About approval of the Instruction for prevention of aviation incidents and incidents in the state aircraft of the Republic of Kazakhstan

According to the subitem 12) of article 15 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and for the purpose of streamlining of activities of aviation personnel for prevention of aviation incidents and incidents in the state aircraft of the Republic of Kazakhstan, I ORDER:

1. Approve the enclosed Instruction for prevention of aviation incidents and incidents in the state aircraft of the Republic of Kazakhstan.

2. To the chief of Head department on supervision of safety of flights of the state aircraft of the Republic of Kazakhstan:

1) in the established legislative procedure to send this order to the Ministry of Justice of the Republic of Kazakhstan for state registration;

The copy of this order to send 2) within ten calendar days after state registration to periodic printing editions and to information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication;

The order to place 3) after official publication on Internet resource of the Ministry of Defence of the Republic of Kazakhstan.

3. To impose control of execution of the order on heads of governing bodies of the state aircraft of the Republic of Kazakhstan.

4. Bring the order to officials in the part concerning them.

5. The order becomes effective on the expiration of ten calendar days from the date of its first official publication.

The instruction for prevention of aviation incidents and incidents in the state aircraft of the Republic of Kazakhstan

1. General provisions

1. The instruction for prevention of aviation incidents and incidents in the state aircraft of the Republic of Kazakhstan (further – the Instruction) is developed according to the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law).

2. The instruction disaggregates activities of aviation personnel of the state aircraft for prevention of aviation incidents and incidents.

3. The terms and determinations used in the Instruction:

1) air unit – the republican public institution performing the organization and accomplishment of flights of aircrafts of the state aircraft, their operation and storage;

2) aviation event – the event connected with operation of the aircraft during which there was flight safety hazard, damage or loss of the aircraft and/or death of the people who were on this aircraft;

3) aviation incident – the aviation event connected with flight operation of the aircraft which could create or created threat of integrity of the aircraft and (or) life of the people who are on its board, but did not end with aviation incident;

4) aviation incident – the aviation event connected with flight operation of the aircraft which led to death (to bodily harm from the death) of the people who were onboard the aircraft and (or) loss of this aircraft;

5) the aircraft – the device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from land (water) surface;

6) serious aviation incident with damage of the aircraft – aviation incident, in case of which recovery of the aircraft which sustained damage, perhaps and economically reasonablly;

7) flight operation of the aircraft – process of operation of the aircraft from the beginning of carrying out the aircraft by aircrew of pre-flight inspection till the moment when all persons which were onboard for the purpose of flight left the aircraft;

8) serious aviation incident – the aviation incident caused by emergence of difficult or emergency flight situation or in case of which at least of one of persons which were onboard the aircraft harm is done to health;

9) special situation – any emergency situation in the course of flight operation of the aircraft caused by impact of dangerous factor and leading to decrease in safety of flights;

10) parts of providing – aerotechnical bases, aviation commandant's offices, control centers of air traffic;

11) dangerous factor – any (real or potential) impact on any element of aviation system, capable to lead to emergence of aviation event;

12) the state aircraft – the aircraft which is under authority of authorized body in the field of the state aircraft, law-enforcement bodies, the Border service of Committee of homeland security of the Republic of Kazakhstan, and also other state bodies according to the decision of the Government of the Republic of Kazakhstan and used for the purpose of defense, safety of the state, protection of public order;

13) authorized body in the field of the state aircraft – Ministry of Defence of the Republic of Kazakhstan;

14) security service of flights of the state aircraft – the structural division of the Ministry of Defence of the Republic of Kazakhstan exercising the state control and supervision on safety issues of flights in the state aircraft of the Republic of Kazakhstan;

15) governing bodies of the state aircraft – Management of the commander-in-chief Silami of air defense of Armed Forces of the Republic of Kazakhstan, Main command of National guard of the Republic of Kazakhstan, Border service of Committee of homeland security of the Republic of Kazakhstan;

16) security service of flights – structural division as a part of governing body, air unit of the state aircraft.

2. Activities of heads (commanders, chiefs) of governing bodies for prevention of aviation incidents and incidents. Security service of flights

Paragraph 1. Activities of heads (commanders, chiefs) of governing bodies

4. The head (the commander, the chief) of governing body organizes work on prevention of aviation incidents and incidents.

