1. General provisions

1. These rules of creation, registration and consideration of the request for industrial design, entering of data into the State register of industrial designs of the Republic of Kazakhstan, and also issue of the security document (further - Rules) are developed according to item 4 of article 19 of "The patent law of the Republic of Kazakhstan" of the Law of the Republic of Kazakhstan (further - the Law) and determine procedure for creation, registration and consideration of the request for industrial design, entering of data into the state register of industrial designs of the Republic of Kazakhstan (further - the State register), and also issues of the security document.

6) the International classification of industrial designs - the classification of industrial designs accepted by the Lokarnsky Agreement of October 8, 1968 (further - MKPO);

8) the expert organization - the organization subordinated to authorized body performing activities in the spheres referred to the state monopoly (rendering services in the field of protection of inventions, useful models, industrial designs);

2. Procedure for creation and execution of the request for industrial design

3. The application is submitted by person having the right to the patent for industrial design (further - the Applicant):

1) author (authors) of industrial design;

2) the employer if the industrial design is office;

3) the legal successor, including person who acquired the appropriate right according to the procedure of concession;

4) jointly persons, the provided this Item, on condition of consent between them.

The right to application and receipt of the patent for office industrial design belongs to the employer if other is not provided in the contract between him and the worker.
