List of amending documents

According to article 12 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" and article 51 of the Law of the Republic of Tajikistan "About regulatory legal acts" the Government of the Republic of Tajikistan decides:

1. Approve the Provision, Structure of central office, the Scheme of management and the List of the state networks of system of the Agency on hydrometeorology (appendices 1, 2, 3 and 4).

2. Establish the extreme number of employees of the Agency on hydrometeorology in number of 64 units (without service personnel), including Central office - 38 units.

3. Permit the Agency to have 2 deputy directors on hydrometeorology and to set limit of office cars in number of 3 units.

4. To perform financing of the Agency on hydrometeorology at the expense of means of the republican budget and other means according to the procedure, determined by the Ministry of Finance of the Republic of Tajikistan.

5. To committee on environmental protection under the Government of the Republic of Tajikistan within two months:

- make offers on modification and amendments in industry regulatory legal acts of the Republic of Tajikistan;

- bring the acts into accord with this resolution.

6. Declare invalid the Order of the Government of the Republic of Tajikistan of October 1, 2008, No. 485 "About Public institution on hydrometeorology".

Regulations on the Agency on hydrometeorology

1. General provisions

1. The agency on hydrometeorology (further - the Agency) is the public authority enabling the realization of single state policy, control and monitoring of environmental pollution, active impact on meteorological and other geophysical processes in the field of hydrometeorology.

2. The agency in the activities is guided by the Constitution of the Republic of Tajikistan, the constitutional laws of the Republic of Tajikistan, the laws of the Republic of Tajikistan, the international legal acts recognized by the Republic of Tajikistan resolutions of Majlisi milli and Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, decrees and orders of the President of the Republic of Tajikistan, resolutions and orders of the Government of the Republic of Tajikistan and this Provision.

3. The agency is included into the Management structure of Committee of environmental protection under the Government of the Republic of Tajikistan and performs the activities in cooperation with other state bodies, local executive bodies of the government, is scientific - research organizations, institutions of higher professional education, public organizations and other departments and the organizations.

4. The agency has the following powers:

- in accordance with the established procedure develops and represents drafts of the laws and regulatory legal acts in the field of hydrometeorology;

- submits requests for implementation of state programs and long-term plans in the field of hydrometeorology;

- in accordance with the established procedure represents the republic in the international organizations and other states for hydrometeorology, signs contracts with relevant organs of foreign countries;

- carry out work on attraction of grants and other international aid for development of hydrometeorology;

- provides development and implementation of the state statistical reporting in the field of hydrometeorology and represents data to relevant organs; performs activities for providing state bodies with methodical and information consultations in the field of hydrometeorology;

- in accordance with the established procedure coordinates creation and ensuring activities of system of complex monitoring of state of environment;

- establishes and supports the production, research relations and bonds with the republican and foreign companies in the field of hydrometeorology;

- in accordance with the established procedure Tajikistan in the field of hydrometeorology fulfills the international obligations;

- supports and develops exchange of information within cooperation with the World Meteorological Organization, EurAsEC and the Commonwealth of Independent States;

- participates in accomplishment of the international obligations according to the United Nations Framework Convention about climate change and the Vienna Convention on protection of ozone layer and represents the corresponding projects;

- makes use of the best practices of other countries in the field of hydrometeorology, hydrologies, agricultural meteorology, aerology, actinometry, glaciology and monitoring of the environment.

5. According to the assigned powers the Agency provides execution of the following tasks:

- determination of short-term, mid-term and long-term trends of development in the field of hydrometeorology, and also plan development and development programs;

- rendering the methodical and organizational help, for the purpose of enhancement of hydrometeorological forecasts, forecasts of the spontaneous hydrometeorological phenomena, forecasting of productivity of crops and monitoring of the environment;

- development of offers on increase in efficiency of use of the allocated public funds and the attracted foreign investments in the field of hydrometeorology and monitoring of their use;

- signing in accordance with the established procedure the international legal acts in the field of hydrometeorology within the competence;

- realization of effective economic policy and production in the field of hydrometeorology;

- studying of condition of glaciers, lakes, climate change processes, for the purpose of increase in effective use of water

- resources and forecasting of the spontaneous hydrometeorological phenomena;

- studying of spatio-temporal patterns of the hydrological mode, calculation of surface water and water balances of pools and territories;

- cooperation with relevant organs in the field of safety of land and air traffic;

- cooperation with insurance organizations, associations, Dehkan farms, entrepreneurs, legal entities and physical persons in the field of hydrometeorological activities;

- coordination of bonds with republican and foreign production both research institutions and the organizations;

- the direction of workers on seminars, conferences and professional development course;

- implementation of servicing of the special equipment, repair and protection of networks, equipment, radars and radio stations;

- providing with food, fuel it is also combustible lubricants of mountain and hardly accessible stations and posts, creation of necessary working conditions and activities in structures, and also carrying out adequate measures for ensuring compliance with safe engineering and sanitation;

- accomplishment in the established field of activity, other powers provided by the laws, regulatory legal acts of the Republic of Tajikistan.

