ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of the Regulations on procedure for obtaining, accounting, storage, systematization and use of dactyloscopic data and the List of the positions held by persons which are subject to obligatory dactyloscopic registration

(as amended on 17-12-2025)

In pursuance of part (3) Article 12 and part (2) article 13 of the Law on the state dactyloscopic registration of N1549-XV of December 19, 2002. (The official monitor of the Republic of Moldova, 2003, N 14-17, Art. 51) DECIDES: the Government

1. Approve:

Regulations on procedure for obtaining, accounting, storage, systematization and use of dactyloscopic data according to the appendix N1;

The list of the positions held by persons which are subject to obligatory dactyloscopic registration according to the appendix N 2.

2. To perform financing of the measures concerning the organization and carrying out dactyloscopic registration, and also accounting, storage and systematization of dactyloscopic data from budgets of the relevant ministries, organizations. The expense budget of the ministries represented to the Ministry of Finance, departments and services shall include also the expenses connected with the state dactyloscopic registration since January 1, 2004.

3. Determine that the ministries, organizations which perform the state dactyloscopic registration shall be provided:

appropriate technical means and necessary material carriers;

conditions for storage of dactyloscopic arrays and confidential mode of use of information.

4. To the ministries, organizations which perform the state dactyloscopic registration, in 10-day time from the date of publication of this resolution to review departmental regulations according to provisions of this resolution.

Since April 1, 2017 the words "Main State Tax Authorities" are shall be replaced with words State Tax Administration.

to the Order of the Government of the Republic of Moldova of October 31, 2003 No. 1310

Regulations on procedure for obtaining, accounting, storage, systematization and use of dactyloscopic information

I. General provisions

1. This provision is developed according to the Law on the state dactyloscopic registration of N1549-XV of December 19, 2002 and determines the main conditions of obtaining, accounting, storage, the systematization and use of dactyloscopic data received in the course of carrying out the state dactyloscopic registration.

1-1. Processing of personal data in case of receipt, accounting, storage, systematization and use of dactyloscopic data is performed according to provisions of the Marine life protection act of personal data.

1-2. According to this Provision only strictly necessary personal data which are not excessive concerning the established purpose, according to competences which allocate competent authorities will be processed, providing the proper level of safety and confidentiality concerning the risks connected with processing and nature of data according to the principles established by the legislation on personal data protection.

1-3. Within the processing of personal data performed based on this provision observance of the rights of subjects of personal data according to provisions of the Marine life protection act of personal data is provided.

2. The information array created in the course of carrying out the state dactyloscopic registration and managed by the Ministry of Internal Affairs is intended for:

a) search and identification of missing citizens of the Republic of Moldova and foreigners;

b) establishments on unknown corpses of the identity of the person;

c) establishments and/or confirmations of the identity of citizens of the Republic of Moldova and foreigners if it is not possible to make it different way;

d) prevention and fight against crime

3. The information array created in the course of carrying out the state dactyloscopic registration includes arrays of dactyloscopic data which are created and conducted by law-enforcement bodies and Service of information and safety.

4. Information technology of functioning of dactyloscopic arrays shall be compatible to the information technology accepted in law-enforcement bodies.

5. Degree of privacy of information containing in dactyloscopic arrays is determined by the head of body given authority on reference of data to the state secret. The address with such information is performed according to requirements of regulations in the field of protection of the state secret.

5-1. Control concerning compliance of transactions on processing of personal data is exercised by the National center for personal data protection in conditions, stipulated by the legislation about personal data protection. Within the executed checks this organization will be given necessary support and the information access, check, necessary for accomplishment, is provided

II. Structure and objects of accounting of the information array created in the course of carrying out the state dactyloscopic registration

6. The information array created in the course of carrying out the state dactyloscopic registration and managed by the Ministry of Internal Affairs is constituted from dactyloscopic data, belonging to the objects of accounting provided in Item 7 of this provision. The array of dactyloscopic data of office structure of Service of information and safety is created and controlled Service of information and safety.

