ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of technical operation and repair of civil aircrafts of the Republic of Kazakhstan

According to subitem 41-24) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" I ORDER:

1. Approve the enclosed Rules of technical operation and repair of civil aircrafts of the Republic of Kazakhstan.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on iternet-resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of technical operation and repair of civil aircrafts of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of technical operation and repair of civil aircrafts of the Republic of Kazakhstan (further - Rules) are developed according to subitem 41-24) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and determine procedure for technical operation and repair of civil aircrafts of the Republic of Kazakhstan.

2. In these rules the following terms and determinations are applied:

1) the aircraft equipment (further - AT) - complex of aviation technical means (aircrafts, their onboard equipment and aggregates, engines, aviation arms of aircrafts of the state aircraft, aviation survival equipment, complex exercise machines (flight simulators), components, technical means of air traffic control, navigation of landing and communication, and also the means of land ensuring common and special application intended for accomplishment of flight, the organization of air traffic control and land ensuring flights;

2) the organization for maintenance and repair of the aircraft equipment (further - the organization for TO and PAT) - the legal entity or structural division of the legal entity performing maintenance and (or) repair of the aircraft equipment and having the existing certificate of the organization for maintenance and repair of the aircraft equipment;

3) repair of the aircraft equipment (further - RAT) - complex of transactions on recovery of operability and operability of the aircraft equipment;

4) authorized body in the field of civil aviation (further - authorized body) - the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

4-1) authorized organization in the field of civil aviation (further - authorized organization) - the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

5) the aircraft (further - AF) - the device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from land (water) surface;

6) the allowing personnel - the aviation personnel authorized by the organization for maintenance perform the admission of AF or his components to operation after maintenance accomplishment;

7) component - the aviation engine, the air screw, the component or other component of AF;

8) periodic maintenance - the works on maintenance which are not answering to criteria of "operational maintenance" on complexity and requirements to conditions of their accomplishment;

9) maintenance (further - THAT) - work, necessary for ensuring preserving the flight validity of the aircraft, including control recovery work, checks, replacements, elimination of defects which are carried out as separately, and in combination, and also practical implementation of modification;

10) engineering and aviation ensuring flights - satisfaction of the current and perspective demands of air transport in the operational and prepared for flights aircrafts;

11) metrological control - the activities performed by metrological services of state bodies of management, physical persons and legal entities for the purpose of check of observance of metrological rules and regulations;

12) operational maintenance - the works on THAT performed for preparation of AF for flight. Operational THAT includes: search and elimination of refusals; replacement of components (both engines, and air screws belong to such components); planned works on THAT (including the visual surveys for identification of obvious damages / violations which are not requiring labor-consuming profound control). It also includes works on internal elements of design, onboard systems and the power plant for which accomplishment there is access through quickly opened panels/hatches; and also running repair and simple modifications which do not require essential disassembly and can be executed with the simplest types of the equipment and tool;

13) procedures - the normative provisions and instructions stated in the leading and technological documents. For the purposes THAT concept of the procedure covers two types of procedures: the organizational procedures establishing procedure both rules of interaction of divisions and/or faces of aviation personnel of the organization, and the technological procedures establishing technology to accomplishment of different types of activities and works on THAT;

14) the operator - the physical person or legal entity which is engaged in operation of civil aircrafts or offering the services in this area;

15) maintenance of the flight validity - set of the processes providing compliance of AF to the existing requirements of airworthiness standards of civil aircrafts of the Republic of Kazakhstan during useful life of AF, approved by authorized body according to subitem 41-19) of Item 1 of article 14 of the Law (further - airworthiness standards of AF);

16) large modification is the change of standard design which is not provided by technical requirements (specifications) on AF, the AF engine or the air screw which can significantly influence restrictions of weight and centering, the design durability, flight characteristics, operation of the power plant, operational characteristics and other qualities influencing the flight validity or characteristics connected with the environment;

17) operational documentation (further - ED) - documentation regulating flight and technical operation of the aircraft and component, including THAT, and containing operational restrictions, procedures and recommendations;

18) operational and repair documentation (further - ERD) - the documentation developed by developer of the aircraft and/or its component and establishing organizational, normative, technical and other service regulations of aircrafts and/or its components, their maintenance and repair.

3. Technical operation of the aircraft (further - AF) includes processes:

1) maintenance;

2) control of compliance of flight technical characteristics of AF to requirements of airworthiness standards of AF and to documents of the AF developer.

4. Control of compliance of flight technical characteristics of AF to requirements of managements for flight operation is exercised by crews of AF and engineering personnel (further - ITP).

5. Repair includes process of recovery of the flight validity of the aircraft determined by requirements of airworthiness standards of AF.

6. Maintenance and repair of civil aircrafts are made according to these rules the certified organizations for maintenance and repair of the aircraft equipment, the aviation personnel having the existing certificate granted according to article 54 of the Law or the certificate granted by foreign state and recognized according to article 55 of the Law.