Head of governing body, commander (chief) of air unit (division) of the state aircraft:

1) performs permanent management of all types of activity of subordinate structures connected with the organization of flights and their safe accomplishment;

2) directs work of officials of subordinate security service of flights;

3) is organized by timely and high-quality work planning of governing body on prevention of aviation incidents and incidents;

4) is carried out by the systematic analysis of security status of flights on the basis of observations, reports and the arriving information, estimates activities of officials for prevention of aviation incidents and incidents in subordinate governing bodies;

5) is controlled by accomplishment of actions of programs of prevention of aviation incidents and incidents (further – the Program) and plans for prevention of aviation incidents and incidents,

their security with financial and material resources;

6) is performed by matching (in coordination with higher body of safety of flights) and organizes training of specialists of security service of flights, controls level of training of heads (commanders, chiefs) of subordinate governing bodies in questions of prevention of aviation incidents and incidents.

Paragraph 2. Security service of flights

5. Security service of flights is intended for implementation of the activities directed to holding actions for prevention of aviation incidents and incidents with aircrafts of the state aircraft.

6. Exercises head department on supervision of safety of flights of the state aircraft of the Republic of Kazakhstan functions on the state control and supervision in sphere of activity of the state aircraft on safety issues of flights.

7. The decision of the head of state body in governing bodies of the state aircraft creates security service of flights.

8. Appointment of chiefs of security service of flights is made after approval of heads of higher bodies of safety of flights. Matching of officials is carried out to security service of flights in coordination with chiefs (heads) of these bodies.

9. Obligations of officials of security service of flights are approved with the head of higher body of safety of flights and affirm the direct heads (commanders, chiefs).

10. Subordinate security service of flights in the special relation submits to the head of higher body of safety of flights.

Paragraph 3. Powers of specialists of security service of flights

11. Specialists of security service of flights:

1) are revealed and analyze dangerous factors;

2) is controlled by holding preventive actions for the prevention of aviation incidents and incidents, remedial action and violations in the organization, accomplishment and ensuring flights;

3) are developed jointly with structural divisions of bodies of managements of actions for elimination or decrease in influence of dangerous factors, shortcomings and violations;

4) organize timely bringing to aviation personnel operational, periodic and represented on information request about aviation incidents and incidents;

5) organize work of subordinate security service of flights on prevention of aviation incidents and incidents in the state aircraft, exercise control of completeness of fulfillment of duties by staff of these bodies;

6) estimate security status of flights in air units;

7) control quality and completeness of conducting investigations of aviation incidents;

8) check condition of aircrafts, controls and ensuring flights in air units and parts of providing.

12. The head of security service of flights of the state aircraft within competence:

1) is appointed by carrying out in the state aircraft (in coordination with heads of governing bodies of the state aircraft) checks of activities of aviation personnel of the state aircraft in the part concerning safety of flights;

2) is stopped by fulfillment of duties by officials from among aviation personnel of the state aircraft of the Republic of Kazakhstan, allowed violations in the organization and carrying out flights of the state aircraft and use of airspace;

3) discharges of operation the aircraft equipment, controls and ensuring flights in case of discrepancy of their condition to requirements of technical documentation;

4) requests in-house documents and information on the questions carried to competence of public institution from state bodies;

5) participates in the events held by state bodies in the part concerning tasks on safety of flights of the state aircraft;

6) is organized by evaluating condition of accident rate in the state aircraft, develops offers on the prevention of aviation incidents and aviation incidents, provides information to heads of state bodies on these questions;

7) coordinates the work of security service of flights of the state aircraft directed to increase in reliability of aviation system;

8) organizes investigation of aviation incidents and aviation incidents with the state aircrafts, and also aviation incidents and aviation incidents in which the aviation personnel of several state bodies are involved;

Develops 9) for state bodies of the offer on procedure for investigation in case of factual determination of involvement in aviation incident or in aviation incident of aviation personnel of these state bodies;

10) makes the decision on procedure for further investigation of aviation incident or aviation incident in case of factual determination of involvement in aviation incident or in aviation incident of aviation personnel of other state bodies;

11) is organized by interaction with state bodies, security service of flights of civil and experimental aviation, research establishments and the organizations for investigation of aviation incidents and aviation incidents, safety of flights and increase in reliability of the state aircrafts.

