About the Concept of reform of housing and communal services in the Republic of Tajikistan for 2010 - 2025

According to article 6 of the Law of the Republic of Tajikistan "About the state forecasts, concepts, strategy and programs of social and economic development of the Republic of Tajikistan", for the purpose of improvement of activities of service industry of housing and communal services the Government of the Republic of Tajikistan decides:

1) to Approve the Concept of reform of housing and communal services in the Republic of Tajikistan for 2010 - 2025 it (is applied).

2) to the Ministries, departments and local executive bodies of the government:

- take measures for implementation of the Concept of reform of housing and communal services in the Republic of Tajikistan for 2010 - 2025;

- develop the Program of industry and regional development of housing and communal services for the period till 2025.

To the state unitary enterprise "Hochagiya kommunala manziliya" to render assistance to the ministries, departments and local executive bodies of the government in development of the industry program.

3) to the Ministry of Economic Development and Trade of the Republic of Tajikistan, the State unitary enterprise "Hochagiya kommunala manziliya", together with the ministries, departments and local executive bodies of the government in case of development so-so - and long-term programs of social and economic development of the republic to consider requirements of industry for implementation of the established requirements of the Concept of reform of housing and communal services in the Republic of Tajikistan for 2010 - 2025.

4) "Hochagiya kommunala manziliya" about accomplishment of this Concept annually to provide to the State unitary enterprise written information in the Government of the Republic of Tajikistan.

The concept of reform of housing and communal services in the Republic of Tajikistan for 2010-2025

1. Introduction

1) the Concept of reform of housing and communal services in the Republic of Tajikistan (further - the Concept) determines the purposes, tasks and ways of reforming of housing and communal services in the Republic of Tajikistan during the period till 2025.

2) the Main objective of this Concept - creation of economic, legal and organizational conditions for profitable activities, further development and reforming of housing and communal services which is directed to increase in efficiency, reliable functioning of life support systems of the population, improvement of quality of the rendered services, availability of utilities to each consumer of services.

3) Tasks of the Concept are:

- satisfaction of needs of consumers in housing and communal services of proper level and quality at economically reasonable prices and rates, improvement of quality of utilities, bringing their level to international standards;

- demonopolization of industry, creation of conditions for development of the market relations, transition to forming of contractual relations, development of competitive environment in the market of utilities, broad involvement of homeowners for the organization and representation of utilities;

- housing and communal services activities normative legal support, their reduction in compliance with the operating market relations;

- creation is material technical base, recovery and updating of engineering utility infrastructure, technical retrofitting of the utility companies;

- financial improvement of the companies of housing and communal services, enhancement of pricing of industry, reduction of price level to the real operating market prices;

- restructuring of the formed debt of the organizations and organizations financed from budgets of all levels, debt of the population for housing and communal services to public utilities;

- providing regulatory method of budget financing of the consumed services by budgetary institutions;

- transition to the mode of economical consumption of utilities, including on industries of water supply and heat supply, regulation of quantity and service quality by installation of individual metering devices of hot and cold water supply;

- enhancement of systems of social the populations by enhancement of the existing privileges, reduction in compliance of category and number of exempts and sources of their financing are sewn up;

- development of engineering infrastructure, recovery and ensuring their reliability and stability of functioning by mobilization of own sources and attraction of internal and external investments on these purposes.

- carrying out scientific and technical researches on questions of operation and maintenance of objects of housing and communal services, development and deployment of the latest technologies and the equipment directed to technical retrofitting of the companies of housing and communal services and reducing specific costs of energy and material resources;

4) Goal achievement and realization of the tasks of development of housing and communal services determined by the Concept is possible in the conditions of radical change of economic mechanism, transition of industry to the mode of profitable functioning.

2. Condition of housing and communal services and premises of carrying out its reforming

5) After declaration of independence of the Republic of Tajikistan to problems of housing and communal services it began to be paid much attention.

