1. Approve the enclosed Rules of certification and issue of the certificate of aviation training center of civil aviation.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the established legislative procedure state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction of the copy of the order on official publication in mass media and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within 10 working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of the order on the first vice-minister of investments and development of the Republic of Kazakhstan Kasymbek Zh. M.

3. This order becomes effective after twenty one calendar days after its first official publication.

Rules of certification and issue of the certificate of aviation training center of civil aviation

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of aviation training center of civil aviation (further – Rules) are developed according to subitem 41-26) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and determine procedure for certification and issue of the certificate of aviation training center of civil aviation and rendering the state service "Issue of the Certificate of Aviation Training Center of Civil Aviation" (further – the state service).

2. In these rules the following terms and determinations are used:

1) professional training of aviation personnel of civil aviation (further – professional training) - initial preparation, retraining, maintenance of professional level;

2) payments in the field of civil aviation – payment of physical persons and legal entities for the services rendered by authorized organization in the field of civil aviation and also obligatory expels of legal entities for implementation of constant surveillance over safety of flights and aviation safety by it in the budget of authorized organization in the field of civil aviation;

3) authorized organization in the field of civil aviation (further – authorized organization) – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

4) aviation training center – the legal entity performing preparation, retraining and maintenance of professional level of aviation personnel;

5) having been tired (foundation agreement) of aviation training center (further – the Charter) – the document based on which the aviation training center performs the activities according to the civil legislation of the Republic of Kazakhstan;

6) the program of professional training – the document directed to professional training of aviation personnel, developed and approved by the aviation training centers and (or) the organizations of civil aviation according to standard programs of professional training of the aviation personnel participating in safety of flights approved by authorized body in the field of civil aviation (further – standard programs), standards and recommended practice of International Civil Aviation Organization (ICAO), the European aviation rules, and approved with authorized organization;

7) maintenance of professional level – training process of aviation personnel which purpose is updating, expansion and deepening of professional knowledge, skills and abilities, caused by scientific and technical, social and economic development and individual needs of citizens, with issue of documents (the certificate, the certificate and the diploma certifying training completion);

8) retraining – the training process of specialists of industry of civil aviation directed to acquisition of new (additional) professional knowledge, skills, abilities (including qualification marks) and studying of the aircraft equipment, with issue of documents (the certificate, the certificate and the diploma certifying training completion);

9) the statement – the written appeal of the applicant to authorized organization for receipt of the certificate of aviation training center, approval of the instructor and examining personnel of aviation training center, expansion of scope of the certificate of aviation training center, recognition of the certificate of foreign aviation training center;

10) the applicant – the physical person or legal entity which addressed to authorized organization for receipt of the state service provided by these rules;

11) certified requirements – requirements imposed to aviation training centers for the purpose of establishment of compliance of the organization, content, level and quality of training of aviation personnel;

12) the register of acknowledged foreign aviation training centers – the document in which record about acknowledged the foreign aviation training centers performing professional training of aviation personnel of civil aviation of the Republic of Kazakhstan is kept;

13) standard programs – the programs approved by authorized body, providing uniform approach to professional training with preserving possibility for aviation training center and the organization of civil aviation of independent creation of the training programs reflecting features of the directions, specialties and activities.

3. Documents acceptance and issue of the certificate of aviation training center (further - the certificate) is performed by means of the web portal of "the electronic government" (further - the portal).

4. For certification of aviation training center (further - certification) and expansions of scope of the certificate of aviation training center the payment according to the procedure which is determined by the order of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of March 24, 2023 No. 177 "About approval of Rules of collection of payments in the field of civil aviation of the Republic of Kazakhstan" is levied (it is registered in the Register of state registration of regulatory legal acts for No. 32120).

The amount of payment is determined by the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of March 17, 2023 No. 167 "About approval of the list of paid services of authorized organization in the field of civil aviation and rates of payments in the field of civil aviation" (it is registered in the Register of state registration of regulatory legal acts No. for 32089) (further – the List of paid services of authorized organization in the field of civil aviation and rates of payments in the field of civil aviation).

Certification and expansion of scope of the certificate of aviation training center is performed after receipt of payment in the budget of authorized organization.
