About approval of Standard instructions for safety management of flights of operators of civil aircrafts, at the airports, when servicing air traffic, in case of maintenance of aircrafts, aviation training centers of civil aviation which activities are connected with accomplishment of flights of aircrafts during provision of services

According to the subitem 14) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft", I ORDER:

1. Approve enclosed:

1) Standard instruction for safety management of flights of operators of civil aircrafts;

2) the Standard instruction for safety management of flights at the airports;

3) the Standard instruction for safety management of flights when servicing air traffic;

4) the Standard instruction for safety management of flights in case of maintenance of aircrafts;

5) the Standard instruction for safety management of flights of aviation training centers of civil aviation which activities are connected with accomplishment of flights of aircrafts during provision of services.

2. In accordance with the established procedure to provide to committee of civil aviation of the Ministry of Transport and Communications of the Republic of Kazakhstan (Adimold R. O.) submission of this order to the Ministry of Justice of the Republic of Kazakhstan for state registration.

3. To impose control of execution of this order on the vice-Minister of Transport and Communications of the Republic of Kazakhstan Bekturov A. G.

4. This order becomes effective after ten calendar days after day of its first official publication.

About approval of the Standard instruction for safety management of flights of operators of civil aircrafts

Section 1. Introduction

Chapter 1. General provisions

1. This Standard instruction for safety management of flights of operators of civil aircrafts (further - the Standard instruction) is developed according to the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law), Appendix 19 to the Convention on international civil aviation (further - the Convention), the Program for safety of flights in the field of the civil aviation approved by the order of the Government of the Republic of Kazakhstan of March 11, 2016 No. 136, Doc of 9859 ICAO "The control directive safety of flights".

The standard instruction disaggregates requirements for implementation and maintenance of functioning of safety management system of flights (further - SUBP) the suppliers of servicing who are the operators of civil aircrafts performing the international commercial air transportations and the operators of heavy or turbojet airplanes of aircraft of general purpose allowed to accomplishment of the international flights (further - the supplier of servicing).

SUBP of the supplier of servicing considers the conceptual framework for implementation and maintenance of functioning of SUBP specified in Item 3 of Chapter 1 of this Standard instruction and also corresponds to scales of activities of the supplier of servicing and complexity of the aviation services provided to them.

Application of provisions of this Item does not interfere with operators of the civil aircrafts of aircraft of general purpose which are not allowed to accomplishment of the international flights to apply requirements of this Standard instruction.

2. The basic concepts used in this Standard instruction:

1) the first head of the organization of civil aviation (further - the first head) - the individual, identifiable official bearing the personal responsibility for efficient and effective functioning of SUBP of the supplier of servicing;

2) fair culture - the principle of safety of flights in case of which aviation personnel and other workers in the field of civil aviation report about mistakes or offenses and do not bear responsibility for the made mistakes or offenses in the field of civil aviation, except as specified, provided by the Law;

3) the aircraft - the device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from land (water) surface;

4) the interface - interaction as between internal structural divisions of the supplier of servicing, and with the external organizations with which it interacts by provision of the aviation services;

5) danger (dangerous factor) - condition or object which can cause aviation incident or aviation incident or promotes their origin;

6) the reacting method of detection of dangers (dangerous factors) - process during which the analysis of the results or events taking place in the past is performed. Dangers (dangerous factors) come to light in the course of investigation of the aviation incidents or incidents connected with safety of flights. Aviation incidents and (or) incidents are indicator of shortcomings of system and thanks to it can be used for determination of what dangers (dangerous factors) promoted event;

7) pro-active method of detection of dangers (dangerous factors) - process during which information collection and (or) data on safety of flights proceeding from events or processes with less serious effects, and also information analysis or the events this about frequency for the purpose of determination of possibility of development of dangers (dangerous factors) in aviation incident or incident is performed. Information on safety of flights for pro-active detection of dangers (dangerous factors) arrives mainly from programs of the analysis of flight information, systems of data presentation about safety of flights and actions for safety of flights;

8) aviation system of the supplier of servicing - set of elements such, as: any products, people, processes, procedures, objects, services and other aspects of the organization, including external factors which work together as parts of single process, and within SUBP are connected with activities of the supplier of servicing for safety of flights, and exert impact on these activities;

9) degree of gravity of risk (risk factors) - degree of harm which reasonably can be expected in the form of effects or results of the revealed dangers (dangerous factors);

10) safety of flights - the condition in case of which the risk of damnification of life or to human health or causing damage to property is reduced to acceptable level and is supported at this or lower level by means of continuous process of identification of sources of danger (dangerous factors) and risk control (risk factors);

11) the head of inspectorate for safety of flights (the head on safety of flights) - the official of the supplier of servicing responsible for implementation and effective functioning of SUBP.

