List of amending documents

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve:

1) No. 661 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 22.08.2019;

2) the standard of the state service "State Registration of Courts in the State Ship Register of Ocean Ships", according to appendix 2 to this order;

3) the standard of the state service "State Registration of Ocean Ships in the Bare-boat — the Charter Register", according to appendix 3 to this order;

4) the standard of the state service "State Registration of the Property Rights to the Vessel Under Construction in the Register of Courts Under Construction", according to appendix 4 to this order;

5) the standard of the state service "Issue of Permission to Implementation of Cabotage by the Vessel Floating under the flag of Foreign State", according to appendix 5 to this order;

6) the standard of the state service "Carrying Out Engineering Certification of the Organizations and Test Laboratories", according to appendix 6 to this order;

7) the standard of the state service "State Registration of Courts in the International Ship Register of the Republic of Kazakhstan", according to appendix 7 to this order;

8) the standard of the state service "Issue of the Seaworthy Book", according to appendix 8 to this order.

2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A. A.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "State Registration of Courts in the State Ship Register of Ocean Ships"

Chapter 1. General provisions

1. The state service "State Registration of Courts in the State Ship Register of Ocean Ships" (further - the state service).

2. The standard of the state service is developed by the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears Sea port administration (further - the service provider).

Reception of applications and issue of results of rendering the state service is performed through the web portal of "the electronic government" (further - the portal).

Chapter 2. Procedure for rendering the state service

4. The term of rendering the state service from the moment of the address of uslugopoluchatel:

1) issue of the certificate on the right of navigation of the ocean ship under National flag of the Republic of Kazakhstan and the certificate on the property right to the vessel, vessel re-registration in the State ship register of ocean ships - 10 (ten) working days;

2) vessel exception of the State ship register of ocean ships - 2 (two) working days.

The service provider within 2 (two) working days from the moment of receipt of documents of uslugopoluchatel checks their completeness.

In case of factual determination of incompleteness of the submitted documents and (or) documents with the expired effective period the service provider in the specified terms gives written motivated refusal in further review of the statement.

5. Form of rendering the state service: electronic.

Result of rendering the state service - the certificate on the right of navigation of the ocean ship under national flag of the Republic of Kazakhstan and the certificate on the property right to the vessel, the certificate on vessel exception of the State ship register of ocean ships, the international ship register of the Republic of Kazakhstan or the motivated answer on refusal in rendering the state service in the bases, stipulated in Item 12 these standards of the state service.

Form of provision of result of rendering the state service: electronic.

On the portal to uslugopoluchatel the result of rendering the state service certified by the digital signature of the authorized person of the service provider goes to "personal account".

7. The state service is rendered to physical persons and legal entities (further - uslugopoluchatel) on paid basis.

Collection for rendering the state service is performed at the rates and according to the procedure, the established Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget (Tax code)".

Rates of charge constitute:

1) for state registration of the ocean ship - 60 monthly settlement indicators (further - MRP);

2) for re-registration of the ocean ship - 30 MRP.

Payment of the amount of collection is performed in cash or non-cash form through the banks of the second level and the organization performing separate types of banking activities or through payment gateway of "the electronic government" (further - PShEP).

8. The working schedule of the portal - round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed the next working afternoon).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or his representative by proxy):

for receipt of the certificate on the right of navigation of the ocean ship under National flag of the Republic of Kazakhstan and the certificate on the property right to the vessel:

1) the statement in electronic form;

2) the questionnaire of the ship register in form according to appendix to this standard;

3) the document confirming the property right to the vessel;

4) the certificate on the validity to swimming (when applicable);

5) certificate of measurement;

6) classification certificate;

7) the passenger certificate (for the passenger ship);

8) the document confirming payment in the budget of the amount of collection for state registration of the ocean ship;

9) the letter from the operator on North Caspian project, confirmatory that the vessel is constructed (is acquired) directly for implementation of the North Caspian project and is subject to transfer to authority on North Caspian project according to the procedure, provided by the Production sharing agreement across the Northern Caspian Sea of November 18, 1997 (for the courts which are in property of persons specified in Item 13 of Rules of state registration of the courts and the rights to them approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 165 (it is registered in the Register of state registration of regulatory legal acts at No. 11125) (further - Rules);

10) the document certifying that the vessel of foreign state is excluded from the register in which it is registered directly before change of flag of this state and it is not encumbered with mortgage;

11) the identity document of the owner (concerning physical persons) or the certificate of state registration of legal person owner (concerning legal entities).
