ORDER OF THE MINISTER OF INTERNAL AFFAIRS OF THE REPUBLIC OF KAZAKHSTAN

About some questions of realization of personnel policy in law-enforcement bodies of the Republic of Kazakhstan

(as amended of the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of 22.11.2017 No. 765)

According to the subitem 9) of Article 5-1, Item 2 of Article 7, Items 3 and 7 of article 29 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service" I ORDER:

1. Approve:

1) the Technique of assessment of results of staffing and quality of work of subjects of personnel policy of law-enforcement bodies of the Republic of Kazakhstan according to appendix 1 to this order;

2) Rules and methods of determination of professional competences, key indicators and measure calculation of competitiveness in law-enforcement bodies of the Republic of Kazakhstan according to appendix 2 to this order;

3) System and criteria of career development of staff of law-enforcement bodies of the Republic of Kazakhstan according to appendix 3 to this order;

4) the Technique of implementation of the personnel forecast in law-enforcement bodies of the Republic of Kazakhstan according to appendix 4 to this order.

2. To department of personnel work of the Ministry of Internal Affairs of the Republic of Kazakhstan (Abdigaliyev A. U.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

4) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the First Deputy Minister of Internal Affairs of the Republic of Kazakhstan the police lieutenant general Demeuov M. G. and the Department of personnel work of the Ministry of Internal Affairs of the Republic of Kazakhstan (Abdigaliyev A. U.).

4. This order becomes effective after ten calendar days after its first official publication.

Technique of assessment of results of staffing and quality of work of subjects of personnel policy of law-enforcement bodies of the Republic of Kazakhstan

1. General provisions

1. This Technique of assessment of results of staffing and quality of work of subjects of personnel policy of law-enforcement bodies of the Republic of Kazakhstan (further - the Technique) is intended for determination of efficiency of measures for staffing and quality of work of subjects of personnel policy in law-enforcement bodies.

2. Subjects of personnel policy are the first heads and their deputies in territorial subdivisions of law-enforcement bodies and its departments in areas, the cities of Astana, Almaty and on transport, criminal executive system, divisions on emergency situations, specialized security service, higher educational institutions (further - territorial subdivisions of law-enforcement bodies).

3. Objects of assessment of subjects of personnel policy are territorial subdivisions of law-enforcement bodies and its department in areas, the cities of Astana, Almaty and on transport, criminal executive system, divisions on emergency situations, specialized security service, higher educational institutions.

4. Assessment of results of staffing and quality of work of subjects of personnel policy of law-enforcement bodies (further - Assessment of subjects of personnel policy) is performed by Personnel service of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - Personnel service).

5. Assessment of subjects of personnel policy is performed following the results of calendar year.

6. Assessment of subjects of personnel policy is performed by the following criteria:

1) efficiency of use of human resources;

2) training of staff of law-enforcement bodies;

3) overall performance on respect for discipline, legality and prevention of corruption;

4) professional training level.

2. Criterion "Efficiency of use of human resources"

7. Assessment by this criterion is carried out on the basis of information on the employees of key element in this territorial subdivision of law-enforcement body dismissed and who were disposed according to the procedure of sending out on business in other territorial subdivisions, law enforcement agencies and military forming in form provided by territorial subdivisions of law-enforcement bodies according to appendix 1 to this Technique, information about promotion of the employees appointed to higher executive position in this territorial divisions of law-enforcement body from number of persons employed of this territorial subdivision in form according to appendix 2 to this Technique, information on the employees appointed to higher executive positions in this territorial subdivision of law-enforcement body according to the procedure of sending out on business from other territorial subdivisions, law enforcement agencies and military forming in form according to appendix 3 to this Technique, information on timeliness of provision of annual paid labor leave on form, according to appendix 4 to this Technique.

8. Assessment is calculated by the following formula:

                                                                K1 = P1 + P2 + P3 + P4

where K1 - assessment of territorial subdivision of law-enforcement body by this criterion;

P1 - indicator "the staff turnover level";

P2 - indicator "the level of not completeness of established posts";

P3 - indicator "promotion of staff of territorial subdivisions of law-enforcement body";

P4 - indicator "timeliness of provision of labor leave".

The maximum value by this criterion makes 25 points.

9. Assessment on indicator "the staff turnover level" is calculated by the following formula:

                                                                  P1 = k * (1 - and / 0,07 * b)

where k - coefficient for reduction of the received results to weight value (6,25) is equal;

a - the number of employees of territorial subdivision of the law-enforcement bodies dismissed, which were disposed (recalled) in the accounting period;

b - actual number of staff of territorial subdivision of law-enforcement body.