7. Objects of the accounting of the dactyloscopic information array created in the course of carrying out the state dactyloscopic registration and managed by the Ministry of Internal Affairs are:

1) the citizens of Moldova serving in:

a) Ministry of Internal Affairs;

b) Ministry of Defence;

c) To service of the state protection;

d) Department of penal institutions of the Ministry of Justice;

e) to prosecutor's office;

f) National center for fight against corruption;

g) To Customs Service;

h) To the State Tax Service;

2) members of crews of the national and private aircrafts of the Republic of Moldova;

3) drivers of vehicles;

4) ceased to be valid according to the Order of the Government of the Republic of Moldova of 16.04.2025 No. 209

5) the citizens of the Republic of Moldova and foreigners not capable for health reasons or I will increase to report data on the personality if it is not possible to establish these data otherwise;

6) the citizens of the Republic of Moldova and foreigners who are under examination, accused of crime execution or condemned for crime execution, and also the faces subjected to arrest for offense;

7) the foreigners who requested about provision of shelter according to provisions of the Law No. 270/2008 on shelter in the Republic of Moldova, the foreigners detained for illegal crossing of frontier, who arrived from foreign state or being in situation of illegal stay in the territory of the Republic of Moldova;

7-1) foreigners at the age of at least 14 years petitioning for international protection in Item of crossing of frontier;

7-2) foreigners at the age of at least 14 years detained for illegal crossing of frontier, who arrived from other country;

7-3) foreigners taken on the state content in the territory of the Republic of Moldova and placed in the Center of temporary accommodation of foreigners of competent authority for foreigners, and also removed under maintenance within 24 hours;

8) unknown corpses;

9) the citizens of the Republic of Moldova who underwent dactyloscopic registration in voluntary procedure.

8. Objects of accounting of the dactyloscopic array managed by SIB are the citizens serving in SIB.

III. Forms of the material carriers containing dactyloscopic data

12. In the information array created in the course of carrying out the state dactyloscopic registration the following main forms of the material carriers containing dactyloscopic data are used (further - material carriers):

the dactyloscopic card intended for obligatory state dactyloscopic registration of persons specified in subitems 1), 2), 4), 7) and 9) of Item 7 of this provision and for voluntary state dactyloscopic registration of persons specified in Item 11 of this provision (appendix No. 1);

the dactyloscopic card intended for obligatory state dactyloscopic registration of persons specified in subitems 5), 6) and 8) Item 7 of this provision (appendix No. 2).

13. Filling of material carriers is performed according to the Basic rules of fingerprinting and filling of dactyloscopic cards (appendix No. 3). Dactyloscopic data concerning persons specified in subitems 3) and 7)-7-3) of Item 7, are represented exclusively in electronic form.

14. Material carriers are filled with printing method. As the exception, is allowed filling by hand, at the same time adjusting data register printing letters ball pen.

IV. Receipt of dactyloscopic data and the direction of material carriers for registration

15. Receipt of dactyloscopic data (fingerprinting) is performed according to the Basic rules of fingerprinting and filling of dactyloscopic cards (appendix N 3).

16. Dactyloscopic data on persons specified in subitems 1) and 2) of Item 7 of this provision receive the relevant ministries, organizations.

The organization of receipt of dactyloscopic data is determined by heads of the relevant ministries, organizations in coordination with the Ministry of Internal Affairs.

17. Dactyloscopic data on persons specified in Item 8 of this provision receive the bodies of SIB which are independently creating and the leading dactyloscopic arrays of staff. Material carriers go to the corresponding dactyloscopic arrays.

18. Dactyloscopic data of persons specified in subitems 5) 8) and 9) of Item 7, receive divisions of the Ministry of Internal Affairs. The material carriers provided in appendix No. 1, go to the information array managed by the Ministry of Internal Affairs without accounting card regulated in appendix No. 4 to this Provision. The dactyloscopic data specified in the subitem 3) of Item 7, receive including with use of live-scanners and by data recording of the General inspectorate of police of the Ministry of Internal Affairs by divisions in the Automated information system "State Dactyloscopic Register" in their central organizations or at offices of the Agency of the state services. 

18-1. Dactyloscopic data of persons specified in subitems 7) and 7-3) Items 7, turn out the General inspectorate on migration by use of live-scanners and data recording in the Automated information system "State Dactyloscopic Register".

18-2. Dactyloscopic data of persons specified in subitems 7-1) and 7-2) of Item 7, are received by Boundary police by means of live-scanners and by data recording in the Automated information system "State Dactyloscopic Register".

19. Dactyloscopic data on persons specified in the subitem 6) of Item 7 of this provision namely, about the citizens of the Republic of Moldova and foreigners who are under examination, accused of crime execution or condemned for crime execution are received by investigating bodies, and also National penitentiary administration. Material carriers (appendix No. 2) with the accounting card (appendix No. 4) go in subsequent to the information array managed by the Ministry of Internal Affairs.

Dactyloscopic data on persons specified in the subitem 6) of Item 7 of this provision namely, about the citizens of the Republic of Moldova and foreigners subjected to arrest for offense are received by National penitentiary administration. Material carriers (appendix No. 2) without accounting card (appendix No. 4) go in subsequent to the information array managed by the Ministry of Internal Affairs

21. The material carriers received as a result of the state dactyloscopic registration (except for specified in Item 17 of this provision), go to law-enforcement bodies.

Material carriers shall be prepared with respect for the information technologies used when conducting operational and help accounting and shall include, except fingerprints of hands and palm, the following data:

surname, name, middle name, identification number, nationality, floor, birth date and birth place, the residence or the location of person which underwent obligatory state dactyloscopic registration;

basis and date of dactyloscopic registration;

the name of the body which registered dactyloscopic data.

Persons this about criminal record, undergone obligatory state dactyloscopic registration, are entered into material carriers directly by the Ministry of Internal Affairs.

22. Material carriers in one copy with the accounting card or, as necessary, without accounting card (appendix No. 4) in 3-day time go to Service of information technologies of the Ministry of Internal Affairs.

To the direction in Service of information technologies material carriers are stored in the relevant divisions of bodies and organizations.

23. The direction of material carriers in the dactyloscopic array of bodies of SIB specified in the paragraph the second Item 6 of this provision is performed according to the procedure, determined by regulations of relevant organs.

After dismissal from service (work) material carriers from dactyloscopic data on the staff of bodies of SIB go within 3 days to Service of information technologies of the Ministry of Internal Affairs according to requirements of paragraph two of Item of 21 this provision.

V. Methods of forming and maintaining dactyloscopic arrays

24. Forming and maintaining dactyloscopic arrays is performed by two methods: manual (dactyloscopic array) and automated.

25. In case of manual forming and maintaining dactyloscopic array the dactyloscopic card-index intended for the organization of access to dactyloscopic array according to the dactyloscopic formula and barcodes specified on material carriers is created (appendices No. 1 and 2).

The procedure for creation and conducting operational and information accounting is determined by the Ministry of Internal Affairs.

26. The automated forming and management of information arrays implies use of the automated information system of dactyloscopic accounting managed by the Ministry of Internal Affairs, except for the information dactyloscopic array managed by Service of information and safety.

Automation of dactyloscopic array assumes convertion (by scanning) dactyloscopic data from material carriers in electronic form, or obtaining directly in electronic format of dactyloscopic data by means of the live-scanners connected to workstations which are in turn directly connected through the protected connections with the automated information system of dactyloscopic accounting managed by the Ministry of Internal Affairs.

For extraction/check/comparison of the data necessary for dactyloscopic registration, the information automated systems of dactyloscopic accounting managed by the Ministry of Internal Affairs can be interconnected in strict accordance with the existing regulations, with other state registers.

The mechanism of registration and accounting of the users having access, the rights and obligations of persons responsible for access, visualization, collection and processing of dactyloscopic data, including method of their accumulating and storage will be provided by Regulations on the organization and functioning of the Automated information system "State Dactyloscopic Register".

Ensuring protection, safety and integrity of information containing in information systems of dactyloscopic accounting is performed by specialized divisions of the Ministry of Internal Affairs according to the current legislation.