On initiative and the order of the President of the Republic of Tajikistan Emomalii Rahmon are developed and "The program for improvement of providing the population of Tajikistan by clear drinking water for 2007 - 2020" and regional comprehensive programs of development are implemented. Also the regulatory framework is created necessary legislative. The Housing code, the Laws of the Republic of Tajikistan "Are adopted about privatization of housing stock of the Republic of Tajikistan", "About privatization of state-owned property in the Republic of Tajikistan", "About consumer protection", "About content of apartment houses and condominiums", the order of the Government of the Republic of Tajikistan "About enhancement of management of the companies and organizations of housing and communal services in the Republic of Tajikistan" and others.

Amounts of the rendered housing and communal services are as a result increased, their quality improved, new structures on rendering services, including private were formed. The state housing stock, hotel and bath-and-laundry complexes in the field of services is generally privatized. For the purpose of improvement of water supply of number of the cities and regional centers, material and technical resources of the housing-and-municipal companies foreign investments were attracted.

However, despite the taken measures the situation in housing and communal services continues to remain critical. Process of reforming of this important sphere, unfortunately, was dragged out.

6) High centralization, monopolization and considerable dependence on subsidies of this sphere cause general inefficiency of functioning of housing and communal services.

Operation of extremely energy-intensive housing stock and objects of the social sphere with shabby engineering communications costs very much.

Rates for housing and communal services and the allocated funds do not provide not only modernization and development of industry, but also are insufficient for maintenance in working order of housing-and-municipal infrastructure.

7) Financing of capital construction, upgrade and rearmament of industry keeps the old mechanism, the allocated funds are tens times less, than it is necessary.

Technical condition of utility infrastructure of the rural zone is characterized high (more than 70 percent) by the depreciation level, high accident rate, low efficiency of capacities. Thereof problems of supply of certain rural settlements with the electric power, drinking water became aggravated, deficit of capacities of water disposal and sewage treatment was shown. The universal over-expenditure of fuel and energy resources is observed.

8) As of January 1, 2010 total area of apartment houses on the republic constitutes 63 million 488 thousand square meters, from them 3 million 987 thousand square meters are constituted state, public and construction and cooperative dwelling stocks, and 59 million 500 thousand square meters by private dwelling stock.

As a result of mass privatization of housing passed responsibility on operation and repair of housing stock from the state to new owners - the population which in the majority, was not ready to it. To the population it is not clear for what it shall bear responsibility in these privatized buildings, and for what other bodies.

The majority of apartment houses in the republic are operated with violation of the established requirements. Timely capital repairs in them are not made.

Forty percent of the population of the republic have no access to system of drinking water

The adopted republican program for water supply of the population is carried out with lagging, the mechanism of its financing still is completely not solved. Fixed assets of system of utility infrastructure (water supply, the sewerage, heat supply and sanitation) are worn-out more than for seventy percent and require rehabilitation.

Technical condition of water supply systems and the sewerage is extremely low. In system there is no guaranteed electric utility service.

In critical condition there are ninety percent of systems of the sewerage. Level of culture of water consumption and use of services of sanitation is still rather low.

The utility power is almost completely destroyed, the boiler economy, system of heat supply of the majority of multi-storey apartment houses, schools, hospitals and other objects of the social sphere are put out of action.

9) For the purpose of providing single procedure for the State accounting of sites, structures, constructions, engineering networks and subjects to external improvement in the cities, regional centers, settlements and villages of the republic belonging to legal entities and physical persons (irrespective of their patterns of ownership) the regulations on their technical inventory count are approved. However, local executive bodies in which property there are these systems and objects due to the lack of financing sources, not completely provide accomplishment of the Order of the Government of the Republic of Tajikistan No. 513 of December 30, 1998.

Condition of many subjects to external improvement in the cities, regional centers, settlements and villages of the republic do not meet the modern requirements. City settlements, regional centers and settlements of city type are not completely covered by planned and regular sanitary cleaning.

More than a half of polygons for placement of utility waste have finite useful lives and do not conform to modern nature protection requirements. Equipment of the organizations of housing and communal services by special equipment below the regulatory base, more than two thirds from total number of existing require updating. Processes of collection, export, conversion and waste recycling do not correspond to the modern level of development in communication with what it is necessary implementations of the advanced practice and methods of collection, conversion and waste recycling.

Security of settlements with the equipped places of temporary collection of solid utility waste and mini-polygons is insufficient for their placement.

10) are not changed in management of housing and communal services of the relation, both between levels of the power, and between producers of housing and communal services.

