About approval of Changes to Regulations on order of registration and licensing of banks, opening of separate divisions and to Regulations on procedure for submission of data on structure of property

According to Articles 7, of 15, of 55, 56 Laws of Ukraine "About the National Bank of Ukraine", the Law of Ukraine "About the National Bank of Ukraine", for the purpose of enhancement of order of registration of banks, opening of separate divisions by banks the Board of the National Bank of Ukraine decides:

1. Approve:

Changes in the Regulations on order of registration and licensing of banks, opening of separate divisions approved by the resolution of Board of the National Bank of Ukraine of September 08, 2011 No. 306, registered in the Ministry of Justice of Ukraine on October 18, 2011 on No. 1203/19941 (with changes) which are applied (further - Changes)

2. To department of normative and methodological ensuring bank regulation and supervision (Ivanenko N. V.) to bring contents of this resolution to the attention of banks of Ukraine and territorial administrations of the National Bank of Ukraine for use in work.

3. To impose control over the implementation of this resolution on the First Deputy Chairman of the National Bank of Ukraine Pisaruk A. V.

4. The resolution becomes effective from the date of, its official publication following behind day, except paragraph two of the subitem of 1 Item 1, of subitems 1-3 of Item 3, of subitems 3, of the 5th Item 5 of Changes which become effective since January 16, 2015.

Changes to Regulations on order of registration and licensing of banks, opening of separate divisions

1. In the Section I:

1) in Item 1.2:

state paragraph two in the following edition:

"Considerable influence on management or activities of the legal entity - immediate and/or indirect possession by one person independently or together with other persons from 10, but is lower than the level of 50 percent of authorized capital and/or voting power of shares, shares of the legal entity or possibility of implementation of such influence, independent of formal ownership, on management or activities of the legal entity";

add Item with the paragraph of the following content:

"The independent member of council - physical person which is part of council of the bank and is not associated person of the board member of this bank, the representative related or affiliates of bank, the shareholder of bank or its representative";

Item 1.4 after paragraph one to add 2) with the paragraph the second the following content:

"Documents which are filed to National Bank according to this Provision and concern legal entities, shall be certified by seal (in the presence)";

3) in Item 1.14:

"Availability of the confirmed sources of origin of means at the expense of which fees for forming or increase in the authorized capital of bank are performed";

5) in Item 1.16:

the fourth to state the paragraph in the following edition:

"Improper execution of obligations of financial nature concerning any bank or other legal entity or physical person, including availability of the facts of failure to carry out by person of the undertaken obligations as participant/investor on ensuring introduction of means for capitalization of bank";
