RESOLUTION OF BOARD OF THE NATIONAL BANK OF UKRAINE

About modification of some regulatory legal acts of the National Bank of Ukraine

According to Articles 7, of 25, of 44, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 5, of 11, 13 Decrees of the Cabinet of Ministers of Ukraine of February 19, 1993 No. 15-93 "About system of currency control and currency exchange control", for the purpose of enhancement of regulatory legal acts of the National Bank of Ukraine the Board of the National Bank of Ukraine DECIDES:

1. Approve Changes in:

1) the Instruction about procedure for issue of individual licenses on implementation of investments abroad approved by the resolution of Board of the National Bank of Ukraine of March 16, 1999 No. 122, registered in the Ministry of Justice of Ukraine on April 26, 1999 for No. 259/3552 (with changes) which are applied;

2) the Rules of export from Ukraine and import to Ukraine authorized banks of national and foreign currency, bank metals, check forms approved by the resolution of Board of the National Bank of Ukraine of August 6, 2003 No. 327, registered in the Ministry of Justice of Ukraine on August 29, 2003 for No. 753/8074 (with changes) which are applied;

3) the Regulations on procedure for issue of individual licenses on transfer of foreign currency out of limits of Ukraine for payment of bank metals and carrying out separate currency transactions approved by the resolution of Board of the National Bank of Ukraine of June 17, 2004 No. 266, registered in the Ministry of Justice of Ukraine on July 16, 2004 for No. 897/9496 (with changes) which are applied;

4) Regulations on procedure for issue of individual licenses by the National Bank of Ukraine on the placement of currency values by residents (legal entities and physical person) on accounts outside Ukraine approved by the resolution of Board of the National Bank of Ukraine of October 14, 2004 No. 485, registered in the Ministry of Justice of Ukraine on November 5, 2004 for No. 1413/10012 (with changes) which are applied;

5) Regulations on procedure for issue of individual licenses by the National Bank of Ukraine on use of foreign currency in the territory of Ukraine as instruments of payment, approved by the resolution of Board of the National Bank of Ukraine of October 14, 2004 No. 483, registered in the Ministry of Justice of Ukraine on November 9, 2004 for No. 1429/10028 (with changes) which are applied;

6) the Instruction about movement of cash and bank metals through the customs border of Ukraine approved by the resolution of Board of the National Bank of Ukraine of May 27, 2008 No. 148, registered in the Ministry of Justice of Ukraine on June 11, 2008 for No. 520/15211 (with changes) which are applied;

2. Bring in the Regulations on movement of securities through customs border of Ukraine approved by the resolution of Board of the National Bank of Ukraine of December 22, 2011 No. 469, registered in the Ministry of Justice of Ukraine on January 24, 2012 on No. 105/20418 (with changes), the following changes:

1) in appendices 1 and 2:

the detail "Contact person" after the words "phone number" to add with words ", the e-mail address";

2) in appendix 6:

in Item 2 of the word "Inspection department, methodology and licensing of currency transactions" shall be replaced with words:

Changes to the Instruction about procedure for issue of individual licenses on implementation of investments abroad

1. To add Item 1.1 of Chapter 1 after paragraph two with the new paragraph third the following content:

"Do not require receipt of the individual license of the National Bank of Ukraine on implementation of investment of transaction with carrying out calculations by subjects of investments in the territory of Ukraine in hryvnias for the purpose of acquisition of property right to investees abroad".
