About introduction of amendments to the Law of Ukraine "About the higher education" concerning establishment of restrictions when electing to position (appointment of the acting as) of the head of higher educational institution

The Verkhovna Rada of Ukraine decides:

I. Article 42 of the Law of Ukraine "About the higher education" (2014, Art. No. 37-38, 2004) after part one to add sheets of the Verkhovna Rada of Ukraine with new part of the following content:

"2. Cannot be chosen, appointed (including the acting as) to position of the head of higher educational institution person who:

1) by a court decision acknowledged incapacitated or capacity to act of which is limited;

The criminal record for crime execution has 2) if such criminal record is not extinguished or is not removed in the procedure established by the law;

3) according to the court verdict it is deprived of the right to hold the corresponding positions;

4) by a court decision it was found guilty of making of corruption offense - within year from the date of the introduction of the relevant decision of court in legal force;

5) was exposed to administrative punishment for corruption offense - within year from the date of the introduction of the relevant decision of court in legal force;

6) falls under action of part three of article 1 of the Law of Ukraine "About cleaning of the power";

7) voted for the dictatorial laws on January 16, 2014".

With respect thereto the second - the fifth to consider parts respectively parts three - the sixth.

II. Final provisions

1. This Law becomes effective from the date of, its publication following behind day.

2. The acting as the head of higher educational institution who on the date of entry into force of this Law falls under action of part two of article 42 of this Law is subject to release by the founder (founders) or the body (person) authorized by it (them) within two weeks from the date of entry into force of this Law.

3. To the Cabinet of Ministers of Ukraine within two months from the date of publication of this Law:
