About approval of Rules of provision of innovative grants on commercialization of technologies

1. Approve the enclosed Rules of provision of innovative grants on commercialization of technologies.
2. To department of technology and innovative development of the Ministry for Investments and Development of the Republic of Kazakhstan () provide A.B. Batyrkozha:
1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.
3. To impose control of execution of this order on the Vice-Minister of investments and development of the Republic of Kazakhstan Sagadiyev E. K.
4. This order becomes effective from the date of its first official publication.

1. These rules of provision of innovative grants on commercialization of technologies (further - Rules) are developed according to the subitem 20) of article 5 of the Law of the Republic of Kazakhstan of January 9, 2012 "About the state support of industrial and innovative activities" and determine procedure for provision of innovative grants on commercialization of technologies.
2. In these rules the following basic concepts are used:
1) preliminary consideration - consideration of preliminary applications regarding their compliance to the priority directions of provision of innovative grants, to criteria of innovation, scale, competence of the applicant;
2) the preliminary application - the statement with appendix of the questionnaire, passport of the project and vision of project implementation according to requirements of these rules;
3) the grantee - the physical person or legal entity which received grant according to these rules;
4) the commission on grant financing - the advisory advisory bodies under national institute created in the priority directions of provision of innovative grants;
5) the industrial and innovative project (further - the project) - the complex of actions directed to the transfer of technologies, creation of new or advanced productions, technologies, goods, works and services realized during certain term of time;
6) authorized body in the field of the state support of industrial and innovative activities (further - authorized body) - the central executive body performing management in the field of the industry and industrial and innovative development, and also performing in limits, stipulated by the legislation cross-industry coordination and participation in realization of the state support of industrial and innovative activities;
7) innovative grant - the budgetary funds provided to subjects of industrial and innovative activities on a grant basis for implementation of their industrial and innovative projects within the priority directions of provision of innovative grants;
8) pilot laboratory sample - the product sample made on again developed worker of documentation for check by testing of compliance to its set technical requirements for the purpose of decision making about possibility of statement on production and (or) proper uses;
9) test batch of product - the set of prototypes or certain amount of products made for the established period of time according to again developed same documentation for control of compliance of products to the set requirements and decision making about its statement on production;
10) experimental industrial design - the product sample having the main signs planned to product development, produced for the purpose of verification of the proposed solutions and refining of separate characteristics for their use in case of development of these products;
11) the request - the statement of the established sample with appendix of required materials and documents according to requirements of these rules;
12) the applicant - the person who is performing activities in the territory of the Republic of Kazakhstan, provided for consideration the request for receipt of innovative grant according to these rules;
13) commercialization of technologies - the activities connected with practical application of results of scientific and (or) scientific and technical activities for the purpose of conclusion to the market of new or advanced goods, processes and services, directed to receipt of positive economic effect;
14) the authorized person of national institute - person determined by the first head of national institute of development in the field of technology development from among deputy first heads of national institute.
3. Innovative grants are provided to applicants within the priority directions of provision of innovative grants according to the legislation on the state support of industrial and innovative activities.
4. The prize-winners of tenders in the field of innovative development organized by authorized body or who are carried out by request of authorized body within one calendar year after the announcement of results of tender sign the contract on provision of innovative grant for the first stage of commercialization of technologies without passing of stages of preliminary consideration of requests, conducting independent examination, consideration by the commission on grant financing.
5. Provision of innovative grants according to these rules is performed by national institute of development in the field of technology development (further - national institute) based on the agreement signed between authorized body and national institute.
6. Information support of processes of provision of grants is performed by national institute.
7. The costs made by applicants for the purpose of implementation of the declared project to the conclusion of the contract for provision of innovative grant, are not compensated.
8. National institute provide nondisclosure of information on the request to the third parties, uninvolved in the course of provision of innovative grants, except for the shareholder of national institute, authorized body and cases established by legal acts of the Republic of Kazakhstan.
9. By the time of application for receipt of innovative grant for commercialization of technologies scientific research shall be complete and the project team is created.
10. Application by the applicant for receipt of the innovative grant provided by these rules does not limit its right to apply for receipt of other innovative grants, stipulated by the legislation about the state support of industrial and innovative activities.
11. Innovative grants are provided in payment type of part of costs for the following project implementation phases:
1) first stage: creation of pilot laboratory sample;
2) second stage: creation of experimental industrial design;
3) third stage: release and realization of test batch of product.
Conditions of provision of innovative grants are specified in appendix 1 to these rules.
12. If on the project passing of the first and (or) second stage is not required, the applicant submits the application for the second and (or) third stage without passing of the previous stages.
13. The national institute at least 2 (two) times a year announces the beginning of acceptance of preliminary applications for receipt of innovative grants and places information on acceptance, terms and procedure for adoption of preliminary applications in mass media, including on official Internet resource of national institute with indication of the address and the period of acceptance of preliminary applications.
14. The national institute provides the report on holding procedures of provision of innovative grants to authorized body in the terms established by the agreement signed between national institute and authorized body.
15. Procedures of provision of innovative grants after date of provision of the report to authorized body do not stop except for acceptance of the preliminary applications which arrived in the terms which are not provided by national institute.