When calculating assessment for removability the employees dismissed are not considered:

in connection with retirement;

in connection with reorganization of law-enforcement body or staff reduction;

due to illness, in connection with death;

in connection with appointment to political position.

In case of dismissal at own will or sending out on business in other divisions, including law enforcement agencies and military forming, in connection with change of the head of territorial subdivision of law-enforcement body, more than 3% of employees of key element within the next 3 months, from the received result are taken away 3 points.

The maximum value on this indicator makes point 6,25.

10. Assessment on indicator "the level of not completeness of established posts" is calculated by the following formula:

                                                                P2 = k * (1 - and / 0,1 * b)

where k - coefficient for reduction of the received results to weight value (6,25) is equal;

a - quantity of vacant established posts of territorial subdivision of law-enforcement body (shortage);

b - average quantity of positions according to the staff list of territorial subdivision of law-enforcement body (number of staff).

The average quantity of positions is determined as average value of the amount of quantity of positions of territorial subdivision of law-enforcement body with first on the fourth quarter inclusive.

In case of the received result with minus sign, to territorial subdivision of law-enforcement bodies on this indicator value 0 is put.

The maximum value on this indicator makes point 6,25.

11. Assessment on indicator "promotion of staff of territorial subdivisions of law-enforcement body" is calculated by the following formula:

                                                                      P3 = k * and / b

where k - coefficient for reduction of the received results to weight value (6,25) is equal;

a - the number of the employees appointed to higher executive position in this territorial subdivision of law-enforcement body from number of persons employed of this territorial subdivision;

b - total quantity of the employees appointed to higher executive positions in this territorial subdivision of law-enforcement body from personnel reserve on promotion according to the procedure of sending out on business from other territorial subdivisions, law enforcement agencies and military forming.

If in territorial subdivision of law-enforcement body appointments to higher positions due to the lack of vacant higher positions were not made, to territorial subdivision of law-enforcement body on this indicator 3 points are put.

If in territorial subdivision of law-enforcement body appointments to higher positions only from personnel reserve of this division were made and appointments to positions according to the procedure of sending out on business from other territorial subdivisions, law enforcement agencies and military forming were not made, to law-enforcement body on this indicator the maximum value is put.

The maximum value on this indicator makes 6,25 of points.

12. Assessment on indicator "timeliness of provision of labor leave" is calculated by the following formula:

                                                                     P4 = k * and / b

where k - coefficient for reduction of the received results to weight value (6,25) is equal;

a - the number of employees of territorial subdivision of law-enforcement body which are granted annual paid labor leave in full in the accounting period;

b - actual number of staff of territorial subdivision of law-enforcement body.

The maximum value on this indicator makes point 6,25.

3. Criterion "Training of staff of law-enforcement bodies"

13. Assessment by this criterion is carried out on the basis of information on the employees who are subject to passing and last advanced training and retraining in form provided by territorial subdivisions of law-enforcement bodies according to appendix 5 to this Technique and information on the employees who are subject to passing and underwent retraining in form according to appendix 6 to this Technique.

14. Assessment is calculated by the following formula:

                                                                      K2 = P1 + P2

where K2 - assessment of territorial subdivision of law-enforcement body by this criterion;

P1 - indicator "advanced training of staff of law-enforcement bodies";

P2 - indicator "retraining of staff of law-enforcement bodies".

The maximum value by this criterion makes 25 points.

15. Assessment on indicator "advanced training of staff of law-enforcement bodies" is calculated by the following formula:

                                                                 P1 = k * a/b

where k - coefficient for reduction of the received results to weight value (17,5) is equal;

a - the number of employees of territorial subdivision of the law-enforcement bodies which underwent advanced training in the accounting period from among subjects;

b - the number of employees of territorial subdivision of the law-enforcement bodies which are subject to passing of advanced training in the accounting period.

The maximum value by this criterion makes point 17,5.

16. Assessment on indicator "retraining of staff of law-enforcement bodies" is calculated by the following formula:

                                                                 P1 = k * with / d

where k - coefficient for reduction of the received results to weight value (7,5) is equal;

c - the number of the employees of territorial subdivision of law-enforcement body who underwent retraining in the accounting period from among subjects;

d - the number of the employees of territorial subdivision of law-enforcement body who are subject to passing of retraining in the accounting period.

The maximum value on this indicator makes point 7,5.

4. Criterion "Overall performance on respect for discipline, legality and prevention of corruption"

17. Assessment is carried out on the basis of represented by territorial subdivision of law-enforcement body and division of own safety of information on the number of the employees condemned for making of corruption crime, who made ethical offenses, dismissed for negative motives.