12) information on safety of flights - the data on safety of flights processed, systematized or analyzed in specific context to make them suitable for the purposes of management the Name of position of the head of inspectorate for safety of flights (the head on safety of flights) depends on organizational structure of the supplier of servicing; safety of flights;

13) data on safety of flights - certain set of the facts or significant results concerning safety of flights and received from the different sources connected with aircraft which are used for maintenance or increase in level of safety of flights. Collection of such data on safety of flights is performed during the flights of actions of the pro-active or reacting nature connected with safety, including investigations of aviation incidents or incidents, the reporting in the field of safety of flights, data presentation about maintenance of the flight validity, monitoring of operational characteristics, inspections, checks, inspections, researches and reviews of security status of flights;

14) system of collection and data processing about safety of flights (further - SSODBP) - the system approach allowing to collect, to register and store data and information on safety of flights for the subsequent carrying out the analysis of the obtained data and information on safety of flights for the purpose of ensuring activities for performance management of safety of flights;

15) risk (risk factor) for safety of flights - expected probability and gravity of effects or results of danger (dangerous factor);

16) risk probability (risk factors) for safety of flights - possibility of unsafe event or result;

17) SUBP - system approach to safety management of flights, including necessary organizational structure, hierarchy of responsibility, obligation, the guidelines and procedures;

18) management on safety management system of flights (further - RUBP) - the document of the supplier of servicing describing the organization of safety management system of flights;

19) performance indicator of safety of flights (Safety Performance Indicator - SPI) - the parameter based on data used for monitoring and efficiency evaluation of safety of flights;

20) the target objective of efficiency of safety of flights (Safety Performance Target - SPT) - the target objective planned or assumed by the state or the supplier of servicing for performance indicator of safety of flights for the set period reflecting the purposes in area of safety of flights;

21) efficiency of safety of flights - the level of safety of flights reached by the state or the supplier of servicing determined by the target objectives of efficiency of safety of flights and performance indicators of safety of flights established by them;

22) the analysis of safety of flights - process of application of statistical or other analytical techniques for check, studying, descriptions, transformations, compression, estimates and visualization of data and information on safety of flights for the purpose of identification of useful information, formulation of the conclusions and support of the decision making process based on data.

3. Conceptual framework for implementation and maintenance of functioning of SUBP consists of four main components and twelve elements:

1) policy and purposes of safety of flights:

obligations of management;

hierarchy of responsibility and obligation in the field of safety of flights;

appointment of the leading experts responsible for safety of flights;

coordination of planning of actions on case of emergency environment;

documentation on SUBP;

2) risk management (risk factors) for safety of flights:

detection of dangers (dangerous factors);

assessment and reduction of risks (risk factors) for safety of flights;

3) safety of flights:

control and quantitative efficiency evaluation of safety of flights;

implementation of changes;

continuous improvement of SUBP;

4) promoting of safety issues of flights:

training and training;

exchange of information about safety of flights.

Chapter 2. Planning of implementation of SUBP

4. For the purpose of effective implementation and functioning of SUBP the first head of the supplier of servicing:

1) appoints the head of inspectorate for safety of flights (the head on safety of flights), responsible for implementation and effective functioning of SUBP of the supplier of servicing (further - the head of inspectorate for safety of flights (the head on safety of flights)). Depending on scales of activities of the supplier of servicing, complexity of the aviation services provided to them or in case of distribution of SUBP by the supplier of servicing the first head can appoint the group of persons responsible for implementation and functioning of SUBP of the supplier of servicing to several types of activity, at the same time one of them is appointed the head of inspectorate for safety of flights (the head on safety of flights) for the purpose of preserving direct and unambiguous hierarchy of accountability to the first head;

2) is provided by the description of aviation system of the supplier of servicing within which SUBP will take root and function;

3) is provided by forming of organizational structure of SUBP of the supplier of servicing for implementation and functioning of effective SUBP;

4) is provided by carrying out the analysis of shortcomings which are available in the existing safety management processes of flights of the supplier of servicing.

