About approval of general aviation Rules of the Republic of Tajikistan (OAP RT - 21) "Air traffic management in the Republic of Tajikistan"

In compliance of the Convention on international civil aviation, and also for the purpose of reduction in compliance with requirements of International Civil Aviation Organization (ICAO) of air traffic management of the Republic of Tajikistan,

I dispose:

1. Approve general aviation Rules of the Republic of Tajikistan (OAP RT - 21) "Air traffic management in the Republic of Tajikistan" (is applied).

2. Provide this order in accordance with the established procedure for state registration in the Ministry of Justice of the Republic of Tajikistan.

3. This order to enact after state registration and official publication.

4. Declare invalid the Order of the Minister of Transport of the Republic of Tajikistan of January 20, 2014, No. 15 "About approval of aviation rules of the Republic of Tajikistan "Air traffic management in the Republic of Tajikistan" (AP RT - 21)".

5. Control of execution of this order to assign to the head of department of civil aviation.

General aviation Rules of the Republic of Tajikistan (OAP RT - 21) "Air traffic management in the Republic of Tajikistan"

Chapter 1. General provisions

1. General aviation rules of the Republic of Tajikistan (OAP RT - 21) "Air traffic management in the Republic of Tajikistan" (further - Rules) are developed based on Chapter 2 of the Air code of RT and Chapter 1 of Rules of use of airspace of the Republic of Tajikistan taking into account national practice in the field of air traffic management, standards and recommended practice of International Civil Aviation Organization.

2. These rules are obligatory for execution in the Republic of Tajikistan by users of airspace of the Republic of Tajikistan, the bodies of servicing of air traffic (further - body of Department of Internal Affairs) performing servicing of air traffic in the zones and areas established for them, other bodies and the organizations participating in ensuring flights of aircrafts, except for users of airspace and governing bodies of flights of the state aircraft and experimental aircraft in the airspace allocated for these types of aircraft where these rules are applied without fail to servicing of air traffic of civil aircrafts.

3. Air traffic management when flying civil aircrafts in airfields of joint basing and airfields of joint use is performed according to these rules.

4. In these rules the following terms and determinations are used:

- absolute height - distance down from the average level of the sea (MSL) to the level, point or the object accepted for point.

- absolute height of transition - the absolute height at which or below which the aircraft provision in the vertical plane is given in sizes of absolute height.

- absolute height of flight of obstacles (WASP) or the relative height of flight of obstacles (OSN) - the minimum absolute height or the minimum relative height over exceeding of the corresponding threshold of the runway or in appropriate cases over exceeding of airfield, used for ensuring compliance with the corresponding criteria of flight of obstacles.

Note 1. Absolute height of flight of obstacles is counted from the average level of the sea, and the relative height of flight of obstacles - from exceeding of threshold of the runway or, in case of inexact landing approaches, from exceeding of airfield or exceeding of threshold of the runway if its exceeding more than on 2 m (the 7th foot) is less than exceeding of airfield. Relative height of flight of obstacles for landing approach is around counted from exceeding of airfield.

Note 2. When both concepts are used, it is possible to apply the "absolute/relative height of flight of obstacles" form and reducings to convenience "WASP/N".

- emergency stage - the general term meaning uncertainty stage, stage of alarm or stage of disaster under different circumstances.

- the emergency notification - service of the emergency notification. The services provided for the notification of the relevant organizations on the aircrafts needing the help of search and rescue services, and rendering necessary assistance to such organizations.

- the aircraft address - individual combination from 24 bits which are available for assignment to the aircraft for the purpose of ensuring communication "air - the earth", navigation and observation.

- aviation incident - the event connected with use of the aircraft which takes place since the moment when any face is raised aboard with intention to make flight, till the moment when all being onboard person left the aircraft, and during which:

a) any face sustains bodily harm from the death or serious bodily harm as a result:

- stays in this aircraft, or;

- direct contact with any part of the aircraft, including the parts separated this aircraft or;

- direct impact of stream of gases of the jet engine;

- unless bodily harms are sustained as a result of the natural reasons, put to themselves, or put with other persons or when bodily harms are put to the free riders disappearing out of zones where access to passengers and crew members is usually open or;

b) the aircraft sustains damage or there is destruction of its design therefore:

- design durability is broken, technical or flight characteristics of the aircraft worsen;

- usually extensive repair or replacement of the damaged element is required;

- except as specified refusal or damage of the engine when only the engine, its cowls or auxiliary aggregates is damaged;

- when only air screws, zakontsovka of wing, antennas, pneumatics, brake mechanisms, fairing or when in covering there are small dents or holes are damaged;

c) the aircraft is missing or it appears in such place where access to it is absolutely impossible.