It is necessary to state that the facts of the rough bureaucratic attitude towards needs of people are not obsolete. Work on transition of servicing according to market economy is poorly conducted.

Not up to standard there are informative and legal study of agreements, failure to carry out of contractual relations at all production phases and provisions of housing and communal services, including the owner, the producer of services and their consumer.

Violation of the principle of the market relations are often shown in formalistic approach to the procedure of the conclusion of agreements that excludes possibility of objective control over accomplishment of contractual commitments.

Work on work incentives of the workers occupied in the field of utilities is almost insufficiently conducted. Many heads do not consider housing and communal services serious field of activity.

11) Major factors which led to deterioration in condition of housing and communal services are:

- delay in reforming of housing and communal services;

- physical and obsolescence of the equipment;

- inefficient use of resources;

- insufficiency of financial provision;

- growth of debt for consumption of electrical energy and utilities, both from the companies of housing and communal services, and from consumers of services;

- lack of economically reasonable approach in establishment of rates (cases when rates do not compensate all-in cost of services are frequent);

- incomplete accomplishment of the program for equipment of housing stock means of accounting and regulation of water consumption and heat energy.

3. Purposes, tasks and priorities of reforming of housing and communal services

12) the Main objective of reform of housing and communal services at the present stage consists in the following:

- creation of the conditions of accommodation corresponding to standard rates of the social standard in housing-and-municipal industry;

- gradual transition from budget subsidizing of housing and communal services for payment consumers of utilities in full;

- ensuring social protection of needy segments of the population;

- economic incentives of improvement of quality and growth in volumes of the rendered utilities to the population.

13) it is necessary For achievement of effective objectives:

- construction of facilities and missing capacities, recovery and capital repairs of the existing constructions and networks of water supply system, the sewerage, electric utility service, roads, polygons and the place of collection of utility waste;

- housing construction growth in volumes, to the meeting modern requirements, due to off-budget accumulatings, housing and mortgage loans;

- implementation of the market principles of development of the housing-and-municipal sphere when preserving social orientation of housing policies of the state;

- enhancement of system of territorial planning, obligatory observance of rules of land use and building, forming and development of engineering utility infrastructure of sites for construction of housing and other objects, allocations of the parcels of land for creation of subsidiary farms of gardening in case of public utilities;

- implementation of the organizational and economic mechanisms directed to establishment of actual cost of housing and communal services (increasing quality of their provision);

- enhancement of tariff policy on housing and communal services, for the purpose of achievement of balance between financial needs of service providers and solvency of consumers;

- establishment of the raised rates for the above-standard areas of housing and consumption of utilities, and also payment differentiation, depending on quality and location of housing;

- increase in investment appeal of housing and communal services;

- comprehensive implementation of the Law RT "About Content of Apartment Houses and Condominiums";

- rendering active support to initiatives and aspiration of the population in creation of condominiums;

- ensuring the effective address help to needy segments of the population;

- enhancement of management system, operation and control in housing and communal services;

- universal use of contractual relations;

- development of competitive environment of provision to consumers of opportunity to influence amount and quality of the rendered services;

- implementation is preferential competitive selection including the private organizations exercising control of housing stock and its servicing, providing the utility companies with materials, the equipment and performing project construction works;

- enhancement of system of social protection of the population, streamlining of the existing system of privileges, strengthening of address orientation of the funds allocated for these purposes.

14) the Main condition of reform is economic balance of the held events with real opportunities of the companies of industry, irrespective of patterns of ownership, solvency of the population, local budgets and purposeful means of the republican budget.

15) With respect thereto, priority tasks of industry further development of reform of housing and communal services on basis is considered:

- forming of organizational and managerial conditions and market mechanisms for effective management and servicing of housing stock and subjects to external improvement;

- enhancement of system of contractual relations on provision of housing and communal services, and also competitive selection of customers on placement of the utility order and contract organizations on performance of works on content and repair of housing stock, subjects to external improvement;

- developments of the competition in the field of management, content and repair of housing stock;

- comprehensive observance of Rules of accession to engineering communications and utilities;

- strengthenings of control over quality of housing-and-municipal servicing of the population;

- reforming of system of provision to the population of privileges on payment of housing and communal services;

