According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", I ORDER:

1. Approve:

1) the standard of the state service "Certification of Faces of Command Structure of Courts", according to appendix 1 to this order;

2) the standard of the state service "Certification of Faces of Command Structure of Courts", according to appendix 2 to this order;

3) the standard of the state service "Issue of the Certificate on the Minimum Structure of Crew of the Vessel", according to appendix 3 to this order;

4) No. 661 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 22.08.2019;

2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A. A.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Certification of Faces of Command Structure of Courts"

Chapter 1. General provisions

1. The state service "Certification of Faces of Command Structure of Courts" (further - the state service).

2. The standard of the state service is developed by the Ministry for Investments and Development of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears territorial authorities of Committee of transport of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service is performed through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. The term of rendering the state service in case of the address on the portal:

issue of the certificate of passing of certification for faces of command structure of courts - no later than 22 (twenty two) working days;

issue of the duplicate of the certificate of passing of certification for faces of command structure of courts - 2 (two) working days.

5. Form of rendering the state service: electronic (partially automated).

1) the service provider - Monday through Friday inclusive from 9:00 to 18:30 o'clock, with lunch break from 13:00 till 14:30 o'clock, except days off (Saturday and Sunday) and holidays, according to the labor law of the Republic of Kazakhstan;

2) the portal - round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours of the service provider, on the weekend and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working afternoon).

9. The list of documents necessary for rendering the state service in case of the address of uslugopoluchatel on the portal:

1) for receipt of the certificate of passing of certification for faces of command structure of courts:

the statement in form, according to appendix 1 to this standard of the state service in electronic form, the uslugopoluchatel certified by the EDS;

electronic copy of the professional diploma;

the electronic copy of the conclusion of medical commission about suitability to work on the vessel (the medical certificate in form 086/at approved by the order of the acting minister of health care of the Republic of Kazakhstan of November 23, 2010 No. 907, registered in the Register of state registration of regulatory legal acts for No. 6697);

2) for receipt of the duplicate of the certificate of passing of certification for faces of command structure of courts:

the statement in form, according to appendix 2 to this standard of the state service in electronic form, the uslugopoluchatel certified by the EDS.

Data of the identity document of uslugopoluchatel, the service provider receives from the corresponding state information systems through lock of "the electronic government".

When giving the uslugopoluchatel of all necessary documents through the portal - in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of date and time.

10. The service provider refuses rendering the state service in the following bases:

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

2) discrepancy of uslugopoluchatel and (or) the provided materials, supplied and the information necessary for rendering the state service, according to requirements, the statutory rules of certification and certification of faces of command structure of the courts which are subject to state registration in the State ship register of the Republic of Kazakhstan, approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of March 27, 2015 No. 355 (it is registered in the Register of state registration of regulatory legal acts for No. 11234), and Allowing requirements and the list of the documents confirming compliance to them for issue of the professional diploma and the certificate of passing of certification for faces of command structure of courts, approved by the order of the Minister of investments and development of the Republic of Kazakhstan of October 19, 2015 No. 995 (it is registered in the Register of state registration of regulatory legal acts for No. 12824).

Chapter 3. Procedure for appeal of decisions, actions (bezdeystviye) of the central state bodies, and also the service provider and (or) his officials concerning rendering the state services

11. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials, concerning rendering the state services:

the claim is submitted addressed to the head of the service provider, or addressed to the head of the Ministry of the addresses specified in Items 13 and 13-1 of this standard of the state service.

The claim is submitted in writing by mail or purposely through office of the service provider or the Ministry, in the working days, and also by means of the portal.

Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider or the Ministry, with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint.

The claim of uslugopoluchatel which arrived to the service provider, the Ministry is subject to consideration within five working days from the date of its registration.

In the claim of uslugopoluchatel its surname, name, and also at will middle name and the postal address are specified.

The claim shall be signed by uslugopoluchatel.

12. In disagreement cases with results of the rendered state service, the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

13. Addresses of places of rendering the state service are placed on Internet resource of the Ministry - www.miid.gov.kz, the Section Committee of Transport, the subsection "State Services".