Note 1. Only for the purpose of uniformity of statistical data bodily harm as a result of which within 30 days from the moment of incident there came death is classified ICAO as bodily harm from the death.

Note 2. The aircraft is considered the missing person when were, official searches are stopped and the location of fragments was not established.

- aspects of human factor - the principles applicable to design processes, certification, trainings, maintenance and operational activities in aircraft and aimed at ensuring safe interaction between the person and other components of system by means of proper accounting of opportunities of the person.

- airfield - certain site terrestrial or surface of the water (including any buildings, constructions and the equipment), intended fully or partially for arrival, departure and movement on this surface of aircrafts.

- airfield reserve - the airfield intended for landing of the aircraft in case use of airfield of appointment is impossible. Can be reserve as well airfield of departure.

- airfield of appointment - airfield in which landing of the aircraft is provided by flight plan or task for flight. Airfields of appointment are subdivided into airfields of intermediate and final landing.

- airfield movement - movement on airfield maneuvering areas, and also flights of aircrafts around airfield.

Note. It is considered that the aircraft carries out flights around airfield when it enters airfield circle of flights, leaves it or is in its limits.

- airfield dispatching servicing - dispatching servicing of airfield movement.

- aeronautical servicing - the servicing of users of airspace including the organization and servicing of air traffic, radio engineering ensuring flights and aviation telecommunication, provision of aeronautical and meteorological information, aviation search and the rescue provided at all stages of flight of the aircraft.

- airfield circle of flights - the established route to which the aircrafts which are carrying out flight in the neighborhood of airfield shall adhere.

- aeronautical situation - set of the conditions of accomplishment of flight determined season and days, nature of the pro-flown area, degree of security of route with technical means, arrangement of reserve airfields, availability of prohibitions and restrictions of use of airspace and relative positioning of aircrafts.

- barometric height - indications of the barometric altimeter which does not have tool and aerodynamic errors and otgraduirovanny according to the standard atmosphere.

- safe flight altitude - flight altitude excluding collision of the aircraft with land (water) surface or obstacles in it.

- the pilotless uncontrollable aerostat - the pilotless aircraft is easier than air, without power plant, being in free flight.

- onboard system of the prevention of collisions (ACAS) - the onboard system based on use of signals of the transponder of the secondary survey radar (VORL) which functions irrespective of the land equipment and provides to the pilot information on conflict situation which the aircrafts equipped with VORL transponders can create.

- vektoreniye - ensuring navigation targeting of aircrafts by means of specifying of certain rates on the basis of use of watch system of Department of Internal Affairs.

- the landing strip (LS) - the certain rectangular site of overland airfield prepared for landing and take-off of aircrafts.

- visibility - visibility for the aviation purposes represents the size exceeding:

a) the greatest distance at which it is possible to differentiate and identify the black object of the acceptable sizes located near the earth in case of its observation on light background;

b) the greatest distance at which it is possible to differentiate and identify fires luminous intensity approximately in 1000 cd on dark background.

Note 1. These two distances have different values in air with the set absorption coefficient, and the last) depends on illumination of background. The first and) is characterized by meteorological optical visibility range (MOR).

Note 2. This determination is applied to observations of the visibility specified in local, regular and special reports, to observations of the prevailing and minimum visibility specified in reports of METAR and SPECI and to observations of visibility at the earth.

- visibility in flight - visibility from cabin of the pilot of the aircraft in the direction of flight.

- visibility at the earth - the visibility in airfield reported by the authorized observer or the automated systems.

- visibility vertical - the maximum distance from the Earth's surface to the level from which vertically objects on the land surface are visible down.

- visibility meteorological - the horizontal visibility determined by meteorological service by means of technical means or visually by visibility reference points.

- visual weather conditions (VMC) - the weather conditions expressed in sizes of visibility range, distances to clouds and height of the lower bound of the clouds corresponding to the established minima or exceeding them.

- visual landing approach - landing approach when flying on PPP when the scheme of landing approach on devices in parts or in full is not observed and calling is carried out on visual land reference points.

- the airway - controlled airspace (or its part) in the form of corridor.