- enhancement of system of review and approval of rates on operational and utilities;

- further differentiation of rates of rent of premises;

- activation of work on creation of the conditions necessary for education and activities of condominiums and other forms of associations of inhabitants;

- decrease in unproductive operating costs and repair of housing stock, on the rendered utilities and achievements of improvement of their quality by implementation and use of the latest developments of the equipment and technology by means of development and implementation of industry programs for energy saving and winterization of buildings which will be provided in appropriate programs of the industry ministries and departments;

- realization of package of measures for financial improvement of housing and communal services, including, restructuring and debt repayment for the rendered services and the performed works;

- changes of the principle of financial provision of industry by increase in payments of the population for housing and communal services.

4. Basic principles of implementation of reform of housing and communal services

16) are applied To successful implementation of reform of housing and communal services:

- principle of subsidiarity. Considering requirements of the population of the different areas and cities of the republic the level of management bearing responsibility for the organization of services it is supposed to have closer to the final consumer of services to have sufficient means for its provision;

For executive bodies of the government on places accurately established functions and obligations which do not duplicate other levels of management, power and resources on accomplishment of these functions are provided;

- the principle of separation of regulation from provision of services. Function of regulating authority will be separated provision of services that will promote unconditional fulfillment of requirements of regulations of housing and communal services in practice;

- the principle of determination of powers in case of separation of rates from tariff control. Responsibility of powers for accomplishment of measures for establishment of rates is separated tariff control. The producer of services (monopolist) directly establishes rate and approves with the operating antimonopoly authority;

- the principle of separation of establishment of payments from functional purposes. The republican body sends direct transfers (capital investments) to the service provider. Local authorities of managements can also direct capital investments to the service provider;

- principle of consumer rates. It is determined that the consumer always pays for the rendered services when she is individual. If the service public, it requires general form of financing, for example, as tax which is applied to all population;

- principle of determination of subsidy. The government within state policy, supports (stimulates) allocations of subsidies to consumers of services;

- principle of transparency of functional purposes. Functions of all levels of local executive bodies of the government shall be accurately determined;

- principle of ownership and management of fixed assets. Ownership, management and responsibility for fixed assets are transferred to supply agencies of services.

5. Main ways of reforming of housing and communal services

1. Demonopolization and development of competitive environment

17) creation of competitive environment in management system and servicing of the housing-and-municipal sphere shall become the Most important element of reform.

It will allow homeowners and domestic objects to choose that organization which will be able to provide the necessary quality level of works and services in bottom prices.

18) Development of the competition in the housing-and-municipal sphere is performed for the purpose of creation of conditions for overcoming effects of monopoly position of the organizations of housing and communal services. It is possible in the way:

- forming by local authorities (jamias, areas and the cities) the territorial order for servicing and development of subjects to housing-and-municipal appointment irrespective of patterns of ownership;

- the organizations of the single automated settlement system for the made and consumed housing and communal services on the basis of agreements, and also applications of economic sanctions for violation of contractual commitments;

- attraction on equal basis of the organizations of different patterns of ownership for rendering housing and communal services.

19) Necessary premises of development of the competition is housing and communal services demonopolization.

20) treat fields of activity in which competition development is possible:

- management and servicing of housing stock and objects of municipal services;

- involvement of the organizations using alternative forms of provision of utilities, including the autonomous life support systems which are not connected with network engineering infrastructure of objects (boiler rooms, capacity gas supply, autonomous heat supply, electric utility service and another)

- accomplishment of separate works on servicing of objects of municipal services (repair and cleaning of networks, refuse collection, operation of lift economy and another);

- project - prospecting and construction works on development of domestic objects;

- creation of conditions and normative and methodical base on forming on places of competitive environment in the field of production and provision of housing and communal services.

21) in the course of demonopolization of the housing-and-municipal sphere needs to be observed:

- implementation of actions for demonopolization in view of the fact that housing and communal services are difficult economic complex;

- non-admission of discrimination in relation to any patterns of ownership on housing stock and on other domestic objects;

- approval of the actions performed within the state and local programs of demonopolization;

- taking measures to creation of great number of subjects of different patterns of ownership in the field of provision of housing and communal services;

- orientation to ensuring the greatest possible competition of business entities, and also protection of the rights and consumer interests of housing and communal services.