6. The agency has the following obligations:

- implementation of state programs in the field of hydrometeorology;

- carrying out the state system of meteorological, hydrological, agrometeorological, aerological, aktinometrichesky, glaciological, radar and satellite observations, and also monitoring of the environment;

- enhancement of system of ensuring collection, processing, analysis and bringing to the consumer of the user of information on state of environment;

- timely providing consumers with hydrometeorological forecasts, warnings of emergence of deterioration in condition of weather, climatic processes and ozone layer for acceptance of necessary operational measures;

- providing with official forecasts, other information products according to state of environment;

- carrying out monitoring of pollution of the atmosphere, ozone layer in big cities and on important state and strategic objects;

- carrying out monitoring of pollution of surface water on the rivers having interstate and regional value;

- carrying out expeditionary observations of glaciers, lakes, snow cover, avalanches and mudflows;

- generalization of reliable data about the meteorological and radiation mode in the territory of the Republic of Tajikistan;

- forming of the state information resources in the field of hydrometeorology, creation and maintaining Single State Fund of data of the environment;

- providing air, aeronautical services and air traffic control systems of the airports with weather forecasts and radar information for safety of flights.

7. Rights of the Agency:

- request and receive the data necessary for decision making on the questions carried to competence of the Agency;

- in case of detection of gross violations of professional nature to introduce in Committee on environmental protection under the Government of the Republic of Tajikistan and in relevant organs of the Republic of Tajikistan offers, for the purpose of their non-admission further when implementing hydrometeorological activities;

- perform actions for retraining and advanced training of personnel for the Agency;

- perform according to the legislation of the Republic of Tajikistan international cooperation;

- has other rights stipulated by the legislation the Republic of Tajikistan.

3. Organization of activities

8. The agency is headed by the Director appointed to position and dismissed by the Government of the Republic of Tajikistan on representation of the chairman of Committee on environmental protection under the Government of the Republic of Tajikistan.

9. The director bears the personal responsibility for accomplishment of the tasks assigned to the Agency and realization of state policy in the established field of activity.

10. The director is permanent representative of the Government of the Republic of Tajikistan under the World Meteorological Organization.

11. The number of deputy directors of the Agency is determined by the Government of the Republic of Tajikistan.

12. The director has two deputies appointed to position and dismissed by the Chairman of Committee of environmental protection under the Government of the Republic of Tajikistan on its representation.

13. Director of the Agency:

- distributes tasks between the deputies;

- approves regulations on the bodies of structure of Central office, bodies entering the Scheme of management and the List of the state networks of system of the Agency;

- in accordance with the established procedure appoints to position and dismisses the staff of the Agency;

- approves annual work plans, reports and indicators about activities of the bodies entering the Scheme of management and the List of the state networks of system of the Agency;

- in accordance with the established procedure makes offers on financial provision, reorganization and liquidation of divisions of the Agency;

- makes in the Ministry of Finance of the Republic of Tajikistan offers on forming of the republican budget regarding financial provision of activities of the Agency;

- develops and submits for approval of Committee on environmental protection under the Government of the Republic of Tajikistan the staff list of Central office of the Agency, according to standard requirements within salary fund and the number of workers, expense budget on content of Central office of the Agency within the budgetary appropriations established by the Government of the Republic of Tajikistan, approved for the corresponding financial year provided in the Government budget;

- approves the number and salary fund of employees of the bodies entering the Scheme of management and the List of the state networks of system of the Agency within the indicators established by the Government of the Republic of Tajikistan and also expense budget on their content within the assignments approved for the corresponding period provided the republican budget;

- according to the procedure, established by the legislation of the Republic of Tajikistan on public service, resolves the issues connected with passing of public service in the Agency;

- publishes orders, approves instructions, regulations, the rules and regulatory legal acts obligatory for execution by all employees of the Agency, the companies and organizations entering the Scheme of management and the List of the state networks of system of the Agency and also their execution provides control;

- represents in accordance with the established procedure the employees of central office of the Agency, the companies and organizations entering the Scheme of management and the List the state networks of system of the Agency and other persons performing activities in the established field of activity, to assignment of honorary titles and rewarding with the state awards of the Republic of Tajikistan.

14. Financing of maintenance costs of central office of the Agency, the bodies entering the Scheme of management and the List of the state networks of system of the Agency is performed at the expense of the means provided in the republican budget, and also at the expense of special means according to the procedure, approved with the Ministry of Finance of the Republic of Tajikistan.

15. The agency is legal entity, has seal with the image of the State Emblem of the Republic of Tajikistan and with the name, the corresponding forms, seals, stamp and is financed from the single treasurer account of Head department of the Central Treasury of the Ministry of Finance of the Republic of Tajikistan.