- air traffic - all aircrafts which are in flight or moving on the airfield maneuvering area.

- airspace of Department of Internal Affairs - airspace of certain sizes with alphabetic reference within which specific types of flights can be carried out and for which servicing of air traffic and the rule of flights are determined.

- air situation - simultaneous relative positioning on vertical and horizontal of aircrafts and other material objects in certain region of airspace.

- the aircraft - any device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from the land surface.

- possibilities of the person - the capabilities of the person and limits of its opportunities influencing safety and efficiency of aviation activities.

- possibility of initiation of data line (DLIC) - application of data line which provides possibility of exchange of the addresses, names and numbers of versions necessary for initiation of application of data line.

- the secondary survey radar (SSR) - the radar-tracking system of observation using transmitters/receivers (requesters) and transponders in which the radio signal transferred by radar station causes transfer of response radio signal of other station.

- emergency landing - landing in airfield (except landing in reserve airfield) or out of airfield for the reasons which are not allowing to execute flight according to the plan.

- height - distance down from the level accepted for reference mark to this point. Absolute height is measured from the average level of the sea (geoid), relative height - from the chosen level, true height - from land relief level in reference point.

- height of the lower bound of clouds - distance down between land surface or waters and the lower bound of the lowest layer of clouds, the being lower than 6000 m (20 000 foot) and closing more than a half of the sky.

- transition height - the established height for transfer of scale of pressure of the barometric altimeter into value concerning pressure of 760 mm of mercury. (1013 gpa) in case of set of the set echelon.

- glide path - the decrease profile established for vertical targeting on final stage of landing approach.

- border of action of permission - Item/boundary, to which really dispatching permission issued to the aircraft.

- pressure atmospheric standard (QNE) - the established value of pressure of 760 mm of mercury. (1013 gpa).

- pressure of airfield (Item) specified to the average level of the sea on the standard atmosphere (QNH) - the atmospheric pressure in case of which installation on scale of pressure of the barometric altimeter the barometric height of airfield (Item) matches with its absolute height.

- pressure in airfield (QFE) - atmospheric pressure at the level of working threshold of the runway or the control point of airfield (CPA).

- visibility range on the runway (RVR) - distance within which the pilot of the aircraft which is on the axial line of the runway can see marking signs on the surfaces of the runway or fires limiting the runway or designating its axial line.

- discrete code - the VORL four-digit code which two last figures are not "00".

- dispatching zone (CTR) - the controlled airspace stretching up from the land surface to the established upper bound.

- the dispatching recommendation - the recommendation to crew on taking measures, concerning flight accomplishment, and used at the discretion of crew.

- dispatching body of approach (DPP) - the body intended for ensuring dispatching servicing of the controlled flights of the aircrafts which are arriving to one or several airfields or taking off from them.

- the dispatching area - the controlled airspace stretching up from the border established over the land surface.

- dispatching servicing of approach - dispatching servicing of controlled flights of the arriving and taking off aircrafts.

- dispatching permission - permission to the aircraft to be effective in accordance with the terms, established by dispatching body.

Note 1. The term "dispatching permission" is often replaced with the reduced term "permission" which is used in the corresponding contexts.

Note 2. The reduced term "permission" can be used with the explanatory words "on taxiing-out", "on take-off", "on departure", "on flight along route", "on landing approach" or "on landing" for designation of stage of flight to which dispatching permission belongs.

- dispatching specifying - the directions of body of Department of Internal Affairs ordering to crew of the aircraft to perform specific action.

- the aircraft report (aircraft) - the aircraft report of the aircraft which is in flight which is constituted according to requirements for data message on location, the course of accomplishment of flight and (or) weather conditions.

- reserve airfield on route in case of accomplishment of ETOPS (Extended-range Twin-engine Operational Performance Standards) - suitable reserve airfield on which the airplane can make landing after switching off of the engine or in case of origin any other special or emergencies in case of accomplishment of ETOPS along route.

- zone navigation (RNAV) - the navigation method allowing aircrafts to carry out flight on any desirable trajectory within the action area of land or satellite navigation aids or in the limits determined by opportunities of autonomous means or their combination.

- landing approach on devices - stage of flight at which the procedure of landing approach for devices performed according to the established scheme with use of radio engineering means of targeting is performed.

- landing approach on the radar - landing approach which final stage is completed under the leadership of the dispatcher using the radar.

- zone airfield (flight) - airspace of the established sizes for working off of the technology of piloting and other flight tasks.