5. The description of aviation system of the supplier of servicing represents summary information on processes, activities and interfaces for management functions by safety of flights and the description of organizational structure of the supplier of servicing to which SUBP scope, and also the description of interaction both in own aviation system, and with other systems in the field of civil aviation extends.

The description of aviation system is subject to revision within processes of implementation of changes in case of entering of considerable or essential changes into the processes determined in the description of system of the supplier of servicing.

6. Before implementation of SUBP the supplier of servicing carries out the analysis of shortcomings which consists in comparison of the existing safety management processes of flights of the supplier of servicing with the requirements to SUBP established by the current legislation of the Republic of Kazakhstan.

The revealed shortcomings on analysis results are subject to elimination according to the plan of implementation of SUBP which determines necessary actions for implementation of completely functional and effective SUBP of the supplier of servicing.

Based on analysis results of shortcomings the appointed head of inspectorate for safety of flights (the head on safety of flights) or the group of persons responsible for implementation and functioning of SUBP of the supplier of servicing develops and informs concerned parties the plan of implementation of SUBP taking into account the revealed shortcomings which interfere with implementation of SUBP.

7. Implementation of SUBP of the supplier of servicing is performed according to the plan of implementation of SUBP developed according to requirements of this Standard instruction, standards and recommended practice of International Civil Aviation Organization (further - ICAO), and also the plan for safety of flights of the Republic of Kazakhstan. The plan of implementation of SUBP affirms the first head of the supplier of servicing.

8. The plan of implementation of SUBP includes:

1) the description of actions for remedial action which are available in the existing safety management processes of flights of the supplier of servicing;

2) description of the actions necessary for implementation of SUBP;

3) terms of accomplishment of the actions specified in subitems 1) and 2) of this Item;

4) information on the one who is actionee of the action determined by the plan;

5) the description of result in case of which it is considered that certain operation is performed successfully.

The plan of implementation of SUBP includes the description of actions for coordination with the external organizations or contractors.

The appointed head of inspectorate for safety of flights (the head on safety of flights) or the group of persons responsible for implementation and functioning of SUBP of the supplier of servicing performs monitoring of accomplishment of the actions provided by the plan of implementation of SUBP and staticizes it.

9. The results received on completion of works on planning of implementation of SUBP:

1) the document containing the plan of implementation of SUBP;

2) bringing to data of all employees of the plan of implementation of SUBP;

3) the complete description of aviation system of the supplier of servicing within which SUBP will take root and function;

4) the complete analysis of shortcomings which are available in the existing safety management processes of flights of the supplier of servicing;

5) creation of organizational structure of SUBP;

6) approval of RUBP approved with authorized organization in the field of civil aviation;

7) creation of means and determination of methods of distribution of information on safety issues of flights.

10. The supplier of servicing depending on policy in the field of safety of flights, scales of activities and complexity of the aviation services provided to them makes the decision on combining SUBP, management systems of quality and other systems of management (quality management system, system of aviation safety, system of labor and environmental protection) in single function of management on safety of flights, service quality and other processes (the integrated system of management) for the purpose of resource optimization and implementation of the structured approach for providing that all processes and procedures functioned properly. At the same time in SUBP and in quality management system certain heads for the purpose of preserving direct and unambiguous hierarchy of accountability to the first head are appointed.

Section 2. Policy and purposes of safety of flights

Chapter 3. Obligations of management

11. The supplier of servicing determines the policy in the field of safety of flights which:

1) is reflected by the obligation of the supplier of servicing on safety of flights, including permanent increase in level of efficiency of safety of flights, provision of guarantees that safety of flights is first-priority obligation of all heads, assistance to forming and maintenance of positive culture of safety of flights, observance of all applicable normative legal requirements concerning safety of flights;

The accurate statement for provision of the resources necessary for realization of policy in the field of safety of flights contains 2);

3) contains data on system of data presentation and information on safety of flights;

Accurately specifies 4) what types of behavior of personnel when implementing by the supplier of servicing of aviation activities are inadmissible, and also circumstances under which disciplinary actions for the purpose of development of fair culture will not be taken;

5) it is signed by the first head of the supplier of servicing;

6) is brought to the attention of all personnel of the organization and it is available to all personnel for the purpose of providing at all organizational levels of understanding, implementation and observance of policy in the field of safety of flights;

7) it is reviewed regarding preserving relevance and compliance of activities of the supplier of servicing. Terms of review of policy in the field of safety of flights are determined by the supplier of servicing and are specified in RUBP.