27. When forming of the automated dactyloscopic arrays use of electronic dactyloscopic scanners and "live" scanners is admissible.

VI. Appeal to information array

28. Dactyloscopic data from the information array (the copy of dactyloscopic cards) created in the course of the state dactyloscopic registration it is represented to the courts, bodies of prosecutor's office, criminal prosecution authorities and bodies performing operational search activities (further - body - the initiator of request) taking into account their powers and restrictions set by the legislation when using dactyloscopic data.

29. The appeal to the information array created in the course of the state dactyloscopic registration is performed in request form. The request contains the motivated letter of any form with appendix of material carriers:

dactyloscopic cards (appendices N 1 and 2);

dactyloscopic cards (appendix N 2) with fingerprints of hands of unknown corpses;

information cards with traces of fingers of the hands withdrawn from places of unsolved crimes if the technology of maintaining dactyloscopic array allows to run for search in single fingerprint of hand (in case of the automated maintaining dactyloscopic array).

30. In the motivated letter the data allowing to assume possibility of finding of the interesting information in dactyloscopic array are surely specified.

31. Motivated letters shall be without fail signed officials of body - the initiator of request to whom this right is granted by regulations, and are certified by impress of a seal of body.

32. Unsigned motivated letters of the official of body - the initiator of request and impress of a seal, and also the material carriers of dactyloscopic data filled carelessly, with violations of the Basic rules of fingerprinting and filling of dactyloscopic cards (appendix N 3) and not meeting the requirements of regulations of relevant organs, return to the initiator of request without execution.

33. Body - the initiator of request within the powers sends inquiry to one or several bodies performing forming and maintaining dactyloscopic arrays (further - contractors).

34. Access to dactyloscopic arrays can be limited by requirements of legal acts in the field of protection of the state secret.

35. Control of use of dactyloscopic data is imposed on heads of state bodies to whom dactyloscopic data were issued.

36. In case of receipt of request the contractor performs on dactyloscopic array. The results of check sent to the initiator of request are drawn up in any form with appendix of the material carrier which arrived on check.

37. Requests of state bodies within their powers on check on the information array created in the course of carrying out the state dactyloscopic registration are performed no more than 5 days from the moment of obtaining, urgent in time - no later than the next working day.

38. Execution of request is performed according to the procedure, established by regulations of relevant organs.

VII. Control of forming and maintaining the information array created in the course of carrying out the state dactyloscopic registration

39. For the purpose of quality assurance, reliability, completeness of dactyloscopic information, timeliness of the direction of the material carriers determined by this provision control of their filling is exercised. Such control is conducted:

divisions of the ministries, organizations to which receipt of dactyloscopic information is assigned, - before the direction of material carriers in dactyloscopic arrays;

divisions of the bodies performing forming and maintaining dactyloscopic arrays - in case of receipt of material carriers.

40. The material carriers prepared with violations of the Basic rules of fingerprinting and filling of dactyloscopic cards (appendix N 3) and mistakes which cannot be corrected without refining are subject to immediate return to the sender.

41. Forms of control of quality, reliability, completeness and timeliness of provision of dactyloscopic data are determined by regulations of the bodies performing forming and maintaining dactyloscopic arrays.

42. Control of quality of forming and maintaining dactyloscopic arrays is assigned to division managers of relevant organs.

VIII. Storage durations of material carriers

43. The service of information technologies of the Ministry of Internal Affairs stores material carriers from dactyloscopic data:

a) about persons to whom this resolution extends (except for persons which are registered in Service of information and safety), - before factual determination of their death;

b) about unknown corpses - before identification of the person.

The service of information and safety stores material carriers from dactyloscopic data on persons which are registered in it, before factual determination of their death.

The dactyloscopic data obtained as a result of carrying out voluntary and obligatory dactyloscopic registration it is destroyed after storage durations.

Basic rules of fingerprinting and filling of dactyloscopic cards

1. For fingerprinting it is necessary to have:

forms of dactyloscopic cards (appendices No. 1 and 2 to this provision);

the black typographical paint (providing preserving dactyloscopic data);

the roller for putting ink;

two smooth metal or glass plates for paint expansion (further - plates);

paint remover or special finger-printing kits;

table for fingerprinting.