2. Enhancement of management system housing and communal services

22) Reforming of housing-and-municipal industry is directed to increase in role of independence and responsibility of business entities of the different patterns of ownership which are providing direct consumer service of the housing and communal services and having legal and financial opportunities not only for implementation of the current operational activities, but also for development of housing-and-municipal industry.

23) it is necessary to pay Special attention:

- to carrying out the government by executive bodies on places of transformations, necessary in the course of demonopolization, in the field of management, financings and pricings aimed at providing more effective functioning of housing and communal services;

- to forming of the structures (service of the customer, managing company, condominium and others) representing the interests of all homeowners protecting the rights of consumers of housing and communal services;

- to implementation of contractual relations at all production phases and provisions of housing and communal services, including the owner of the house owner, the producer of services and their consumer;

24) rational separation of functions and the organization of relations between the owner by managing company, contract organizations of different patterns of ownership and body can be the basis for management system by housing and communal services, authorized to exercise the state control for provision to the population of housing and communal services of necessary quality, behind use and safety of housing stock, irrespective of its accessory.

25) In case of the choice of option of management it is reasonable to be guided by the principle of provision to the owner of the right to decide, and to manage who will service the property (real estate) belonging to it it.

26) Emergence of new types of owners is caused by the needs for other forms and methods of investment of development of subjects to housing-and-municipal appointment in the conditions of limitation of budgetary funds.

27) at the same time, along with dialogue "the customer - the contractor (the company of housing and communal services)", multilateral relations which participants are are created:

- the investment, construction and operational organizations of different patterns of ownership performing financing, construction, content of objects of housing and communal services and management of them;

- the owners of housing stock and objects of municipal services representing them bodies and managing companies;

- consumers of services are owners, employers and lessees of premises, objects and other organizations.

28) domestic Objects can be serviced by the organizations of different patterns of ownership.

In small settlements of function of the customer on content and development of subjects to housing-and-municipal appointment can be performed by divisions of local public authority which sign for this purpose contracts with the organizations of housing and communal services for content, technical operation and development of the specified objects;

- taking into account construction of multi-storey houses it is necessary to organize the companies of networks of technical operation for repair of elevators in the republic.

At new stage of reforming of housing and communal services the system of contractual relations includes 29):

- the contract between the owner of subject to housing-and-municipal appointment and business entity (including management of housing stock and its servicing, public service) signed including, on competitive basis;

- contract between the owner of housing stock and employer (owner) of premises;

- the contract between business entities (for example, water - the warm, power supplying organizations, etc.);

- contract between suppliers of utilities and consumers of these services.

3. Ensuring state regulation and control

30) Availability of different patterns of ownership assumes state regulation of safety of housing stock and the domestic objects providing observance obligatory for all owners parameters of standard rates of the republican standard.

31) the State control and regulation of quality of housing-and-municipal servicing can be performed by public authorities on places or the republican body controlling not only observance of the quality standards of the provided services, but also availability of the relevant agreements.

32) Control over condition of the state, local and private housing stocks and objects, behind accomplishment of the obligatory engineering procedures ensuring technical and ecological safety of the population can be performed by different levels of authorities.

33) the Republican body given the Government of the Republic of Tajikistan appropriate authority carries out the complex analysis and generalization of tendencies of development of housing and communal services on the basis of the state statistical and accounting records, performs forming of state policy in this sphere of economy.

34) One of forms of state regulation and quality control, the provided housing and communal services ensuring availability of information on economic activity of the companies of housing and communal services, control of investment projects, transparent tariff regulation, and also determination of priority customer groups of the services which are subject to obligatory servicing is.

35) Protection of consumer interests of housing and communal services should be performed also by establishment of the necessary conditions and restrictions providing the normative level of housing-and-municipal consumer service in case of decision making about change of patterns of ownership: organizations of housing and communal services or management of it.

36) in the field of technical supply of housing and communal services, in addition to the use of devices of individual accounting and regulation consumed waters, gas and other energy resources it is necessary to provide implementation of the automated systems of dispatching management which allow to consider not only use of appropriate resources, but also to regulate process of their distribution and consumption in housing and communal services. Besides, such system can provide information for all levels of management.