7. Maintenance of civil aircrafts is performed according to programs (regulations) of maintenance (further - RTO). The program (regulations) of maintenance of the aircraft registered in the State register of civil aircrafts of the Republic of Kazakhstan affirms authorized organization.

8. It is not allowed to use when carrying out maintenance and repair of civil aircrafts the aggregates, components and spare parts to them which do not have the identifying documents (forms, passports, labels, documents on the admission to operation, authentic duplicates) issued by their producer or the certified organization for maintenance and repair according to Item 3 of article 48 of the Law.

9. Compliance of the organizations for TO and PAT, certified requirements is confirmed by authorized organization issue of the certificate according to Rules of certification and issue of the certificate of the organization for maintenance and repair of the aircraft equipment of civil aviation, according to approved by authorized body, according to subitem 41-25) of Item 1 of article 14 of the Law (further - Rules of certification and issue of the certificate of the organization for TO and PAT).

10. The certified organizations for TO and PAT of foreign states are allowed to works on maintenance and repair after recognition of their certificates according to Item 5 of article 48 of the Law.

11. The certified organization for TO and PAT according to the order of the Minister of Transport and Communications of the Republic of Kazakhstan of March 28, 2011 No. 173 "About approval of Standard instructions for safety management of flights of operators of civil aircrafts, at the airports, when servicing air traffic, in case of maintenance of aircrafts" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 6855) implements safety management system of flights depending on amount and complexity of the performed works according to Item 6 of article 48 of the Law.

12. Technical operation of the aircraft equipment is made by the organization for TO and PAT or aviation personnel performing engineering and aviation ensuring flights.

13. Engineering and aviation ensuring flights performs the following tasks:

1) timely, complete and high-quality requirements satisfaction of airlines in the operational and prepared for flights aircrafts;

2) accomplishment of the set ED of requirements, specifications and guarantees of effective and safe use of AT to destination.

14. The organization for TO and PAT performs the following functions:

1) the organization and accomplishment of TO and PAT (including - recovery of the AT resource), its completions, checks and surveys, quality control of AT and its THAT and repair - according to requirements of operational and repair documentation;

2) search and elimination of refusals and defects of AT, collection, accounting and data processing about the refusals and defects of the aircraft equipment revealed in flight and on the earth;

3) reliability analysis, the analysis and generalization of experience of technical operation of the aircraft equipment, its THAT and repair - with actions for the prevention of aviation incidents, refusals and defects of AT, for the purpose of safety of flights and enhancement of own activities;

4) conducting damage claims activities, presentation of requirements to suppliers of AT about remedial action of their products;

5) control of compliance of flight technical characteristics of AF to requirements of management for flight operation;

6) ensuring protection of AF in case of their maintenance and repair;

7) participation in development and realization of progressive technologies of control of condition of AT, its THAT and repair, labor organizations and productions;

8) development of suggestions for improvement of operational and repair documentation of the aircraft equipment;

9) ensuring execution of own needs for operational and repair documentation of the aircraft equipment, its maintaining and ensuring safety, including the identifying (number-specific) documentation;

10) maintaining the established forms of accounting and the reporting on: to completions of AT, activities of engineering air service (further - IAS), to structure, condition, use and movement of the park of aircrafts, material property, spare parts and the equipment;

11) implementation of measures for providing normative working conditions of workers and production organization and repair, fire safety and environmental protection, to ensuring production by necessary rooms, equipment, spare parts and aerotechnical property, their contents, storage, use and servicing;

12) the organization and work for evacuation and recovery of the damaged courts;

13) the organization and equipment of educational technical base, the organization of technical training of personnel of IAS and training of specialists on the aircraft equipment;

14) matching and placement of personnel of IAS, carrying out systematic work on forming of responsible attitude of each worker to the service duties.

15. Control of compliance of flight technical characteristics of AF to requirements of management for flight operation is exercised by crews of AF and ITP including use of means of objective control.

Crew members provide identification and timely entering into the logbook of variations in work of the AF systems, on ITP - the analysis of the reasons of variations of values of flight technical characteristics, the modes of flight which are written down in the logbook, intended for registration of parameters of work of AT, and also fixed by means of objective control.

16. Operation of AF by crews includes complex of the transactions which are carried out by them on use of AF, its systems, products and the equipment on the earth and in flight (flight operation of AF) from the moment of acceptance of AF under responsibility of crew and until delivery of the aircraft under responsibility of other services. The specified complex of transactions is regulated by management on flight operation for AF of specific type.

17. The crew is responsible for AF from the moment of its acceptance under the responsibility from representatives of other services or from other crew and until delivery of the aircraft to the representative of other service or other crew.

