About modification and amendments in the order of the Minister of Agriculture of the Republic of Kazakhstan of December 12, 2014 No. 4-2/664 "About approval of Rules of subsidizing of development of seed farming"

1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of December 12, 2014 No. 4-2/664 "About approval of Rules of subsidizing of development of seed farming" (registered in the Register of state registration of regulatory legal acts at No. 10190, published on April 1, 2015 in information system of law of Ad_let) the following changes and amendments:

in the Rules of subsidizing of development of seed farming approved by the specified order:

be reworded as follows Item 2:

"2. In these rules the following concepts are used:

1) seeds of the first reproduction - seeds from reproduction of seeds of elite of the first year;

2) seeds of hybrids of the first generation - seeds of the plants received from crossing of genetically differing parent forms and exceeding owing to heterosis the best parent form on productivity or other indicators;

3) seeds of the second reproduction - seeds from reproduction of seeds of the first reproduction;

4) seeds of the third reproduction - seeds from reproduction of seeds of the second reproduction.";

be reworded as follows Item 6:

"6. The resolution of local executive body of area in coordination with the Ministry of Agriculture of the Republic of Kazakhstan (further - the Ministry) within thirty calendar days after enforcement of these rules in 2015 and annually till December 20 of the year preceding year of crops the minimum regulations of acquisition (use) on the harvest eve of next year of seeds of the first reproduction and hybrids of the first generation on areas and by cultures which shall not differ (in the big or smaller party) from the regulations of acquisition (use) of seeds of the first reproduction and hybrids of the first generation specified in appendix 1 to these rules, more than twice affirm.";

"8. Subsidies intend for partial cost recovery:

At the same time agricultural producers acquire seeds of the first reproduction and hybrids of the first generation at seed-growing farms, implementors of seeds, the foreign companies and their official representatives in the Republic of Kazakhstan;

2) seed-growing farms for the seeds of the first reproduction and hybrids of the first self-produced generation used on crops;

3) elite and seed-growing farms on production of elite saplings of fruit and berry cultures and grapes on condition of their realization to agricultural producers at the reduced the price cost;

4) agricultural producers, except for seed-growing farms, on acquisition of seeds of wheat second and (or) third of reproductions (including the seeds imported from the countries of the FSU and beyond and other areas of the republic according to the legislation of the Republic of Kazakhstan in the field of seed farming). At the same time agricultural producers acquire seeds of wheat second and (or) third of reproductions at seed-growing farms, implementors of seeds, the foreign companies and their official representatives in the Republic of Kazakhstan.";

the paragraph one of the subitem 1) of Item 9 to be reworded as follows:

"1) giving by agricultural producer in department till July 20 of the corresponding year - on summer cultures, till November 10 of the corresponding year - on winter crops of the request for receipt of subsidies for acquisition of seeds of the first reproduction and hybrids of the first generation in form according to appendix 2 to these rules, with appendix:";

the paragraph one of the subitem 1) of Item 10 to be reworded as follows:

"1) giving by seed-growing economy in department till July 20 of the corresponding year - on summer cultures, till November 10 of the corresponding year - on winter crops of the request for receipt of subsidies for the seeds of the first reproduction and hybrids of the first self-produced generation used for crops in form according to appendix 7 to these rules, with appendix:";

the paragraph one of the subitem 1) of Item 11 to be reworded as follows:

"1) giving by elite and seed-growing economy in department till July 20 of the corresponding year of the request for receipt of subsidies for partial reduction in cost of elite saplings of fruit and berry cultures and grapes in form according to appendix 10 to these rules, with appendix:";

add with Item 11-1 of the following content:

"11-1. The subsidies specified in the subitem 4) of Item 8 of these rules are paid on condition of giving by agricultural producer in department till October 20 of the corresponding year of the request for receipt of subsidies for acquisition of seeds of wheat second and (or) third of reproductions in form, according to appendix 11-1 to these rules, with appendix:

copies of the invoices confirming acquisition by agricultural producer of seeds of wheat second and (or) third of reproductions;