4. Reforming of system of financing of housing and communal services

Reforming of system of financing assumes 37):

- transition to self-financing of the organizations of housing and communal services based on development of rates for the rendered services to the level of economically reasonable costs;

- need of the address direction of budgetary appropriations on provision of subsidies in the limits provided on these purposes of means by the government budget.

- respect for the principle, what level establishes subsidies, that also completely pays them;

- development of mechanisms of attraction and return of short-term and long-term investment loans for development and upgrade of objects of housing and communal services;

- financing of capital construction and reconstruction of objects of housing and communal services at the expense of own means, investments and the budget within the provided means;

- implementation obligatory and voluntary insurance of housing, objects of the utility sphere and cultural, social appointment;

- allocation of the financial resources necessary for development of republican standards of regulations and legal framework of industry of housing and communal services;

- gradual transition to the new principles of calculations in housing and communal services;

- overcoming emergency of non-payments, both citizens, and organizations and organizations.

5. Payment of housing and utilities

38) Feature of reform of housing and communal services is change of tactics of pricing, transition from simple increase in rates for housing and communal services to smooth change of these rates considering growth of real incomes of citizens. It will allow to provide the most painless transition of housing-and-municipal industry for the population to conditions of market system of managing.

39) Increase in the share of charges of housing paid with the population and provision of utilities can be reached due to establishment of actual cost of the consumed services. For achievement of these purposes the following conditions shall be created:

- universal implementation of individual devices of regulation, accounting of water and other energy resources;

- conclusion of contracts between suppliers and consumers of utilities;

- the conclusion of contracts between managing company (service of the customer) and the organizations providing housing and communal services, as a rule, on competitive basis;

- approval of rates (in the absence of the alternative organizations) between service of the customer and the organizations by natural monopolists.

40) Rates are approved on the basis of the analysis of compliance of organization activity of housing and communal services to standard rates and standards.

41) For the purpose of consumer protection agreements on hiring for maintenance and provision of utilities with owners shall contain the rights and obligations of the Parties guaranteeing fee according to their of really reached amounts and quality.

The charge rate of housing provided according to the employment contract in the state housing stock shall include not only payment for content and repair of housing, but also for its hiring.

6. Ensuring social protection of the population

Social protection of the population upon transition of industry to the mode of profitable functioning assumes 42):

- provision of the public assistance to needy segments of the population in case of increase in prices (rates) for housing and communal services; the guaranteed provision of the privileges established by the legislation and providing the minimum standard rates of the social standard on provision to the population of services in the field of housing-and-municipal servicing.

- exception of possibility of refusal in allocation of non-cash housing subsidies to the citizens having the right to them, under any pretext, including, living in the houses which are under economic authority or operational management of the organizations in houses of private housing stock, and also in the rural zone.

43) Measures for enhancement of procedure for granting of privileges shall assist decrease in specific weight of payment for use of premises, maintenance and utilities in the household budget of needy citizens.

44) In case of determination of size of subsidy on payment for use of premises the payment exception on separate types of utilities is inadmissible (also cold water supply, the sewerage, gas, electrical and heat energy, use of the elevator, export and neutralization of municipal solid waste, and other maintenance is hotter).

45) need to be provided operational reflection of the standard costs connected with rendering housing and communal services in respect of refining of calculation of subsistence minimum.

6. Housing and communal services reforming realization stages

46) At the first stage (2010 - 2015) it is planned:

- development of the development program of housing and communal services of the Republic of Tajikistan and mechanisms of realization of this reform;

- further enhancement of management structure of industry of housing and communal services according to the organization of state body for providing single technical policy, coordination and perspective development of industry, including the utility sphere of the rural zone;

- creation, in the procedure established by the legislation, systems of bodies of the state housing inspectorates in the Republic of Tajikistan;

- differentiation of function of the owner house owner, managing company (service of the customer) and the servicing organization. Transition to complete contractual relations in the field of provision of housing and communal services;

- the organization of preparation and retraining of personnel for work in the managerial and servicing organizations;

- carrying out mass inventory count of objects, structures and communications in the cities, regional centers and other settlements of the Republic of Tajikistan;