Chapter 2. Procedure for technical operation of civil aircrafts of the Republic of Kazakhstan

18. The operational AF having the remaining balance of resource, sufficient for accomplishment of specific flight, and service life which is answering to specifications, underwent the established corresponding testing and preparation allows to flights (special survey of AF, ice accretion elimination and so forth).

19. The aircraft is considered operational under the following simultaneous conditions:

1) the glider, engines and components have remaining balance of resource and service life, are fully completed according to the list and number-specific documentation (forms, the logbook);

2) on the vessel next THAT is executed, provided by regulations, defects and their effects are eliminated;

3) technological and identification (number-specific) documentation is drawn up, operability of the vessel is confirmed with signatures of the corresponding officials in the map job specification.

20. Operational AF is considered ready to departure under the following simultaneous conditions:

1) the glider, engines and components have remaining balance of resource, sufficient for accomplishment of specific flight, and service life;

2) AF is filled with fuels and lubricants, gases, special liquids, equipped with all necessary components, according to task for flight and requirements of the program (regulations) of maintenance, the maintenance guide and management on flight operation;

3) works on providing departure are performed and drawn up by signatures in the map job specification;

4) by AF is transferred to crew with priyemo-transfer registration by signatures in the map job specification and the logbook.

In case of non-compliance with the specified requirements of AF it cannot be allowed in flight.

21. Need of the operator for operational AF is determined by amounts of airborne transportations and aviation works, dynamics of use of AF - the schedule of production of flights.

22. In case of technical operation of AF it is necessary:

1) to observe the operational restrictions set by regulating documents for AF, the main and components including on working hours of AT in flight and on the earth;

2) timely, in full and it is correct to perform works in case of THAT and storage;

3) to use the fuels and lubricants, special liquids, gases, consumable materials provided to application on AF of this type;

4) to follow rules of the kontrovka of demountable connections protecting details from spontaneous opening, otvorachivaniye and loss;

5) to protect AF from damages in case of start and approbation of engines, dismantling installation works, towage and loading (unloading), from collision with obstacles;

6) to use parking of AF only artificial and soil strips, paths, platforms, intended and/or suitable for these purposes;

7) to contain in good repair and readiness for proper use crash equipment sets (further - ASO), to perform onboard ASO and means AF, transported on AF according to airworthiness standards of AF;

8) not to allow change of provision AF on the parking and switching off of power supply from the moment of inclusion of inertial system before its transfer in operating mode;

9) to apply measures for protection of AF from destructive impact of the environment (snow, ice, water, dust).

23. Upon termination of works contractors check for AF whether remained on site task performance (in compartments, hatches, airintakes, cabins) details, the tool, other foreign objects.

24. In case of maintenance of AF of specific type it is allowed to use only operational, meeting the requirements of the conforming ED, special vehicles, power sources, heavy lift gears, heaters, other means of land servicing of common application. The procedure for confirmation of operability of the specified means is determined by the operator and the organization on THAT and repair.

25. ITP provides control of use of the means of land servicing of common application involved for maintenance of AT and does not allow to THAT special vehicle aircrafts, not completed with regular earthing provisions and fire extinguishing, to take operational measures for liquidation of the possible emergencies connected with abnormal work of means of land servicing.

26. In case of the parking of AF lasting more than two watch (if other is not specified in ED of the AF specific type), and in case of rain, snowfall, blizzard, fog, dust storm - irrespective of parking duration, on air inlets, receivers of systems of total and static pressure, other AF systems it is necessary to install the protection devices provided by ED.

The specified protection devices are painted in red color and have red soft pennants (for the purpose of prevention of departure of AF with the established protection devices). On AF where installation sites of protection devices are painted in red (orange) color, protection devices are painted in black color. The protection devices removed from AF for the period of flight and THAT store in the places ensuring their safety and operability.

27. In case of shift of products from one AF on another the production technology of specific works is applied, their organization developed in details, registration, information maintenance and control is provided.

28. Installation on AF of the modernized or new types of components, accomplishment of completions, and also changes of design of AT make according to the bulletins enacted by the AF developer.

29. THAT the elements of glider, the power plant, aeronautical and radio-electronic equipment (further - A and REO) entering one AF functional system is provided with the organization for TO and PAT or the technical list of the operator of AF.

30. For the purpose of safety on AF in case of its THAT the AF onboard network is cut off power in the following cases:

1) in case of accomplishment on AF of dismantling and installation works on A and REO;

2) in case of surveys and checks of distributing devices (boxes);

3) in case of recovery work in electrochains and onboard oxygen system;

4) in case of performance of works on AF with use of flammable materials;

5) in case of equipment (rassnaryazheniye) of devices pyrotechnic means.

In the specified cases in crew cabin, at switches of airfield and emergency power supply, and also at sockets of connection of land-based sources of the electric power hang out the warning pennants with the text "Under current not to include. There are works".
