Based on the paragraph of the fifth of part two of article 9 of the Law of the Republic of Belarus of June 23, 2008 "About labor protection" in edition of the Law of the Republic of Belarus of July 12, 2013, subitem 7.1.5 of Item 7 of the Regulations on the Ministry of Labour and Social Protection of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1589 "Questions of the Ministry of Labour and Social Protection of the Republic of Belarus", subitem 9.1 of Item 9 of the Regulations on the Ministry of Health of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 28, 2011 No. 1446 "About some questions of the Ministry of Health and measures for implementation of the Presidential decree of the Republic of Belarus of August 11, 2011 No. 360" the Ministry of Labour and Social Protection of the Republic of Belarus and the Ministry of Health of the Republic of Belarus DECIDE:
1. Approve the enclosed Cross-industry rules on labor protection for the organizations occupied with rendering mental health services to persons suffering from mental disturbances (diseases).
2. This resolution becomes effective after its official publication.

1. These Cross-industry rules (further - Rules) establish requirements for labor protection for the organizations of health care giving mental health services in out-patient and (or) stationary conditions, stationary organizations of social servicing for persons suffering from mental disturbances (diseases), other organizations occupied with rendering mental health services to persons suffering from mental disturbances (diseases) (further if other is not established, - the organizations occupied with rendering mental health services), including the structural (isolated) divisions of the organizations of health care.
2. The requirements for labor protection containing in these rules are aimed at providing healthy and safe working conditions of health workers and other employees of the organization occupied with rendering mental health services (further if other is not established, - workers), and are obligatory for execution by all employers when implementing activities for rendering mental health services to the persons suffering from mental disturbances (diseases), to persons, making the actions giving the grounds to assume availability at them mental disturbance (disease), to persons who addressed for rendering mental health services, to persons receiving mental health services (further - patients).
3. For the purposes of these rules:
terms and their determinations in the values established by the Law of the Republic of Belarus of June 23, 2008 "About labor protection" are used (The national register of legal acts of the Republic of Belarus, 2008, No. 158, 2/1453; National legal Internet portal of the Republic of Belarus, 24.07. 2013, 2/2059), the Law of the Republic of Belarus of June 18, 1993 "About health care" (Vyarkho¸naga Savet's Vedamastsi of Respubliki Belarus, 1993, No. 24, Art. 290; The National register of legal acts of the Republic of Belarus, 2008, No. 159, 2/1460), the Law of the Republic of Belarus of January 7, 2012 "About rendering mental health services" (The national register of legal acts of the Republic of Belarus, 2012, No. 10, 2/1901);

4. In the organizations occupied with rendering mental health services requirements of the these rules, Cross-industry general rules for labor protection approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of June 3, 2003 No. 70 shall be observed (The national register of legal acts of the Republic of Belarus, 2003, No. 87, 8/9818; 2011, No. 125, 8/24335), Governed on labor protection in the organizations of health care approved by the resolution of the Ministry of Health of the Republic of Belarus of June 10, 2009 No. 64 (The national register of legal acts of the Republic of Belarus, 2009, No. 160, 8/21090), other regulatory legal acts, including technical regulatory legal acts.
5. In case of absence in these rules, other regulatory legal acts, including technical regulatory legal acts, requirements for labor protection employers take the necessary measures providing preserving life, health and efficiency of workers in the course of labor activity.
6. The worker shall report immediately to the employer about any situation, life-threatening or to health of workers and people around, the accident which happened on production, to render assistance to the employer in taking measures to rendering necessary assistance to the victims and their delivery in the organization of health care.
7. The territory shall be protected on all perimeter, be lit at night and be kept clean and procedure. Branches of the trees located closer than 10 m from barrier at m 3,5 height also shall be more cut off. For pass of workers and other persons on the territory the checkpoint is arranged.
