According to the subitem 6) of Item 1 of article 9 of the Law of the Republic of Kazakhstan "About space activities", I ORDER:

1. Approve the enclosed Rules of payment of immediate compensation to the candidate for astronauts, to the astronaut in case of establishment of the disability which was caused injuries, mutilations, diseases got on duty and also in case of his death (death) in connection with execution of service duties.

2. To space committee of the Ministry for Investments and Development of the Republic of Kazakhstan (Musabayev T. A.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of payment of immediate compensation to the candidate for astronauts, to the astronaut in case of establishment of the disability which was caused injuries, mutilations, diseases got on duty and also in case of his death (death) in connection with execution of service duties (further – Rules), are developed according to the subitem 6) of Item 1 of article 9 of the Law of the Republic of Kazakhstan "About space activities" and determine payment procedure of immediate compensation to the candidate for astronauts, the astronaut in case of establishment of the disability which was caused injuries, mutilations, diseases got on duty and also in case of his death (death) in connection with execution of service duties.

Chapter 2. Payment procedure of immediate compensation to the candidate for astronauts, the astronaut in case of establishment of the disability which was caused injuries, mutilations, diseases got on duty and also in case of his death (death) in connection with execution of service duties

2. Payment of immediate compensation is made:

1) in case of death (death) of the candidate for astronauts, the astronaut on duty - to his heirs;

2) in case of establishment to the candidate for astronauts, the astronaut of the disability which was caused injuries, mutilations, diseases got on duty - the corresponding candidate for astronauts, the astronaut.

3. Investigation of circumstances of death (death) of the candidate for astronauts, the astronaut, and also receipt by them of injury, mutilations, diseases is made according to the Labor Code of the Republic of Kazakhstan.

4. From the moment of removal by the commission on investigation of accident of the conclusion confirming the fact of death (death) of the candidate for astronauts, the astronaut in connection with execution of service duties and also the conclusion about causal relationship of the established disability with injury, the mutilation, disease got on duty in case of receipt of injury by them, mutilations, diseases which entailed disability establishment (whether) with which employer they consist in employment relationships, within seven calendar days in writing informs persons having the right to immediate compensation (further - the receiver), according to Item 2 of these rules, on possibility of filing of application on payment of immediate compensation for form, according to appendix 1 to these rules in authorized body in the field of space activities (further - authorized body).

5. For receipt of immediate compensation the candidate for the astronauts, the astronaut or persons having the right to its obtaining submit the following documents to authorized body:

1) in case of death (death) of the candidate for astronauts, the astronaut:

the statement in form, according to appendix 1 to these rules;

copy of the conclusion of the commission on accident investigation;

copy of the death certificate or notification on death;

copy of the identity document of the receiver of immediate compensation;

the certificate on the right to inheritance if addressed for payment is heir of the died (dead);

2) when obtaining by the candidate for astronauts, the astronaut of injury, the mutilation, disease which entailed disability establishment:

the statement in form, according to appendix 1 to these rules;

the copy of the conclusion of the commission on accident investigation, about causal relationship of the established disability with injury, the mutilation, disease got on duty;

copy of the medical certificate;

copy of the certificate of disability.

6. In case of the address of persons having the right to immediate compensation with the statement for compensation payment the authorized body checks completeness and correctness of document creation, the these rules specified in Item 5, and registers the statement in the magazine of registration of statements on payment of immediate compensation for form, according to appendix 2 to these rules.

In case of incomplete submission of required documents or their wrong registration, the application is returned to the applicant with indication of return reasons within three working days from the date of submission of documents.

7. Authorized body, having registered the submitted documents, within seven working days from the date of registration passes the decision on payment of immediate compensation.

8. Payment of immediate compensation to the receiver is performed by authorized body at the expense of budgetary funds, according to the Budget Code of the Republic of Kazakhstan procedure, by transfer to personal account of the receiver in bank of the second level within the Republic of Kazakhstan within three months from the moment of submission of the relevant documents by the applicant.
