1. Approve the enclosed Rules of swimming and the parking of courts in seaports of the Republic of Kazakhstan and on approaches to them.

2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A. A.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. I reserve control of execution of this order.

Rules of swimming and the parking of courts in seaports of the Republic of Kazakhstan and on approaches to them

Chapter 1. General provisions

1. Rules of swimming and the parking of courts in seaports of the Republic of Kazakhstan and on approaches to them (further - Rules) are developed according to subitem 55-11) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" (further - the Law) and determine procedure for swimming and the parking of courts in seaports of the Republic of Kazakhstan and on approaches to them.

2. These rules include:

1) swimming in limits of the water area of port and on approaches to it;

2) entrance of courts to port and their exit from port;

3) the parking of courts in port;

4) safety and safety of constructions in the port water area during the swimming and the parking of courts.

During the swimming and the parking of courts on the water area of seaports and approaches to them provisions of these rules and the order of the captain of port, including taking into account the International rules of the prevention of collision of courts in the sea are observed (further - MPPSS-72).

3-1. When calling (exit) seaport, swimming and the parking its water areas the payment for the obligatory services of seaport rendered by the owner of seaport (the operator of maritime terminal) and the navigation center which list is approved by the order of the Minister of investments and development of the Republic of Kazakhstan of January 30, 2015 No. 77 "About approval of the list of obligatory services of seaport" is levied from ocean ships (it is registered in the Register of state registration of regulatory legal acts for No. 10906).

The services of the navigation center which are part of obligatory services of seaport appear at the prices approved by authorized body in the field of merchant shipping according to the procedure, established by the law of the Republic of Kazakhstan "About state-owned property".

At the same time the service fee of the navigation center is not levied from warships and courts of Naval forces of Armed Forces of the Republic of Kazakhstan and the Border service of Committee of homeland security of the Republic of Kazakhstan, and also courts attracted by state bodies for taking measures to the prevention and (or) liquidation of emergency situations of natural and technogenic nature, participation in actions for increase in readiness for them (doctrines, trainings).