- the waiting area - the airspace of the established sizes located, as a rule, over radio navigational point of airfield (the area of airfield, airline hub), intended for expectation by aircrafts of the queue of landing approach or approach to airfield.

- location index - the four-letter code group constituted according to the ordered ICAO rules and appropriated for designation of location of the aviation fixed station.

- the indicator of air situation - the electronic indicator on which location and movement of aircrafts, and also other necessary information are displayed.

- location indication - visual display in not symbolical or symbolical form on the indicator of air situation of location of the aircraft, airfield vehicle or other object.

- information of AIRMET - information on the actual or expected emergence of certain phenomena of weather on flight route issued by body of meteorological tracking which can affect safety of flights of aircrafts at small heights and which were not still included in the forecast constituted for flights at small heights in the respective region of flight information or his subrayena.

- information of SIGMET - information on the actual or expected emergence of certain phenomena of weather on flight route issued by body of meteorological tracking which can affect safety of flight of aircrafts.

- information on movement - the information proceeding from body of servicing of air traffic for the warning of the pilot of other known or observed aircrafts which can be near its location or the planned flight route, and helping the pilot to prevent collision.

- information of body of servicing of air traffic - information transferred by body of servicing of air traffic to crew of the aircraft about meteoconditions, movement, change of operational condition of navigation aids, condition of airfields and the related means and other data which can affect safety of flight.

- incident - any event, except aviation incident, connected with use of the aircraft which influences or could affect safety of operation.

- used by the runway - it is applied to designation of one or several runways which in any specific time are considered by airdrome control office as the most suitable for use by aircrafts of those types which as it is supposed, will carry out landing or take-off in this airfield.

- code (VORL) - number assigned to the specific multipulse signal of the answer transmitted by the transponder in the mode A or in the mode C.

- the commander of the aircraft - the pilot appointed the operator or, in case of aircraft of general purpose, the owner of the aircraft to carry out obligations of the commander and to be responsible for safe accomplishment of flight.

- final stage of landing approach - that part of the scheme of landing approach on devices which begins in the established control point (or point) final stage of landing approach or, in the absence of such point:

a) at the end of the last standard turn, turn on landing straight line or turn to the line of way of approach in the "hippodrome" scheme if that is provided, or;

b) in point of exit to the last line of way in the scheme of landing approach also comes to an end in point of the area of airfield from which:

- landing can be executed or;

- leaving on the second circle is begun.

- advisory airspace - airspace of certain sizes or the established route where advisory servicing of air traffic is provided.

- advisory servicing of air traffic - the services provided in advisory airspace for the purpose of ensuring optimum echeloning of the aircrafts which are carrying out flights according to plans of flights for PPP.

- advisory route - the established route on which there is advisory servicing of air traffic.

Note. Dispatching servicing of air traffic provides much more full service, than advisory servicing of air traffic therefore within controlled airspace advisory zones and routes are not established, however advisory services of air traffic can be provided below or above dispatching areas.

- contractual automatic dependent observation (ADS-C) - type of observation in case of which exchange of ADS-C terms of agreement between land system and the aircraft is performed (on data line) and make a reservation conditions in which transfer of reports of ADS-C, and data which will contain in these reports will be initiated.

- controlled flight - any flight which is carried out in the presence of dispatching permission.

- controlled airspace - airspace of certain sizes within which dispatching servicing according to classification of airspace is provided.

Note. Controlled airspace - the general term meaning airspace of Department of Internal Affairs of classes A, B, C, D and E as it is specified in item 2.6. Appendices 11.

- controlled airfield - airfield in which dispatching servicing of airfield movement is provided.

Note. The term "controlled airfield" means that in this airfield dispatching servicing of airfield movement is provided, but does not mean obligatory availability - the geographical place used as reference point for the scheme of expectation.

- control height - height which the barometric altimeter of the aircraft on transition echelon after transfer of scale of the altimeter into the pressure of airfield or the minimum pressure specified to the average level of the sea on the standard atmosphere shall show.

- control point of airfield - the point determining location of airfield in the chosen system of coordinates.

- control of trajectory of flight - use of watch systems of Department of Internal Affairs for the purpose of provision to aircrafts of information and the messages concerning considerable variations from nominal trajectory of flight including variations from the conditions stipulated in the dispatching permissions issued to them.