8. In the territory of psychiatric hospital specially equipped sites for walk of patients are provided. If necessary sites are equipped with smooth, continuous barriers height of at least 2,0 of m for prevention of escapes of patients and unauthorized penetration of strangers, transfer of the prohibited objects and substances to them.
Sites for walks of patients concerning which enforcement powers of safety and treatment are implemented are equipped with barriers height of at least 3,5 of m. The barrier is equipped with gate with automatically the closed locking device.
9. Smoking is allowed only in the places which are specially intended for smoking equipped according to the requirements established by the resolution of the Ministry of Emergency Situations of the Republic of Belarus and the Ministry of Health of the Republic of Belarus of April 22, 2003 No. 23/21 "About requirements to specially intended smoking areas" (The national register of legal acts of the Republic of Belarus, 2003, No. 56, 8/9493), and also Fire safety regulations of the Republic of Belarus. PPB of Belarus 01-2014, Ministry of Emergency Situations of the Republic of Belarus approved by the resolution of March 14, 2014 No. 3 (The national legal Internet portal of the Republic of Belarus, 19.06. 2014, 8/28744).
10. Architectural and planning and constructive solutions of buildings and premises of the organizations occupied with rendering mental health services shall conform to requirements of technical regulatory legal acts.
11. Rooms in places of stay of patients shall be kept clean and procedure.
12. In the organization occupied with rendering mental health services the measures excluding access for patients to office means of communication, keys from locks of rooms, to medical equipment and the products of medical appointment, medicines, personal belongings of workers, stock, sharp pricking and to the cutting objects, chemicals shall be taken.
13. Lamps of general lighting in rooms shall be with the continuous (closed) reflectors, be located at distance, unavailable to patients. Chambers shall be equipped with emergency (night) lighting with tension in power line no more than 42 Century.
14. Chambers of the round-the-clock observation of psychiatric hospital shall be equipped with the special technical means having functions audio-and (or) videos, working in the automatic mode.
15. Rooms, entrance doors and entrance apertures in medical chambers for the purpose of exception of unauthorized movement of patients shall be available to visual inspection of workers.
16. Chambers of the round-the-clock observation of psychiatric hospital shall have the doorways which are not equipped with door cloths.
17. Entrance doors in cabins and mezhkabinny partitions shall be equipped so that to provide availability of patients to visualization. All speakers of part of pipes and designs shall be hidden.
18. Ladder flights shall be equipped with the mesh safety barrier and the protective catching grids executed according to the project documentation.
19. Windows in chambers of the round-the-clock observation shall be equipped with oar lattices, are glazed by special unbreakable glasses or strengthened by special protective shock-proof film (class A), equipped with the locks excluding free opening of windows.
20. In the places which are specially intended for smoking, toilet rooms, chambers of the round-the-clock observation, medical chambers installation of lattices according to requirements of technical regulatory legal acts is allowed.
21. Storage of psychotropic medicines on sisterly posts, in procedural offices, offices of senior nurses, offices for storage of medicines is performed in the safes or metal cases attached to wall or floor, thermolabile psychotropic medicines - in refrigerators. Safes or metal cases shall be closed on the lock, keys from them shall be at the duty nurse, be told on change about what the corresponding log entry of transfer of keys is made.
22. The organization of the workplaces which are in halls and corridors shall provide:
maximum overview of space;
overview of workplace at least one other worker;
safe evacuation of the worker from workplace in case of direct danger to life and health, in case of aggression from the patient, in case of emergency situation.
23. Workplaces shall be kept clean and procedure, to be equipped with the objects, devices and products of medical appointment necessary for accomplishment by the worker of the job responsibilities, taking into account requirements of this Chapter. Storage in the places available to the patients who are in private use of objects which can be used as weapon is not allowed.
24. The workers who had in the procedure established by the legislation medical examinations, training, training, instructing and examination concerning labor protection are allowed to work in the organizations occupied with rendering mental health services.
The workers trained and owning methods of fixing shall apply fixing.
