RESOLUTION OF THE MINISTRY OF TRANSPORT AND COMMUNICATIONS OF THE REPUBLIC OF BELARUS

About modification and amendments in the resolution of the Ministry of Transport and Communications of the Republic of Belarus of March 31, 2008 No. 40

Based on the paragraph of the fifth of part one of article 9 of the Law of the Republic of Belarus of January 6, 1999 "About rail transport" in edition of the Law of the Republic of Belarus of December 31, 2014 and subitem 5.9 of Item 5 of the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985 "Questions of the Ministry of Transport and Communications of the Republic of Belarus", the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Bring in the resolution of the Ministry of Transport and Communications of the Republic of Belarus of March 31, 2008 No. 40 "About approval of rules of transportation of goods by railway transport public" (The national register of legal acts of the Republic of Belarus, 2008, No. 106, 8/18622; 2011, No. 14, 8/23271; 2012, No. 15, 8/24671; National legal Internet portal of the Republic of Belarus, 28.08.2012, 8/26317; 13:02. 2013, 8/26838) following changes and amendments:

1.1. the twelfth Item 1 to state the paragraph in the following edition:

"Service regulations of railway tracks of uncommon use;";

1.2. To be reworded as follows the Regulations of Admission of loads to transportation by railway transport public approved by this resolution (are applied);

1.3. in Rules of transportations by railway transport the public of loads with the announced value approved by this resolution:

state Item 1 in the following edition:

"1. These rules establish procedure for presentation by consignors of loads to transportation by railway transport public with the announcement of their value.";

in Item 5:

state part one in the following edition:

"5. In case of presentation to cargo hauling with the announced value the consignor together with the transport rail waybill shall show to carrier the inventory of loads with the announced value completed in the corresponding GU-112, form provided in appendix to these rules. In transit load with use of the electronic waybill the inventory can be constituted in electronic form in the presence of the contract on electronic exchange of documents between carrier and the consignor.";

in part three of the word "at the railway station" shall be replaced with words "at carrier";

state Item 6 in the following edition:

"6. The carrier during the cargo reception shown to transportation checks compliance of quantity of cargo pieces this to the inventory of loads. The carrier has the right to demand representation by the consignor of the documents confirming load cost and also the opening by the consignor shown to cargo hauling for survey and check of value if there is basis to assume that load value is overestimated by the consignor.";

In case of disagreement with contents of the act of damage of the car the conductor signs it with notes, having specified motives of disagreement. The first copy of the act of damage of the car is applied to delivery note for delivery on railway station of destination to the consignee or to the road sheet according to which the car is sent in addition if the damaged car went as a part of group sending. At the same time in the road sheet according to which the car is sent in addition under the name of load or in the column intended for marks of carrier, the original of delivery note number of the act of damage of the car, date and the reason of its creation are specified. The second copy of the act of damage of the car of carrier is applied to the bill for damage of the car which is made out by carrier for payment to the consignee. The third copy of the act of damage of the car remains at carrier at the railway station where there was car uncoupling.";

THE CONDUCTOR SHALL:

ensure safety of the accompanied loads, watch condition of fixture and stability of loads in the car, to take measures for protection of loads from spoil, to recovery of fixture of loads;

feed and give to drink to the accompanied animals and birds;

clear cars of manure and garbage in the places established by administration of the railway station;

tell in writing carrier disease of animals and birds in transit, defect of heating devices and the equipment of cars, and also detection of violation of fixture or stability of loads in the car;

know the staff instruction on maintenance of dangerous goods developed and approved by the consignor dangerous properties of load and security measure. In case of origin fire or emergency to be effective taking into account requirements of the specified instruction;

in transit perishable loads to heat, air the car if it is required for this sort of load;

hand over load to the consignee;

in case of stay on railway tracks to observe the following requirements of personal security:

pass railway tracks in places specially allotted for this purpose at right angle, previously having convinced that on the ways there are no coming railway vehicles;

not pass railway tracks in the locations of arrows and crosspieces;

not run across railway tracks before the coming railway vehicles, and in case of pass along cars and their bypass not to go near them closely;

not creep under cars and through automatic coupling, and also between close standing cars. Not sit on boards of platforms, gondola cars and not to stand in open doors of cars in case of their movement;

on the electrified railway tracks not to rise higher than the level of roof of the car as high voltage in contact network is life-threatening. The conductor shall declare to the person on duty on the station need to rise above this level.

