About approval of standards of the state services in the field of rail transport

List of amending documents

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve:

1) the standard of the state service "Licensing for Transportation of Goods in the field of Rail Transport", according to appendix 1 to this order;

2) the standard of the state service "State Registration of Railway Vehicles", according to appendix 2 to this order;

3) the standard of the state service "State Registration of Pledge of Railway Vehicles", according to appendix 3 to this order.

2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A. A.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Licensing for Transportation of Goods in the field of Rail Transport"

Chapter 1. General provisions

1. The state service "Licensing for Transportation of Goods in the field of Rail Transport" (further – the state service).

2. The standard of the state service is developed by the Ministry for Investments and Development of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears territorial authorities of Committee of transport of the Ministry (further – the service provider).

Reception of an application and issue of result of rendering the state service is performed through the web portal of "the electronic government" www.egov.kz (further – the portal).

Chapter 2. Procedure for rendering the state service

4. Terms of rendering the state service since the address moment on the portal:

1) licensing - 2 (two) working days;

2) issue to the renewed license - 2 (two) working days;

The service provider within 1 (one) working day from the moment of receipt of documents of uslugopoluchatel checks completeness of the submitted documents.

In case of factual determination of incompleteness of the submitted documents and (or) documents with the expired effective period the service provider in the specified terms gives written motivated refusal in further review of the statement.

5. Form of rendering the state service - electronic (partially automated).

6. Result of rendering the state service – the license, renewal of the license for transportation of goods in the field of rail transport (further – the license) in the electronic form signed by the digital signature (further – the EDS) the service provider, or motivated refusal in case and on the bases, stipulated in Item 10 these standards of the state service.

Form of provision of result of rendering the state service - electronic.

On the portal the result of rendering the state service goes to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

7. The state service is rendered on paid basis to physical persons and legal entities (further - uslugopoluchatel).

The license fee is paid to the local budget at the rate of charge established by the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget (Tax code)" and constitutes:

1) for licensing - the sixfold monthly settlement indicator operating on the date of collection payment;

2) for renewal of the license - 10% of rate of charge when licensing.

Payment of the amount of the registration fee of the budget is performed in cash and non-cash form through payment gateway of "the electronic government" (further - PShEP).

8. Working schedule:

1) the service provider - Monday through Friday, from 9-00 till 18-30 o'clock, with lunch break from 13-00 till 14-30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

9. The list of the documents necessary for rendering the state service in case of the address of uslugopoluchatel on the portal:

1) for receipt of the license:

the statement in electronic form, the uslugopoluchatel certified by the EDS according to appendix 1 (for the legal entity) to this standard of the state service, or according to appendix 2 (for physical person);

data according to qualification requirements, according to appendix 3 to this standard of the state service;

2) for renewal of the license:

the statement in electronic form, certified by the EDS of uslugopoluchatel according to appendix 4, (for the legal entity) to this standard of the state service, or according to appendix 5 (for physical person);

Data of identity documents, about state registration (re-registration) of the legal entity, about state registration as the individual entrepreneur, about licenses, payment confirmation the budget of the license fee in case of payment through PShEP the service provider receives from the corresponding state information systems through lock of "The electronic government".

When giving the uslugopoluchatel of all necessary documents through the portal - in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service.

10. The bases for refusal in provision of the state service are if:

1) occupation type of activity, is forbidden by the laws of the Republic of Kazakhstan for this category of subjects (physical persons or legal entity);

2) the license fee is not brought;

3) the uslugopoluchatel does not conform to qualification requirements;

4) is available taken legal effect the decision (sentence) of court concerning uslugopoluchatel prohibiting to it to be engaged in activities for transportation of goods in the field of rail transport;

5) court based on representation of the legal executive the uslugopoluchatel is temporarily forbidden to obtain the license.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of service providers and (or) his officials concerning rendering the state service

11. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state services: the claim is submitted addressed to the head of the service provider or addressed to the head of the Ministry of the address specified in Item 13 of this standard of the state service.

Claims are accepted in writing by mail or in electronic form or purposely through office of the service provider in the working days.
