Regulations on aviation works on protection and protection of forest fund

1. General provisions

1. This Provision is developed according to the Forest code of the Republic of Kazakhstan and the order of the Government of the Republic of Kazakhstan of July 17, 2003 N 712 "About approval of the Basic rules of flights in airspace of the Republic of Kazakhstan" (further - the Basic rules).

4. The contractor who won competition performs aviation works on protection and protection of forest fund according to the agreement signed with authorized body and other owners of forest fund.

5. The contractor needs to correspond to the following conditions:

1) availability of forces, means and the fire extinguishing device in enough which are regulated by tender conditions;

2) accomplishment of lesoaviatsionny works on own aircrafts, and also the courts leased under contracts with airlines;

3) availability of the pilots observers having the existing certificates of the pilot observer;

4) availability of landing fire engineering service, the trained and having existing certificates of the paratrooper-firefighter, and also admissions to work with water drain and trigger devices, with fire extinguishing means and radio communications;

5) availability of fire extinguishing means - manual fire-proof stock, technical means of fire extinguishing, water drain devices;

6) availability of dispatching service on collection and information transfer about wildfires in all territory of the Republic of Kazakhstan;

7) availability of means of communication - radio stations of the short-wave range, ultrashort-wave aviation range, ultrashort-wave range with the working frequencies approved with rescue services and owners of the protected forest fund;

8) availability of the sound broadcasting station of the aircraft.

6. The contractor performs methodical management and advisory services by preparation and retraining of specialists for suppression of wildfires, including firefighters-paratroopers, and also carries out certification of pilots observers and will organize increases in their qualification.

7. Treat aviation works on protection and protection of forest fund:

1) carrying out precautionary works on protection and protection of the woods and especially protected territories from the fires, wreckers of the wood and forestry violations;

2) aviation protection (patrol) of the woods from the fires and their suppression using aircraft;

3) identification and prevention of violations of the law in the field of plant and animal life and especially protected natural territories;

4) carrying out general supervision of sanitary condition of the woods, accomplishment of aviachemical works on pest control and wood diseases;

5) accomplishment of flights for needs of forest, hunting economy and especially protected natural territories;

6) mass agitation, explanatory work among the population, the organization of promotional and informational activities in the field of protection, protection of the woods and fauna.

8. The territory of forest fund serviced by the Contractor is subdivided into areas in which suppression of the fires is made by forces and means of the Contractor (areas of aviation protection), and areas in which suppression of the fires is made by the state forest protection or the state inspectorate for protection of especially protected natural territories and their fire services (areas of land protection).

9. The territories in which timely detection and liquidation of wildfires cannot be provided with the existing land forces and fire extinguishing means belong to areas of the aviation protection performed by the Contractor.

10. In areas of land protection branches of the Contractor in case of aviapatrol provide timely detection of wildfires, the notification of forest owners about emergence of wildfires, their distribution and necessary measures for fight against fire.

11. Procedure for reference of the territories to areas of aviation and land protection are established in case of forest management, in coordination with authorized body, based on offers of the companies performing aviation works on forest conservation, territorial administrations of authorized body and structural divisions of forestry of Akimats of areas.

12. Along with aviation works on protection and protection of the state forest fund, the Contractor can carry out aviation works on protection and protection of forest fund of other not state forest owners.

13. The organization and procedure for carrying out the aviation works on protection and protection of forest fund stated in this Provision is provided with the Contractor, state bodies of management of forestry of the Republic of Kazakhstan both other owners of forest fund and forest users, organizing aviation forest conservation.

14. Flights, on accomplishment of aviation works on protection and protection of forest fund, are carried out according to the requirements provided by the Basic rules.

15. Works on suppression of wildfires as land and aviation means are made by the Contractor according to the Fire safety regulations in the woods of the Republic of Kazakhstan approved by the order of the Chairman of Committee of forestry of the Republic of Kazakhstan of December 13, 2004 N 268, registered in the Register of state registration of regulatory legal acts for N 3369 (further - Rules) with observance of requirements of the Law of the Republic of Kazakhstan "About safety and labor protection".

2. Organization and planning of aviation forest conservation

16. Direct carrying out the aviation works on protection and protection of forest fund, in the territories serviced by the Contractor is made by its branches. As a part of branch aviation links, aviation departments, aviation groups, aviation points, and also the mechanized groups equipped by bulldozers, truck tanks and fire-proof aggregates are organized.

For delivery of the mechanized groups to places of the fires heavy helicopters are used.

Work of branch will be organized according to the regulations on branch approved by the Contractor.

17. In the territories serviced by the Contractor if necessary the experienced and production branches performing the activities according to the provision approved by the Contractor can be organized.

18. For carrying out fight against wildfires the Contractor will organize in branches parachute and landing and fire services which part parachute and firefighters and the landing fire brigades and groups staffed respectively by parachutists-firefighters and paratroopers-firefighters are.

19. Parachute and firefighters and landing fire brigades the senior instructor parachute and landing fire engineering service heads. Depending on the number of parachutists-firefighters and paratroopers-firefighters for the aid to the senior instructor parashyutno and landing fire engineering service of branch instructors of parachute and landing and fire teams are appointed.

20. The technical guidance of works on forest protection is performed by the senior pilot observer on forest protection.

25. Places of basing of branches are established in the Items located as it is possible closer to the most fire-dangerous sites of the protected territory.