Paint shall not be showered and spread both when fingerprinting, and in case of long-term use of dactyloscopic cards. Application of other means of fingerprinting is admissible only after their certification by relevant organs.

2. Before receipt of prints it is necessary to inspect hands of fingerprinted. If on fingers and palms open wounds or damages of integuments are found, fingerprinting is made after their treatment.

3. Typographical paint even layer is rolled with the roller on plate. The same roller (without additional putting paint on it) rolls thin paint coat on the second plate on which fingers of fingerprinted are rolled. The form of the dactyloscopic card put along the upper line of excess is put on the table edge near plate (from its right side). The employee making fingerprinting costs on the right side of table, fingerprinted - to the left of the employee, facing table.

4. Fingerprinting begins with thumb of the right hand and comes to an end with little finger. Fingerprinted straightens fingers consistently, since big, having pressed other fingers of hand to palm. The employee making fingerprinting, three fingers of the left hand (big, index and average) takes finger fingerprinted at the basis (closer to palm), and the fingers of the right hand of the same name takes nail phalanx of the same finger. The hand of fingerprinted shall be free, not intense. The finger fingerprinted by lateral face of nail phalanx is put on edge of plate and rolled on it from one edge of nail to another. Thumbs are rolled towards other four fingers. Index, average, anonymous and little finger are rolled towards thumb. When rolling finger on plate it is necessary that painted there was all small pillow of nail phalanx and 3-5 mm of average phalanx. After that the coated finger is rolled by the same method on the place of the form of the dactyloscopic card allocated to it for receipt of print. Rolling is performed by easy pressing finger regularly and without shifts. Upon termination of rolling the employee making fingerprinting without issuing finger, lifts it up, without greasing the image of papillary pattern. In the absence of any finger the place allocated for it on the form of the dactyloscopic card remains free.

5. For fingerprinting of fingers of the left hand paint on the second plate is rolled again according to Item 3. The form of the dactyloscopic card develops on the lower line of excess. Fingerprinting of fingers of the left hand is performed in the same order, as the right hand.

6. Upon termination of fingerprinting of fingers of the left hand paint on plate is rolled with uniform and thin layer for receipt of control fingerprints of both hands again. Control prints receive by simultaneous applying of four fingers (without big) at first the left, then right hand to the painted plate, and then to the places intended for them on the form of the dactyloscopic card. Similarly receive control prints of thumbs on specially allotted places of the form of the dactyloscopic card. In case of receipt of control prints fingers shall be located perpendicular to the lower edge of the dactyloscopic card.

7. On control prints correctness of placement of prints on the dactyloscopic card is checked. Each print shall be in the place of the form of the dactyloscopic card corresponding to it.

8. Upon termination of fingerprinting quality of each print is checked:

the completeness of rolling providing display of all characteristics of papillary pattern;

lack of the dirty and not printed sites;

the clearness of display of all papillary lines providing their calculation with the naked eye, calculation of dactyloscopic formula and formula of additional classification.

9. In case of violation of conditions of Items 7 and 8 repeated fingerprinting is conducted.

9-1. For removal of prints of palms typographical ink is applied by means of the roller with even layer on two plates. On the second plate on which palms of the fingerprinted person are rolled thin film of ink is applied by the same roller (without additional putting ink). On the edge of table near plate the form of dactyloscopic card (on the right side) is placed (from reverse side). The employee making fingerprinting costs on the right side of table, and person who is exposed to fingerprinting - to the left of the employee facing table. The hand of the fingerprinted person shall be free, not intense. The palm of the fingerprinted person is located with the lower party on surface of plate and is carried out on it from one edge to another. When carrying out palm on plate it is necessary that remained the palm painted all surface.

Then the palm covered with ink is rolled on the respective site of the form of the dactyloscopic card (reverse side of the form) for receipt of print of palms. Rolling is performed regularly and without shifts by easy pressing palm. Upon termination of rolling the employee making fingerprinting without issuing palm, raises it up, without greasing the image of papillary pattern.