13. Officials of security service of flights:

1) is heard by reports of officials of governing bodies (air units, parts of providing) on the organization and accomplishment of the actions directed to maintenance of safety of flights of aircrafts of the state aircraft;

2) is checked by activities of aviation personnel of the state aircraft, including level of training of aircrew in technology of piloting, air navigation and fighting application;

3) stop fulfillment of duties by officials from among aviation personnel from the deputy manager (the commander, the chief) and below in the governing body, allowed violations in the organization and carrying out flights of the state aircraft and use of airspace menacing to safety of flights with the subsequent report to the direct heads (commanders, chiefs);

4) is discharged of operation by aircrafts, controls and ensuring flights in case of discrepancy of their condition to requirements of technical documentation, with the subsequent report to the direct heads (commanders, chiefs);

5) instruct officials aviation personnel on elimination of the revealed violations and shortcomings of the part concerning safety of flights with the report to the direct heads (commanders, chiefs).

14. Instructions of officials of security service of flights of the state aircraft for the questions carried to their competence are accepted to execution by all officials of aviation personnel of the state aircraft.

15. Instructions of officials of security service of flights for the questions carried to their competence are accepted to execution by all officials of relevant organs of management, air units and parts of providing the state aircraft.

3. Organization of scheduled maintenance on prevention of aviation incidents and incidents

Paragraph 1. Content, essence and principles of scheduled maintenance on prevention of aviation incidents and incidents

16. Scheduled maintenance on prevention of aviation incidents and incidents constitutes the main content of activities of aviation commanders, chiefs, all aviation personnel on safety of flights and is carried out in all governing bodies, air units and parts of providing.

The essence of scheduled maintenance on prevention of aviation incidents and incidents consists in active identification of dangerous factors of flight work and taking measures to their elimination, decrease in their influence or evasion from them.

17. The basic principles determining effectiveness of work on prevention of aviation incidents and incidents are:

1) objectivity in case of identification and the analysis of dangerous factors;

2) timeliness and periodic repeating of actions for prevention of aviation incidents and incidents;

3) enhancement of methods, methods and principles of work on prevention of aviation incidents and incidents;

4) systematicity, complete scope of aviation activities, completeness of the taken measures;

5) personal participation and personal example of administrative board in carrying out work on prevention of aviation incidents and incidents, in observance of established procedure and rules of flights;

6) permanent efficiency evaluation of the carried-out work.

Paragraph 2. Identification of dangerous factors

18. All officials participating in the organization, management, accomplishment and ensuring flights, and also controlling their carrying out are engaged in identification of dangerous factors.

Control of activities for identification of dangerous factors is exercised by the senior aviation chiefs.

19. For identification of dangerous factors observations and the reports of the officials who are organizing, carrying out, providing and servicing flights, materials of means of objective control, the message of the officials controlling flights, entries in magazines of the head of flights and the senior engineer of flights, onboard and technical documentation, attestations of eyewitnesses and voluntary messages of persons having data on violations are used.

20. Main forms of work on identification of dangerous factors:

1) forecasting of the dangerous factors leading to aviation incidents and incidents;

2) inspection (check) of structural divisions;

3) investigation of aviation incidents and incidents;

4) voluntary (confidential) messages on the shortcomings, special situations menacing to safety of flights.

21. In air units (parts of providing) forecasting of dangerous factors is applied in the simplified type by job analysis of administrative board and anticipation of conditions in which the tasks set the forthcoming academic year are solved.

Treat such tasks: reeducation on other types of aircrafts, development of new policy strokes, systems of servicing of the aircraft equipment.

Results of forecasting are reflected in the appropriate analytical section of the Program.

22. In governing bodies of the state aircraft forecasting of dangerous factors is applied in the simplified type by job analysis of separate elements and aviation system in general. Forecasting is performed for the purpose of development of effective way of prevention of aviation incidents and incidents. By results of forecasting actions for elimination of dangerous factors and restriction of their possible manifestation are fulfilled.

23. Inspection (check) of structural divisions is one of direct obligations of all administrative board and is performed by officials of all instances.

At the same time inspection of structural divisions (control of their activities) is carried out by the head of higher instance, certain officials and/or special groups (commissions).

24. During inspection (check), legality of accomplishment of flights, quality of the organization, preparation and carrying out flights, condition of work on identification, investigation, accounting and the analysis of aviation incidents, violations and wrong actions of aircrew is checked.