- the trailer strip of braking (TSB) - the certain rectangular site of the land surface at the end of the located running start length prepared as the site suitable for aircraft stop in case of the interrupted take-off.

- the coordination center of search and rescue (RCC) - the center created in the allocated area of search and rescue for assistance of search and rescue works to the effective organization.

- cruiser echelon - height maintained during considerable part of flight.

- rate - the direction in which there is longitudinal axis of the aircraft expressed usually in degrees of the corner counted from the northern direction of true, magnetic, compass or conditional meridians.

- flight strip - the part of the airfield of airfield including the runway and trailer strips of braking if they are provided, intended for take off and landing of aircrafts, reduction of risk of damage of aircrafts in case of rolling-out out of limits of the runway and safety of the aircrafts which are flying by over it during take-off or landing.

- the airfield - the part of airfield including one or several landing strips, rulezhny paths, platforms and platforms of special purpose.

- flight letters - specifying about whether the special attention from bodies of Department of Internal Affairs is required to this aircraft.

- the line of way - projection of trajectory of flight of the aircraft to the Earth's surface which direction in any its point is usually expressed in degrees of the corner counted from the northern direction (true, magnetic or conditional meridians).

- route of zone navigation - the route of Department of Internal Affairs established for aircrafts which can apply zone navigation.

- the route of servicing of air traffic - the established route which is intended for the direction of flow of movement for the purpose of ensuring servicing of air traffic and in appropriate cases means the airway, route of zone navigation, local air-line.

Note 1. The term "route of Department of Internal Affairs" is used for designation in appropriate cases of the airway, advisory route, supervised or uncontrollable route, route of arrival or departure etc.

The route of Department of Internal Affairs is determined by route technical requirements which include index of route of Department of Internal Affairs, the line of way to the main points (points of way) or in the opposite direction, distance between the main points, requirements for transfer of reports, and also, according to the decision of the relevant authority of Department of Internal Affairs, the lowermost safe absolute height.

- routes of flights of aircrafts - in controlled airspace for accomplishment of flights out of routes of servicing of air traffic flights of aircrafts are carried out along routes.

- the place of expectation at the runway - the certain place intended for protection of the runway, the surface of restriction of obstacles or the critical/sensitive zone ILS/MLS in which the driving aircrafts and vehicles stop and is expected if there is no other specifying from control office of airfield.

Note. In radiotelephone phraseology expression "the expectation point" is used for designation of the place of expectation at the runway.

- meteorological information - the meteorological report, the analysis, the forecast and any other message concerning the actual or expected weather conditions.

- the meteorological report - the message on results of observations of the weather conditions relating to certain time and the place.

- meteorological body - the body intended for meteorological providing the international air navigation.

- method of number of "Move" - method of keeping of intervals of longitudinal echeloning on routes of Department of Internal Affairs from use of number of "Move".

- the minimum fuel reserve - the term used for the description of situation when the fuel reserve onboard the aircraft reached the level in case of which the small delay is allowed or is not allowed any delay.

Note. It does not mean emergency, and only specifies possibility of emergency environment if any unexpected delay takes place.

- the minimum reduced pressure (P прив.мин) - calculated value of the minimum atmospheric pressure specified to sea level on local air-line, route or the area of flight.

- observation from board (aircraft) - assessment of one or several meteorological elements made onboard the aircraft which is in flight.

- ascent in the cruiser mode - the piloting of the airplane in the cruiser mode providing surplus of absolute height in process of reduction of weight of the airplane.

- the navigation based on characteristics (PBN) - the zone navigation based on requirements to characteristics of the aircrafts which are carrying out flight along route of Department of Internal Affairs the scheme of landing approach on devices or weeds in the established airspace.

- land aeronautical fire - any fire, excepting fires established on the aircraft which is specially held for use as aeronautical means.

- the initial site of landing approach - the site of the scheme of landing approach on devices between control point of the initial stage of landing approach and control point of the intermediate stage of landing approach or, in appropriate cases, control point (or points) final stage of landing approach.

- uncontrollable airfield - airfield in which dispatching services of airfield movement are not provided.

- uncontrollable flight - flight of the aircraft which is not provided with dispatching servicing (management) of air traffic.

- the unknown aircraft - the aircraft which flight in this area is observed or about flight which in this area it is reported, but accessory of which is not established.

- unauthorized departure on the runway - any event in airfield connected with unreasonable availability of the aircraft, vehicle or person on the protected surface area intended for carrying out landing and take-off of aircrafts.