IT IS FORBIDDEN TO CONDUCTORS OF LOADS:

interfere with administrative decrees of the railway station;

smoke in the car in which there is load;

use kerosene stoves, paraffin stoves and other heating devices, except pig-iron furnaces of standard type with use of solid fuel (coal, firewood);

use lamps, candles and other lighting fixtures, except the lamps meeting the requirements of fire safety;

place trestle beds, bedding, personal belongings and fuel reserves in the car at distance is closer than 1 m from the burning furnaces;

leave or hang up lamps in places, accessible for animals, and also warehouse hay, straw near open doorways and hatches;

allow in cars with the accompanied load of strangers, except authorized workers of rail transport public and the law enforcement agencies which showed the identity certificate;

take the loads which are not specified in the transport rail waybill, be engaged in trade in the transported loads and other goods;

throw out from cars manure and garbage on railway tracks in unspecified places.

THE CONDUCTOR BEARS IN ACCORDANCE WITH THE ESTABLISHED PROCEDURE RESPONSIBILITY:

for not safety of the transported loads;

for damage of cars, event through his fault;

for loss and damage to machinery and stock of cars;

for violation of the requirements stated in the certificate.

"21. The seals hung on the car, container shall have the following signs:

full or abbreviated name of railway station of origin;

abbreviated name of the Belarusian railroad;

control signs (one letter and three figures);

when sealing by carrier - the abbreviated name of carrier. When sealing by national (common network) carrier the abbreviated name of the Belarusian railroad - BCh is specified;

when sealing by the consignor - the abbreviated name of the consignor.";

state Item 22 in the following edition:

"22. ZPU irrespective of who makes sealing - the consignor or carrier shall have the following signs:

abbreviated name of the Belarusian railroad - BCh;

control sign (at least six signs);

trademark of the organization manufacturer;

last two figures of year of release of ZPU;

name (type) of ZPU.

In addition the name of railway station of origin and the sender, if necessary - reduced can be put.

Application of ZPU with identical, and also not clear and incomplete control signs is not allowed.";

in Item 23 of the word "the organization of the Belarusian railroad" to replace with the word "carrier";

add Rules with Items 24-32 of the following content:

"24. Lead seals with the camera or two parallel openings are applied to sealing of cars and containers (standard size 7 x 16,5) according to GOST 30269-95 "Seals lead. General specifications" and thermally processed wire for sealing by diameter of 0,6-0,7 of mm in accordance with GOST 3282-74 "Wire steel low-carbon general purpose".

The wire applied to hanging of lead seals is twisted previously in two threads at the rate of four rounds on 1 cm of length.

25. Before sealing of the universal closed car both door slips become stronger turning from the annealed wire 250-260 mm long, with a diameter of 6 mm. The wire for turning is passed so that it covered door overlay and ear of rack of the car, then both ends of wire are inserted into metal die which moves on wire closely to door slip then twisting is made. The metal die shall have the size of 50 x 20 mm, thickness of 2-4 mm and two openings with a diameter of 7 mm at distance of 25 mm from each other (the figure 1 of appendix 1 to these rules).

Wire turning is imposed when sealing all types of cars, containers by lead seals, and also in case of transportation of goods without seals when sealing is not obligatory. Its imposing is made by special metal plate neck with two handles and two openings with a diameter of 7-10 mm and distance between them 30-35 mm; neck length - 300 mm.

When hanging seal on container the wire is passed in two turnovers through opening on the handle and latch of the locking device of cam type (the figure 2 of appendix 1 to these rules) in closed position of the locking device.