25. In psychiatric hospitals, psychiatric departments of day stay, stationary organizations of social servicing for persons suffering from mental disturbances (diseases) and also the special cars "Emergency Medical Services" and "Medical care", other cars used in the organizations occupied with rendering mental health services (further - medical transport), there shall be only workers according to the working schedule (working in shifts).
26. Other workers who are not occupied with rendering mental health services can be in psychiatric hospital, psychiatric departments of day stay, in premises of stationary organizations of social servicing for persons suffering from mental disturbances (diseases) on medical transport with the permission of the authorized officer of the employer, in the presence of the workers appointed by it and only for the period of time necessary for work.
27. Temporary replacement for duty workers on workplace, leaving from workplace is for a short time allowed only with the permission of the authorized officer of the employer, in its absence - the health duty worker.
28. On workplaces workers shall be in steady soft footwear without heels or on low heel with the fixed heel, sanitary clothes according to the resolution of the Ministry of Health of the Republic of Belarus of March 13, 2012 No. 19 "About equipment setting standards by sanitary clothes of employees of the state organizations of health care, except for the state organizations of health care providing fast (urgent) medical care, the organizations of medical equipment, storage bases of medical equipment and property" (The national register of legal acts of the Republic of Belarus, 2012, No. 39, 8/25120), technical regulatory legal acts.
29. Workers taking into account the harmful and (or) dangerous production factors influencing them are provided according to the legislation individual protection equipment.
30. Change of clothes and footwear before watch, meal of workers shall be performed in specially equipped rooms outside places of stay of patients.
31. When rendering mental health services to patients workers shall observe official style of clothes. Not allowed
wear the clothes having deep decollete, deep section, the short length made of transparent fabric and also scarfs or scarves, jewelry, costume jewelry and other objects of toilet, to be in the unstable, causing noise footwear on high heel;
use bright cosmetics and perfumery, to have bright manicure, superimposed nails;
carry hairstyle with long flowing hair;
have in case of itself the sharp, pricking and cutting objects;
leave the workplace connected with performance of works, providing the differentiated types and the modes of observation;
allow patients, except cases of carrying out interviewing, medical examinations, manipulations and acceptance of medicines, to service premises (office of the manager of department and the senior nurse, staffroom, office for implementation of hardware researches with use of medical equipment, procedural office, handling, the room of meal and rest of workers, office of the matron and others) for the purpose of exception of their access to funds of communication, to keys from locks, to medical equipment and products of medical appointment, medicines, personal belongings, stock, the sharp, pricking and cutting objects, chemical means;
provoke by any method (the word, gesture, mimicry, emotional condition) of patients to disputes, the conflicts, aggressive actions and to promote forming at patients of negative attitude to workers, the carried-out treatment and stay in the organization occupied with rendering mental health services.
32. When rendering mental health services in the decisions it is necessary to be guided by medical indications, medical debt, recommendations of specialists doctors in the field of rendering mental health services.
33. For determination of degree of aggression or risk of making of suicide of patients workers use in behavior of patients assessment of the key parameters bearing the greatest informational content - statements and mood of patients, their mimicry, gestures, behavior.
34. Workers taking into account the applied differentiated types and the modes of observation among patients shall be in the provision excluding sudden aggressive actions. Workers are not allowed to be among the initiated patients, to stand back in relation to the patient, initiated, inclined to aggression.
35. In case of situation with possibility of harming of life or to health of the worker as a result of behavior of patients (further - unusual situation) follows:
exclude further participation of patients in unusual situation;
take measures for prevention of further development of unusual situation;
inform the authorized officer of the employer on emergence of unusual situation;
if necessary to take measures for first-aid treatment.
36. After liquidation of unusual situation by the authorized officer of the employer its office investigation is performed and if the wrong behavior of workers became the cause of conflict - unplanned instructing and (or) extraordinary examination concerning labor protection is carried out, and in necessary cases materials of office investigation go to the employer for application of measures of disciplinary responsibility.