18. When evaluating the number of the employees condemned for making of corruption crime, who made ethical offenses, dismissed for negative motives counting on 1000 units of staff of territorial authority of internal affairs is considered.

19. Assessment by criterion "Overall performance on respect for discipline, legality and prevention of corruption" is exposed in form, according to appendix 7 to this Technique.

20. Assessment is calculated by the following formula:

                                                            K3 = P1 + P2 + P3

where K3 - assessment of territorial subdivision of law-enforcement body by this criterion;

P1 - indicator "the number of the employees condemned for making of corruption crime, including who were the staff of this territorial subdivision of law-enforcement body at the time of making of criminal offense";

P2 - indicator "the number of the employees who made ethical offense, including being the staff of this territorial subdivision of law-enforcement body at the time of making of offense;

P3 - indicator "the number of the employees dismissed for negative motives, including who were the staff of this territorial subdivision of law-enforcement body at the time of dismissal".

The maximum value by this criterion makes 25 points.

21. Assessment on indicator "the number of the employees condemned for making of corruption crime, including who were the staff of this territorial subdivision of law-enforcement body at the time of making of criminal offense" is calculated by the following formula:

                                                               P2 = 1000 * (and / b)

a - the number of the employees condemned for making of corruption crime, including who were the staff of this territorial subdivision of law-enforcement body at the time of making of criminal offense, except for the number of the employees condemned for making of corruption crime, revealed by law-enforcement body;

b - actual number of staff of territorial subdivision of law-enforcement body.

The maximum value on this indicator makes 15 points.

22. Assessment on indicator "the number of the employees who made ethical offense, including being the staff of this territorial subdivision of law-enforcement body at the time of making of offense" is calculated by the following formula:

                                                             P2 = 1000 * (and / b)

a - the number of the employees who made ethical offense, including being the staff of this territorial subdivision of law-enforcement body at the time of making of offense, except for the number of the employees who made ethical offense, revealed by law-enforcement body;

b - actual number of staff of territorial subdivision of law-enforcement body.

The maximum value on this indicator makes 6 points.

23. Assessment on indicator "the number of the employees dismissed for negative motives, including who were the staff of this territorial subdivision of law-enforcement body at the time of dismissal" is calculated by the following formula:

                                                                 P1 = 1000 * (and / b)

a - the number of the employees dismissed for negative motives, including who were the staff of this territorial subdivision of law-enforcement body at the time of dismissal, except for the number of the employees condemned for making of corruption crime, who made ethical offense;

b - actual number of staff of territorial subdivision of law-enforcement body.

The maximum value on this indicator makes 4 points.

5. Criterion "Professional training level"

24. Assessment by this criterion is carried out on the basis of information on the employees who are subject to assignment of qualification provided by territorial subdivisions of law-enforcement bodies and to which qualification in form, according to appendix 8 to this Technique and information on equipment of educational material resources of territorial subdivision of law-enforcement body on form, according to appendix 9 to this Technique is appropriated.

25. When evaluating on indicator "professional training level" the relevant data of reports of territorial subdivision of law-enforcement bodies on monitoring of condition of the personnel as of January 1 of the year following the accounting period provided in Personnel service annually are considered.

26. Assessment is calculated by the following formula:

                                                         K4 = P1 + P2

where K4 - assessment of territorial subdivision of law-enforcement body by this criterion;

P1 - indicator "assignment of cool qualification";

P2 - indicator "educational material resources of territorial subdivision of law-enforcement body".

The maximum value by this criterion makes 25 points.

27. Assessment on indicator "assignment of cool qualification" is calculated by the following formula:

                                                           P1 = k1 * a/b

k1 - coefficient for reduction of the received results to weight value (it is equal 16);

a - the number of employees of territorial subdivision of law-enforcement body, which following the results of delivery: testings on office preparation, offsettings on physical, including on fighting fight acceptance, and cool qualification is appropriated to fire preparation;

b - the number of the employees of territorial subdivision of law-enforcement body who are subject to assignment of cool qualification.

The maximum value on this indicator makes 16 points.

28. Assessment on indicator "educational material resources of territorial subdivision of law-enforcement body" is calculated by the following formula:

                                                              P2 = c + d + е

with - availability of sports construction;

d - availability of shooting shooting gallery;

е - availability of educational and methodical office.

In the presence of one of with, d, and е, to territorial subdivision of law-enforcement body increases to 3 points for everyone depending on equipment.
