About approval of Instructions for use high-level railway system
According to subitem 34-10) of Item 2 of article 14 of the Law of the Republic of Kazakhstan of December 8, 2001 "About rail transport" I ORDER:
1. Approve the enclosed Instructions for use by the high-level railway system.
2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A. A.) provide:
1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;
3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.
3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of use of the high-level railway system (further - Rules) are developed according to subitem 34-10) of Item 2 of article 14 of the Law of the Republic of Kazakhstan of December 8, 2001 "About rail transport" (further – the Law) and determine procedure for use of the high-level railway system.
2. In these rules the following concepts are used:
1) special trains – the trains for transportation of passengers and/or especially important military or strategic loads appointed according to special requirements according to the legislation of the Republic of Kazakhstan;
2) string of the schedule – graphical display of route of the train with indication of the points of departure, appointments and passings, departure times, arrival, technological parking, average times of the course, and also other technical parameters of the train;
3) the dispatching schedule – the operating plan of movement of extraordinary, special, auxiliary trains, the passenger and cargo trains which are beaten out from the train schedule;
4) dispatching regulation - management process and monitoring of transactions of transportation process in real time;
5) operational planning – process on creation of infrastructure by the national operator and carrier of work plans for days with breakdown on 12 (twelve) hour periods;
6) the monthly plan of transportation of goods – the document constituted by carrier and reflecting predicted data on loading amounts, correspondence of traffic volumes on calendar month;
7) extraordinary trains – the trains which are not provided by the traffic schedule (recovery and fire trains, snowplows, locomotives without cars, special self-propelled railway vehicles), intended for liquidation of obstacles to train service, accomplishment of unexpected works and the corresponding re-deployment of vehicles;
8) auxiliary trains – single or groups of locomotives (splotka), the train of cars, the diesel and electrosections following in Items of landing of passengers on technical stations and in sediment Items, and also trains for own needs of the national operator of infrastructure which movement is not provided by the specified train schedule;
9) additional requests – the requests for provision of access to services of the high-level railway system which arrived from carriers on additional transportations during action of the normative train schedule;
10) additional transportations – the transportations which are not provided by the normative train schedule, requiring allocation of additional strings of the schedule which implementation is possible due to the unoccupied or exempted in accordance with the established procedure handling capacity of the high-level railway system;
11) services of the high-level railway system – the services rendered to carriers by the national operator of infrastructure, connected with use of the high-level railway system for the omission and train service;
12) the service provision agreement of the high-level railway system (further – the agreement) – the service provision agreement of the high-level railway system signed between carrier and national operator of infrastructure according to the standard agreement on rendering services of the high-level railway system, approved by authorized body, performing management in spheres of natural monopolies according to the subitem 8) of article 7 of the Law of the Republic of Kazakhstan of December 27, 2018 "About natural monopolies".
13) share of handling capacity of the high-level railway system (quantity of strings of the schedule) – potential possibility of the high-level railway system on ensuring the maximum amount of train service (vapor of trains) in its any part in certain period;
14) distribution of handling capacity of the high-level railway system – the procedure of forming of the train schedule of all carriers on the basis of the principles established by these rules performed by the national operator of infrastructure;
15) the request for provision of access to services of the high-level railway system – the document filed by carriers to the national operator of infrastructure for receipt of access to services of the high-level railway system;
16) access to services of the high-level railway system – possibility of receipt of services of the high-level railway system by carriers for implementation of transportations;
17) the long-term agreement on rendering services of the high-level railway system – the service provision agreement of the high-level railway system signed between the national operator of infrastructure and carrier for at least 5 (five) years;
18) the technical specification of sites of the high-level railway system (further – the technical specification) – the document constituted and approved by the national operator of infrastructure, containing technical characteristics of sites of the high-level railway system and stations, data on daily handling capacity of sites of the high-level railway system and forecast time of reception-transmission (exchange) of cargo trains, the reserved shares of handling capacity of the high-level railway system, planned dates of repair, free handling capacity of sites of the high-level railway system, projects of strings of the schedule;
19) handling capacity of the site of the high-level railway system – the amount of movement in trains (vapors of trains) which can be passed on the site of the high-level railway system for settlement period of time (days) depending on technical and technological capabilities of the high-level railway system, railway vehicles and methods of the organization of train service taking into account the omission of trains of different categories;
