About approval of standards of the state services in the field of industrial safety

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve:

1) the standard of the state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety" according to appendix 1 to this order;

2) the standard of the state service "Registration of declarations of industrial safety of hazardous production facility" according to appendix 2 to this order;

3) the standard of the state service "Issue of permissions to use of the technologies, technical devices, materials used on hazardous production facilities, dangerous technical devices" according to appendix 3 to this order;

4) the standard of the state service "Issue of Permission to Permanent Use of Explosives and Products on Their Basis" according to appendix 4 to this order;

5) the standard of the state service "Issue of Permissions to Production of Explosive Works" according to appendix 5 to this order;

6) the standard of the state service "Approval of the Project Documentation on Construction, Expansion, Reconstruction, Upgrade, Preservation and Liquidation of Hazardous Production Facilities" according to appendix 6 to this order.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety"

Chapter 1. General provisions

1. The state service "Certification of Legal Entities on the Work Right in the field of Industrial Safety" (further - the state service).

2. The standard of the state service is developed by the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears Committee of industrial development and industrial safety of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service are performed by means of the web portal of "the electronic government" www.egov.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

from the date of giving of document package on the portal - 20 (twenty) working days;

in case of issue of the duplicate of-5 (five) working days.

The service provider within 2 (two) working days from the moment of receipt of documents of uslugopoluchatel checks completeness of the submitted documents.

In case of factual determination of incompleteness of the submitted documents and (or) documents with the expired effective period the service provider in the specified terms gives written motivated refusal in further review of the statement.

5. Form of rendering the state service: electronic.

6. Result of rendering the state service - the certificate on the work right in the field of industrial safety or the motivated answer about refusal in rendering the state service in cases and on the bases, stipulated in Item 10 these standards of the state service.

The result of rendering the state service goes to uslugopoluchatel to "personal account" in electronic form, certified by the digital signature (further - the EDS) the authorized person of the service provider.

7. The state service is rendered to legal entities (further - uslugopoluchatel) free of charge.

8. The working schedule of the portal - round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed on following the working day).

9. List of the documents necessary for rendering the state service:

1) the statement in electronic form with indication of industry and the type of the performed activities certified by the EDS of uslugopoluchatel according to appendix 1 to this standard of the state service;

2) the electronic copy of the expert opinion on compliance of the organization to the declared work types, requirements of industrial safety.

3) data in electronic form on the qualification list of the specialists who underwent testing for knowledge of requirements of industrial safety, material and technical resources.

2) discrepancy of the applicant to requirements imposed to the legal entities certified on the work right in the field of industrial safety.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of service providers and (or) his officials concerning rendering the state services

11. Appeal of decisions, actions (failure to act) of the service provider and (or) his officials concerning rendering the state services:

the claim is submitted addressed to the head of the service provider or addressed to the head of the Ministry of the addresses specified in Item 13 of this standard of the state service.

In the claim the uslugopoluchatel enters its surname, name, middle name (in case of its availability), the postal address, reference number and date. The claim is signed by uslugopoluchatel.
