1. Approve the enclosed standard of the state service "Registration of the Foreigners and Stateless Persons Who Are Temporarily Staying in the Republic of Kazakhstan".

2. To provide to department of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan and on the intranet portal of state bodies.

3. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan Turgumbayev E. Z. and Department of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Sainov S. C).

4. This order becomes effective after ten calendar days from the date of its first official publication.

Standard of the state service "Registration of the Foreigners and Stateless Persons Who Are Temporarily Staying in the Republic of Kazakhstan"

1. General provisions

1. The state service "Registration of the Foreigners and Stateless Persons Who Are Temporarily Staying in the Republic of Kazakhstan" (further - the state service).

2. The standard of the state service is developed by the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears territorial subdivisions of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service is performed through the service provider, including through the web portal of "the electronic government" www.egov.kz (further - the portal).

Through the portal the state service is rendered in case of the appeal of the physical person accepting the foreigner regarding primary registration.

2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the date of delivery by uslugopoluchatel of document package to the service provider - 1 (one) working day;

the most allowed time of expectation for delivery of document package - 20 (twenty) minutes;

the most allowed time of servicing of uslugopoluchatel - 20 (twenty) minutes;

2) In case of the address through the portal - 15 (fifteen) minutes.

5. Form of rendering the state service: electronic (partially automated) and (or) paper.

6. Putting down in migratory card of seal and the signature of the official of the service provider is result of rendering the state service.

In case of the address through the portal to "personal account" of the uslugopoluchatel in electronic form certified by the digital signature (further - the EDS) the authorized person of the service provider, the insert to the passport about registration of the foreigner or stateless person who is unpacked on paper goes.

Form of provision of result of rendering the state service: electronic and (or) paper.

7. The state service is rendered free of charge to physical persons and legal entities (further - uslugopoluchatel).

8. Working schedule:

1) the service provider - Monday through Friday (from 9-00 till 18-30 o'clock, with lunch break from 13-00 till 14-30 o'clock) except days off (Saturday, Sunday) and holidays, according to the labor law of the Republic of Kazakhstan.

Reception of an application and issue of result of rendering the state service is performed in place of registration of uslugopoluchatel from 9:00 to 17:30 o'clock with lunch break from 13:00 to 14:30 o'clock.

The state service is rendered in turn, without making an appointment and the accelerated servicing.

2) the portal - round the clock, except for the technical breaks connected with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed the next working afternoon).

9. The list of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (the uslugopoluchatel accepting the foreigner, the stateless person and also foreigners) to the service provider:

1) the valid identity document of the foreigner or stateless person with the entry visa and stay in the Republic of Kazakhstan, for citizens of the countries with which agreements on visa-free stay are ratified the visa is not required;

2) migratory card with mark about crossing of border which is issued by officials of the Border service of Committee of homeland security of the Republic of Kazakhstan at check points through frontier;

3) the petition for registration in any form. Uslugopoluchateli, belonging to one of the categories specified in appendix to this standard of the state service are registered according to the application in person.

For registration of uslugopoluchatel (foreigners and stateless persons) which term of temporary stay in the Republic of Kazakhstan constitutes over 6 (six) months are in addition represented:

two filled address arrival leaves;

the completed coupon of the statistical recording to arrival leaf;

one photo of 35 x 45 mm in size.

In case of the address through the portal the uslugopoluchatel sends inquiry in electronic form, certified by the EDS, with indication of data on the documents specified in subitems 1), 2) of this Item.

The service provider receives data on identity documents from the corresponding state information systems through lock of "the electronic government".

3. Procedure for appeal of decisions, actions (failure to act) of service providers and (or) their officials concerning rendering the state service

10. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state services: the claim is submitted addressed to the head of the service provider, or the Ministry, to the address specified in Item 13 of this standard of the state service.

The claim is submitted in writing by mail or in electronic form about the blog of the head of the Ministry, or purposely through office of the service provider, or the Ministry.

In the claim the uslugopoluchatel enters its surname, name, middle name, the postal address, reference number and date. The claim is signed by uslugopoluchatel.

The accepted claim is registered in registers of claims and appeals of physical persons and legal entities of the service provider. The document confirming adoption of the claim is the coupon, with indication of date and time, surname and initials of person which accepted the claim and also term and the place of receipt of the answer to the made complaint and contact information of officials at whom it is possible to learn about the course of consideration of the claim.

The claim of uslugopoluchatel which arrived to the service provider is subject to consideration within 5 (five) working days from the date of its registration. The motivated answer about results of consideration of the claim goes to uslogopoluchatel by mail or is issued purposely in office of the service provider or the Ministry.

In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is considered within 15 (fifteen) working days from the date of its registration.

11. In disagreement cases with results of the rendered state service, the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

4. Other requirements taking into account features of rendering the state service including rendered electronically

12. Features of rendering the state service to uslugopoluchatel with limited opportunities in case of the address to the service provider:

1) conditions for servicing of uslugopoluchatel physically challenged are provided, entrances to buildings are equipped with ramps, there are chairs for expectation;

2) for uslugopoluchatel who in connection with the state of health have no possibility of corporal appearance to the service provider documents acceptance, necessary for rendering the state service is made by the service provider with departure in place of registration of uslugopoluchatel.

13. Addresses of places of rendering the state service are placed on Internet resources of the Ministry: www.mvd.gov.kz in the Section "About Activities of Law-enforcement Bodies".

14. Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.

15. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of single contact center concerning rendering the state services.

16. Contact telephone numbers of service desks concerning rendering the state service are specified on Internet resource of the Ministry www.mvd.gov.kz. Single contact center concerning rendering the state services: 1414.

Appendix

to the Standard of the state service "Registration of the Foreigners and Stateless Persons Who Are Temporarily Staying in the Republic of Kazakhstan"

Categories of foreigners and stateless persons which registration is performed according to the application in person

1. To citizens of the countries specified in the List of the states which citizens are exempted from need of presentation of visa support or the invitation in case of execution of single visas of categories "A1", "A2", "B1", "B2", "D1" and "G1", an of also single and double visas of category "F1" according to appendix 7 to Rules of issue of visas of the Republic of Kazakhstan, and also prolongation and reducing the terms of their action approved by the joint order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 7, 2013 No. 175 and the acting minister of foreign affairs of the Republic of Kazakhstan of March 5, 2013 No. 08-1-1-1/71.

2. Owners of visas of category "tourist";

3. The foreigners who drove to the Republic of Kazakhstan together with spouses, children or parents - foreign citizens;

4.
