1. Approve the enclosed standard of the state service "Issue of the Omission on Entrance to Border Area to Foreigners and Stateless Persons".
2. To provide to department of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan:
1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";
3) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan and on the intranet portal of state bodies.
3. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan Turgumbayev E. Z. and Department of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Sainov S. S.).
4. This order becomes effective after ten calendar days from the date of its first official publication.

1. The state service "Issue of the Omission on Entrance to Border Area to Foreigners and Stateless Persons" (further - the state service).
2. The standard of the state service is developed by the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry).
3. The state service appears territorial subdivisions of the Ministry (further - the service provider).
Reception of an application and issue of result of rendering the state service is performed through the service provider.
4. Terms of rendering the state service:
1) from the date of delivery by uslugopoluchatel of document package - 7 (seven) working days;
2) the most allowed time of expectation for delivery of document package - 30 (thirty) minutes;
3) the most allowed time of servicing of uslugopoluchatel - 30 (thirty) minutes.
5. Form of rendering the state service: paper.
6. Result of rendering the state service - the omission on entrance to border area according to appendix 1 to this standard of the state service or the motivated answer about refusal in rendering the state service in cases and on the bases, stipulated in Item 10 these standards of the state service.

7. The state service is rendered free of charge to physical persons and legal entities (further - uslugopoluchatel).
8. The working schedule of the service provider Monday through Friday (from 9-00 till 18-30 o'clock, with lunch break from 13-00 till 14-30 o'clock) except days off (Saturday, Sunday) and holidays, according to the labor law of the Republic of Kazakhstan.
Reception of an application and issue of result of rendering the state service is performed in place of registration of uslugopoluchatel from 9:00 to 17:30 o'clock with lunch break from 13:00 to 14:30 o'clock.
The state service is rendered in turn, without making an appointment and the accelerated servicing.
9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel:

10. The bases for refusal to uslugopoluchatel in rendering the state service are:
1) for the benefit of ensuring national security, protection of public order and health of the population;
2) if its actions are directed to violent change of the constitutional system;
3) if opposes sovereignty and independence of the Republic of Kazakhstan, calls for violation of unity and integrity of its territory;
4) if kindles international and religious strife;
5) if it is necessary for protection of the rights and legitimate interests of citizens of the Republic of Kazakhstan and other persons;
6) if belongs to the terrorist or extremist organizations, it was condemned for terrorist or extremist activities or in case of recognition by court in its actions of especially dangerous recurrence;
7) if it does not perform collection for the making of criminal or administrative offense imposed on it during the previous stay in the Republic of Kazakhstan;
8) if during the previous stay in the Republic of Kazakhstan the declaration on the individual income tax is not provided to them in case submission of such declaration is stipulated by the legislation the Republic of Kazakhstan;
9) if did not provide confirmation about availability of the means necessary for stay and departure from the Republic of Kazakhstan, according to the procedure, of the ethnic Kazakhs, persons who were born or earlier consisting in the nationality of the Republic of Kazakhstan or the Kazakh Soviet Socialist Republic, and members of their families determined by the Government of the Republic of Kazakhstan, except for;
10) if in case of the address with the petition for entrance he reported about himself false data or did not submit necessary documents in time, established by the legislation of the Republic of Kazakhstan;
11) in the presence at it the diseases which are contraindication for entry into the Republic of Kazakhstan.
11. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state services: the claim is submitted addressed to the head of the service provider, or the Ministry, to the address specified in Item 14 of this standard of the state service.
The claim is submitted in writing by mail or in electronic form about the blog of the head of the Ministry, or purposely through office of the service provider, or the Ministry.
In the claim the uslugopoluchatel enters its surname, name, middle name, the postal address, reference number and date. The claim is signed by uslugopoluchatel.
The accepted claim is registered in registers of claims and appeals of physical persons and legal entities of the service provider. The document confirming adoption of the claim is the coupon, with indication of date and time, surname and initials of person which accepted the claim and also term and the place of receipt of the answer to the made complaint and contact information of officials at whom it is possible to learn about the course of consideration of the claim.
The claim of uslugopoluchatel which arrived to the service provider is subject to consideration within five working days from the date of its registration. The motivated answer about results of consideration of the claim goes to uslugopoluchatel by mail or is issued purposely in office of the service provider or the Ministry.
In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state services.
The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is considered within fifteen working days from the date of its registration.
12. In disagreement cases with results of the rendered state service, the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation of the Republic of Kazakhstan.
13. Features of rendering the state service to uslugopoluchatel with limited opportunities in case of the address to the service provider:
1) conditions for servicing of uslugopoluchatel physically challenged are provided, entrances to buildings are equipped with ramps, there are chairs for expectation;
2) for uslugopoluchatel who in connection with the state of health have no possibility of corporal appearance to the service provider documents acceptance, necessary for rendering the state service is made by the service provider with departure in place of registration of uslugopoluchatel.
14. Addresses of places of rendering the state service are placed on Internet resource of the Ministry: www.mvd.gov.kz in the Section "About Activities of Law-enforcement Bodies".
15. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of single contact center concerning rendering the state services.