Principles of inspection: systematicity, focus, objectivity, effectiveness.

25. Tasks of inspection (check) are:

1) studying of actual situation (security status of flights and scheduled maintenance) in the checked structural division;

2) the analysis and studying (regarding availability of dangerous factors) procedure for the organization and carrying out flight work and observance at the same time requirements of regulating documents;

3) identification of dangerous factors;

4) taking measures to elimination of dangerous factors;

5) refining of the Program. Control of program implementation;

6) carrying out analysis of results of inspection with administrative board of the checked division and assistance in remedial action;

7) efficiency evaluation of the taken measures.

26. Inspection (check) is subdivided on planned and unplanned:

1) planned – the inspection (check) appointed concerning the checked governing body (air unit, part of providing) based on the annual plan of conducting checks;

2) unplanned – the inspection (check) appointed concerning the specific checked governing body (air unit, part of providing) for the purpose of elimination of direct safety hazard of flights.

27. In case of detection of violations, the wrong actions (failure to act) of aviation personnel, inspecting (checking) stops the dangerous factors creating safety hazard of flights before the termination of flights.

Inspecting (checking) informs the commander (chief) of the checked governing body, air unit (part of providing) on all revealed shortcomings, omissions and notes, brings to it the list of shortcomings which will be reported on the higher chief.

28. By results of work inspecting carries out analysis and prepares the report for the chief about the state of affairs in the checked governing body (air unit, part of providing) with offers on elimination of the revealed shortcomings.

The actions plan on elimination of the revealed violations (shortcomings, omissions) represents the checked subject to inspection body within ten working days from the moment of receipt of the instruction on elimination of the revealed violations (shortcomings, omissions).

29. Investigation of aviation incidents and incidents is conducted for the purpose of identification of the reasons of aviation events and development of recommendations about prevention of aviation incidents and incidents. Investigation of aviation incidents and incidents is the most efficient form of identification of dangerous factors.

30. Aviation incidents in the state aircraft are classified on aviation incidents, serious aviation incidents, serious aviation incidents with damage of the aircraft.

31. Voluntary confidential messages on shortcomings, special situations and events which, according to their participants or witnesses, pose safety hazard of flights, but unknown to command, or known, but not investigated, significantly expand opportunities for identification of dangerous factors.

Voluntary confidential messages are used on the basis of credibility and strict confidentiality, in addition to officially established procedure of submission of reports on the revealed dangerous factors.

Paragraph 3. Work planning on prevention of aviation incidents and incidents

32. Work planning on prevention of aviation incidents and incidents is carried out in governing bodies, air units and parts of providing the state aircraft.

The main planned documents of scheduled maintenance are the Program and the actions plan for safety of flights in which actions of monthly planning are displayed.

Planned documents of scheduled maintenance are developed in governing bodies, air units and parts of providing the state aircraft and affirm the corresponding head of governing body of the state aircraft, the commander (chief) of air unit, part of providing.

In addition to these documents, in governing bodies and air units (parts of providing), plans of preventive actions for results of inspections (checks), and by results of investigations of aviation incidents and incidents are developed.

33. The program is the main regulating document determining complex of the interconnected works, organizational and technical actions, requirements established for certain period for the purpose of safety of flights.

The program is developed for calendar year.

34. Basic data for development of the program are:

1) organizational and methodical instructions for combat training;

2) the tasks facing governing body, air unit (organization) of the state aircraft for year;

3) conclusions from job analysis on prevention of aviation incidents and incidents for the accounting period;

4) orders (instructions) of the senior chiefs, Programs of subordinate structures.

35. In case of development of the Program the following factors are considered:

1) level of flight training and degree of fitness of flight crews;

2) the level of flight and methodical training of the leading and instructor structure;

3) level of training of heads of flights, personnel of group of management of flights, command posts and governing bodies of air traffic;

4) level of training of technical structure and its operating experience of this type of the aircraft equipment;

5) condition of the aircraft equipment, airfields, controls and ensuring flights;

6) condition of educational base for ensuring theoretical and practical training of aviation personnel;

7) the allocated and available material (material) and other resources;

8) results of scientific research;

9) requirements of documents for the organization and carrying out combat (flight) training;

10) experience of development and accomplishment of the previous Programs;

11) structure and possibilities of management systems and providing;
