1. For registration of regulations of specialized depositary (Department of the admission on the financial market (further - authorized structural division) are represented to the Bank of Russia:
the statement for registration of regulations of specialized depositary according to appendix 1 to this Instruction;
regulations of specialized depositary (in duplicate);
verified copy of the document of authorized body of specialized depositary on approval of regulations of specialized depositary;
the electronic version of regulations of specialized depositary on the removable data carrier (if documents are submitted on papers).
2. For registration of the changes made to regulations of specialized depositary are represented to the Bank of Russia (authorized structural division):
the statement for registration of changes in regulations of specialized depositary according to appendix 2 to this Instruction;
regulations of specialized depositary with the changes made to it (in duplicate);
the verified copy of the document of authorized body of specialized depositary on approval of the changes made to regulations of specialized depositary;
the text of the changes made to the current version of regulations of specialized depositary;
the electronic version of the changed regulations of specialized depositary and the text of changes in it on the removable data carrier (if documents are submitted on papers).
3. The documents submitted on registration shall be constituted in Russian. In the documents submitted according to this Instruction on paper and containing more than one leaf, sheets shall be numbered, stitched and fastened the last leaf by zaveritelny text with indication of figures and copy-book of number of the numbered sheets on the back. The Zaveritelny text is signed by her originator with indication of surname, name, middle name (in the presence), positions and dates of creation. The signature of the originator of zaveritelny text shall be certified by seal of specialized depositary.
4. The regulations of specialized depositary (change in regulations of specialized depositary) affirm (affirm) according to the procedure, determined by the charter of specialized depositary if other is not established by the legislation of the Russian Federation, and it is submitted (are represented) on registration to the Bank of Russia (authorized structural division) no later than 10 working days from the date of its approval of specialized depositary by authorized body in time.
Changes are made to regulations of specialized depositary by approval of new edition of regulations by authorized body of specialized depositary.
The title page of regulations of specialized depositary (changes in regulations of specialized depositary) shall contain mark about approval of specialized depositary by authorized body, full name: "Regulations (the full trade name of the organization in genitive case is specified) on control of structure and structure of the assets accepted for covering of insurance reserves and own means (capital) of the insurer".
5. The application for registration of regulations of specialized depositary (the statement for registration of changes in regulations of specialized depositary) is signed by person performing functions of sole executive body of specialized depositary or other authorized person of specialized depositary with appendix properly of the verified copy of the document on delegation of power.
6. The file with the text of regulations of specialized depositary (regulations of specialized depositary with the changes made to it) on the removable data carrier (CD disk, the flash-store) shall be provided in the Rich Text Format (RTF) format. The file shall be in root directory, at the same time the removable data carrier shall not contain other directories and files, and also shall be protected from the subsequent record.
7. The statement for registration of regulations of specialized depositary (the statement for registration of changes in regulations of specialized depositary) with the documents attached to it goes the applicant to the Bank of Russia (authorized structural division) the registered mail, is delivered to couriers or in electronic form, signed by the strengthened qualified digital signature.
Day of receipt of documents by authorized structural division is day of registration of a statement in system of automation of document flow and clerical work of the Bank of Russia.
8. The Bank of Russia (authorized structural division) considers the submitted documents and makes the decision on return of documents or on registration of regulations (changes in it) within 30 working days from the date of their obtaining.
9. In case of discrepancy of the statement, documents attached to it and the electronic medium of information to the requirements established by this Instruction, lack of complete set of documents and also in case of discrepancy of regulations of specialized depositary or changes in regulations of specialized depositary to requirements of the legislation of the Russian Federation according to which the regulations are developed including to requirements of the legislation of the Russian Federation regulating activities of specialized depositaries, insurance companies and managing companies, the Bank of Russia (authorized structural division) the registered mail with the assurance of receipt sends to the address of specialized depositary specified in the statement (issues to the authorized person of the applicant), the return note provided on document registration with application of documents. The return note of documents shall contain complete list of the bases of return.
The statement for registration of regulations of specialized depositary corrected and repeatedly provided to the Bank of Russia (authorized structural division) (the statement for registration of changes in regulations of specialized depositary) and the documents attached to it are again arrived.
10. In case of representation of all properly of the processed documents specified in this Instruction and also in case of compliance of the provided regulations of specialized depositary or changes in regulations of specialized depositary to the legislation of the Russian Federation the Bank of Russia (authorized structural division) makes the decision on registration of regulations of specialized depositary (changes in regulations of specialized depositary).
The decision of the Bank of Russia (authorized structural division) on registration of regulations of specialized depositary (changes in regulations of specialized depositary) is drawn up in the form of the notice of registration of regulations of specialized depositary (changes in regulations of specialized depositary) (further - the notice of registration) which is signed by the head or the deputy manager of authorized structural division.
On each copy of regulations of specialized depositary (changes in regulations of specialized depositary) the corresponding mark about registration is put down.
The notice of registration and mark about registration shall contain decision date about registration. On the notice of registration the print of official stamp of the Bank of Russia is put down.
11. The notice of registration of regulations of specialized depositary (changes) goes to regulations of specialized depositary to the applicant the registered mail with the assurance of receipt (it is issued to the authorized person of the applicant) no later than five working days from decision date in time. One copy of the registered regulations of specialized depositary is applied to the specified notification.
12. The authorized structural division records the registered regulations of specialized depositary (changes in regulations of specialized depositary) and performs storage of the second copy of the registered regulations of specialized depositary (changes in regulations of specialized depositary) with the corresponding set of documents.
13. This Instruction becomes effective after 10 days after day of its official publication in "the Bulletin of the Bank of Russia".
