About the Concept of forecast development of the legislation of the Republic of Tajikistan

For the purpose of enhancement and forecast development of the legislation of the Republic of Tajikistan, increase in efficiency of rule-making process and according to article 69 of the Constitution of the Republic of Tajikistan I decide:

1) to Approve the Concept of forecast development of the legislation of the Republic of Tajikistan it (is applied).

2) to the State bodies and other organizations participating in rule-making activities to be guided by provisions of the Concept of forecast development of the legislation of the Republic of Tajikistan.

3) the National center of the legislation in case of the President of the Republic of Tajikistan together with the Ministry of Justice of the Republic of Tajikistan to perform development of state programs and plans of preparation of projects of regulatory legal acts taking into account provisions of the Concept of forecast development of the legislation of the Republic of Tajikistan.

Concept of forecast development of the legislation of the Republic of Tajikistan

In present modern society the law as means of regulation of all aspects of public life has indisputable role and line item as development of society is possible only by legislative and fair regulation of the public relations. Accurate determination of need of project development of the laws, their comparison to current laws, studying and determination of compliance of the adopted laws to requirements of time and society, and also from the scientific point of view their reasons have many opportunities and it is necessary to use them as often as possible more effectively.

Based on these factors and for the purpose of development of the legal acts governing the different public relations there was need of development of the Concept of forecast development of the legislation of the Republic of Tajikistan.

1. General provisions

1) the Concept of forecast development of the legislation of the Republic of Tajikistan (further - the Concept) is developed for the purpose of ensuring fulfillment of requirements of the Constitution of the Republic of Tajikistan and the solution of urgent problems of system of the legislation of the Republic of Tajikistan, determinations of the main directions and methods of enhancement of the legislation agrees with the principles of the independent, democratic, constitutional, secular, unitary and social state.

2) the Priority directions of the Concept is increase in level and quality of the laws and their effective realization in public life for the purpose of:

- protection of the rights and personal freedoms and citizen, state sovereignty, national interests and safety;

- integrity of the state, establishment and development of the world, friendly and benevolent relations with all states of the world community;

- ensuring rule of law and law and order;

- enhancement of legal reform taking into account development of society, increase in professional knowledge and legal culture;

- further development of democratic institutes, in particular political ideological pluralism, freedom of expression and expression of opinions, speech and enhancement of other aspects of civil society;

- increases in efficiency and ensuring transparency in activities of state bodies and local self-government;

- strengthenings of fight against crime, in particular with terrorism, extremism, corruption, drug trafficking, human trafficking and organized transnational crime;

- firm solution of questions of ensuring unification and coordination of all laws and their compliance to the Constitution of the Republic of Tajikistan;

- elimination of contradictions of legal acts and ensuring harmonization and single legislative space in Tajikistan;

- taking into account the daily requirement of society, process of economic and social reforming, development of political and cultural life of enhancement of the current legislation, development and adoption of the new laws;

- improvement of quality of the laws in case of enhancement of current laws and project developments of the new laws, conducting scientific and legal, anti-corruption, tender, financial, economic and social examination;

- reduction in compliance of the legislation of the Republic of Tajikistan with the international legal acts recognized by the Republic of Tajikistan;

- monitoring of regulatory legal acts.

3) Implementation of the Concept will promote stabilization of the legislation. The legislation of the Republic of Tajikistan regulating the legal basis contradicts public the relation favors to further development and enhancement of the similar relations.

4) Development, enhancement and quality of the legislation within the Concept consists of the following links:

- carrying out scientific and analytical researches of condition, development and practice of application of the legislation, development of offers on its enhancement;

- project developments of the laws, other regulatory legal acts, and also participations in development of the international legal acts;

- developments of offers on reduction of regulatory legal acts in compliance with the Constitution of the Republic of Tajikistan, the laws of the Republic of Tajikistan and international the legal acts recognized by the Republic of Tajikistan;

- conducting examination of drafts of the laws of the Majlisi namoyandagons of Majlisi Oli of the Republic of Tajikistan submitted for consideration;