Upon termination of fingerprinting quality of each print is checked:

- the completeness of rolling providing display of all characteristics of papillary pattern;

- lack of the dirty and not printed sites;

- the clearness of display of all papillary lines providing their calculation with the naked eye.

9-2. Process of fingerprinting of persons specified in subitems 3) and 7) of Item 7 of this provision begins with opening at the workstation of the appendix "AFIS" of line item of registration of the dactyloscopic card and filling of obligatory fields: accounting number, identification number, surname, name, middle name, number, month, year of birth, the birthplace, the residence, category and type of registration, the division which executed registration.

Further, in the appendix "AFIS" the button of removal of prints by means of the live-scanner is pressed. The hand of the fingerprinted person keeps freely, not tensely. Initially control fingerprints fingerprinted (index, average, anonymous and little finger) by their simultaneous applying to the places intended for them, on the lit glass surface of the live-scanner are removed. Control scanning of fingerprints (index, average, anonymous and little finger) the left hand, then in the same way fingers is performed (index, average, anonymous and little finger) the right hand, then two thumbs of both hands, expecting sound signal of fixing of the image of the papillary drawing in the appendix "AFIS".

After carrying out control scanning of fingerprints of both hands scanning of fingerprints by rolling on the lit glass surface of the live-scanner according to the procedure of the electronic indicator (index, average, anonymous and little finger of the left hand, the right hand, then thumbs of the left and right hand), from one edge to another, to sound signal of fixing of the image of the papillary drawing in the appendix "AFIS" is performed. Index, average, anonymous fingers and little finger are rolled towards thumb. Thumbs are rolled towards other four fingers. In case of lack of any finger, the employee designates in the appendix "AFIS" the appropriate place symbol "x".

Scanning of palms (the left hand, then the right hand) is performed by means of positioning on the lit glass surface of the live-scanner, with easy pressing of palm, regularly and without shifts, to sound signal of fixing of the image of the papillary drawing in the appendix "AFIS" on the computer. After completion of fingerprinting of fingerprints and palms quality of each print positioned in the appendix "AFIS" then the keep button is pressed is checked.

10. When fingerprinting it is not allowed:

fingerprinting of dirty and wet hands;

strong pressing on fingers fingerprinted in case of their rolling on the painted plate and according to the dactyloscopic card;

repeated rolling of the same finger on plate and according to the dactyloscopic card;

sliding of finger both on plate, and according to the dactyloscopic card;

rolling of finger on already used paint coat on plate;

use of the contaminated rollers and plates (which are not wiped after removal of prints by the solvent before complete removal of paint from their surface).

11. For receipt of print from the deformed finger which cannot be straightened the small pillow of nail phalanx is painted by means of the roller by typographical paint. Then the paper small square which by means of special tray (or matchbox) is imposed on nail phalanx of the deformed finger is cut out. For receipt of print the finger in case of easy pressing is rolled according to paper. The paper small square with fingerprint is pasted on the place corresponding to it on the form of the dactyloscopic map with obligatory subsequent check of correctness of its placement.

12. Fingerprinting of fingers of corpse is performed according to the rules stated in Item 11. Before fingerprinting fingers and palms of corpse wipe with any degreasing solvent - alcohol, gasoline, turpentine, etc. Upon termination of fingerprinting correctness of placement of prints on the form of the dactyloscopic card is checked. Control fingerprints and palms of corpse receive according to requirements of Item 6. In case of difficulty of the fingerprinting connected with corpse condition the forensic scientist is attracted.

2) in the appendices N 1 and 2 to provision:

surname, name, middle name, identification number, nationality, floor, the birth date and birth place, information on registration at the place of residence (location) supplied about criminal record of person which underwent the state dactyloscopic registration;

the name of the body which was carrying out dactyloscopic registration;

the basis and date of the state dactyloscopic registration, surname and signatures of the persons which constituted the dactyloscopic card and which checked correctness of its creation.

15. Calculation of dactyloscopic formula and formula of additional classification is performed by the bodies creating and conducting dactyloscopic arrays.
