proof actions, including content of the fire-fighting equipment, acquisition and charging of fire extinguishers, implementation of special texts, indexes, execution of plans and schemes of evacuation and so forth;

3) services in servicing of systems of central heating, water supply, water disposal, electric utility service in places of general use, ventilation and preparation for heating season;

4) services in elimination of emergencies;

5) running repair and painting of small architectural forms and fencings.

7. On content of the parcel of land the following expenses join:

1) services in gardening (landing, leaving, cutting of green plantings and lawns);

2) sanitary cleaning of refuse chute, the house adjoining territories, garbage removal (in not canalized houses - cleaning of cesspools, cleaning and whitewashing of domestic bathrooms), snow and leaves;

3) services in sanitary cleaning of places public.

8. Expenses on accumulating of the forthcoming capital repairs of common property of object of condominium join the amount in the amount of at least 0, of 02-fold monthly settlement indicator established for the corresponding financial year by the Law on the republican budget per one square meter of the usable space of the residential (non-residential) room. The decision according to which are accepted on general meeting of owners of rooms (apartments).

9. On implementation of management functions the following expenses join:

1) on compensation of the head and the staff of governing body of object of condominium;

2) charges on the salary (the social tax and social assignments);

3) expenses on office supplies, organizational equipment and its servicing.

2. Calculation of the size of maintenance costs of common property of object of condominium

10. According to the current legislation of the Republic of Kazakhstan in the field of the housing relations, the housing stock is subject to content in good repair, ensuring reliability and safety of accommodation of people, safety of individual property and common property, environment protection.

11. When carrying out planned general and partial surveys of OUOK determines technical condition of designs and the engineering equipment of object of condominium.

12. Terms of carrying out capital repairs are determined on the basis of assessment of their technical condition. According to article 41-2 of the Law of the Republic of Kazakhstan of April 16, 1997 "About the housing relations" determination of the list and priority of carrying out separate types of capital repairs of common property of object of condominium and approval of expense budget on carrying out the separate types of capital repairs of common property of object of condominium financed with participation of the housing help is performed by the housing inspectorate of local executive bodies having functions of the state control in the field of management of housing stock.

13. The expense budget on carrying out capital repairs of common property of object of condominium is considered and approved on general meeting of owners of rooms (apartments). The housing inspectorate performs approval of the expense budget on carrying out separate types of capital repairs of common property of object of condominium provided OUOK financed with participation of the housing help.

14. OUOK within fifteen working days from the date of education opens on each object of condominium the savings account in bank of the second level for accumulating of the amounts on capital repairs of common property of this object of condominium.

15. Share of participation of each owner in the cost of capital repairs, necessary to carrying out, is calculated in proportion to share of the owner of the room (apartment) in common property of object of condominium.

16. The size of fees on content of common property of object of condominium is calculated by formula:

In - the fee size on content of common property of object of condominium;

Р year - expense amount on content of common property of object of condominium;

S got. - the usable space of the apartment house estimated in square meters.

The expense amount on content of common property of object of condominium is calculated by formula:

where:

1) P ex-. - operating expenses and repair of common property of object of condominium;

2) P zy. - maintenance costs of the parcel of land;

3) P приб. - expenses on acquisition, installation, operation and checking of all-house metering devices of consumption of utilities;

4) P опл. lump. services. - expenses on payment of the utilities consumed on content of common property of object of condominium;

5) P накоп. on cap. rhemes. - accumulatings on the forthcoming capital repairs;

6) P ex. - expenses on implementation of management functions.

17. The sizes of costs in month of each owner of the placement (apartment) on content of common property of object of condominium are determined by formula:

where:

Р соб. - the amount of payment of the owner on content of common property of object of condominium;

Room S - the usable space of the room which is in individual (separate) property, estimated in square meters.

18. Expenses under contracts with service providers for cold and hot water supply, water disposal, electric utility service, heating (heat supply) on content of common property of object of condominium are part of total expenses on content of object of condominium.

19. Scoping provided by service providers of cold and hot water supply, water disposal, electric utility service, heating (heat supply) depends on availability or lack of metering devices.

20. If in the apartment apartment house all-house metering devices are established, the cost of the provided utilities on content of common property of object of condominium is determined as follows:

on the electric power - as the difference between indications of the all-house metering device and the amount of indications of individual (room) metering devices increased by rate of certain customer group;

on water supply (cold water of economic and drinking quality) - as the difference between indications of the all-house metering device and the amount of indications of individual (room) metering devices increased by rate of certain customer group;

by water disposal - the amount of sewage is determined equal to amount of the consumed water of economic and drinking quality then it is multiplied by rate of certain customer group;

by water disposal - the amount of sewage is determined equal to amount of the consumed water of economic and drinking quality then it is multiplied by rate of certain customer group;

on heat supply and hot water supply - as the work of the rate for difference established for certain category of consumers between amount of consumption of heat power (on heating and hot water supply) in apartments of owners (it is determined in the settlement way according to the area of the apartment of the owner and quantity of living) and consumption of heat power according to indications of the all-house metering device.

21. The expense budget on content of common property of object of condominium joins the cost of the utilities consumed for the period, preceding planned, with the subsequent refining of the estimate according to the actual indications of metering devices.

22. If in the apartment apartment house there are no all-house metering devices, the cost of the utilities consumed on content of common property is determined proceeding from the rates established by authorized body in the field of natural monopolies for certain type of consumers, standard rates of consumption of utilities.

23. Running repair is made with the frequency providing effective operation of the building.

3. Approval of expense budget on content of common property of object of condominium

24. On general meeting of owners of rooms (apartments) the decision on approval of expense budget on content of common property of object of condominium is made

25. In case of approval of expense budget owners of rooms (apartments) consider basic share of costs for actions in expense structure on content of common property of object of condominium according to appendix to this Technique.

The basic share of costs of actions in structure of expenditure of money consists of expenses on management and content of common property of object of condominium in the following pro rata ratio:

1) on management of common property of object of condominium - to 30%;

2) on content of common property of object of condominium - to 70%.