12. The supplier of servicing, considering policy provisions in the field of safety of flights, determines the purposes of safety of flights which:

1) create basis for monitoring of efficiency of safety of flights, and also monitoring of process of achievement of particular purposes by establishment of SPI and SPT;

2) reflect the obligation of the supplier of servicing on maintenance or permanent increase in overall effectiveness of SUBP;

3) are brought to the attention of all employees of the supplier of servicing;

4) are reviewed regarding preserving relevance and compliance of activities of the supplier of servicing.

The purposes of safety of flights determine intentions of the supplier of servicing in the field of safety of flights and join in policy in the field of safety of flights or are drawn up by the separate document.

Chapter 4. Hierarchy of responsibility, obligation and appointment of the leading experts responsible for safety of flights

13. Forming of organizational structure of SUBP of the supplier of servicing includes the following actions:

1) determination of the first head who irrespective of other functions which are carried out by it bears the personal responsibility for the organization of safety of flights on behalf of the organization, implementation, and also for efficient and effective functioning of SUBP of the supplier of servicing;

2) creation of coordinating body - council on safety of flights (Safety Review Board - SRB) - under the leadership of the first head of the supplier of servicing and creation of group on safety of flights (Safety Action Group - SAG) - under the leadership of the appointed head of inspectorate for safety of flights (the head on safety of flights). The supplier of servicing ensures functioning of SRB and SAG consisting of number of persons employed;

3) appointment of the head of inspectorate for safety of flights (the head on safety of flights). Depending on the size, nature and complexity of the organization the supplier of servicing based on requirement creates permanent structural division for ensuring continuous operational work on safety of flights in the form of inspection, service, department (office) or department;

4) establishment of accurate hierarchy of responsibility in all organization, including direct responsibility of the heads participating in safety of flights;

5) determination of obligations of all heads, irrespective of other functions which are carried out by them, and also employees concerning efficiency of SUBP of the supplier of servicing in the field of safety of flights;

6) establishment of order of interaction between governing bodies of SUBP, structural divisions and the first head;

7) documentary registration of hierarchy of responsibility, obligations and powers in the field of safety of flights and finishing them to data of all staff of the organization;

8) determination of level of the heads having powers to make decisions concerning admissibility of risk (risk factors) for safety of flights.

14. Functions of the first head concerning safety of flights include:

1) providing financial resources and personnel appointments for proper implementation and functioning of effective SUBP;

2) assistance to forming of positive culture of safety of flights;

3) input of policy in the field of safety of flights of the supplier of servicing and its promoting;

4) establishment of SPI and SPT of the supplier of servicing;

5) ensuring proper implementation SUBP and compliance of performance indicators of safety of flights to the requirements established by this Standard instruction;

6) ensuring continuous improvement of SUBP;

7) is headed by council on safety of flights (SRB) and makes decisions on safety of flights.

15. Council on safety of flights (SRB) carries out strategic role, dealing with the main issues of policy, resource allocation and efficiency of organization activity in the field of safety of flights. Council on safety of flights (SRB) includes the first head and heads who are directly accountable to the first head, and the head of inspectorate for safety of flights (the head on safety of flights) acts as the adviser (secretary).

Council on safety of flights (SRB) performs monitoring:

1) efficiency of SUBP;

2) timely reaction in case of implementation of necessary control measures of risks (risk factors) for safety of flights;

3) compliance of performance indicators of safety of flights to policy and the purposes of the organization in the field of safety of flights;

4) overall effectiveness of the measures directed to control and (or) reduction of risks (risk factors) for safety of flights;

5) process performances of the organization for safety management of flights which assist respect for the declared first priority of tasks on safety management of flights, and also promoting of questions of safety of flights in all organization.

16. The group on safety of flights (SAG) is tactical body and deals with the specific questions directed to realization of the strategic objectives set by council on safety of flights (SRB). Heads and representatives from among non-management employees which work is closely connected with production questions enter into group on safety of flights (SAG).

The group on safety of flights (SAG) performs the following functions:

1) monitors safety on production in areas of functional organization activity and provides proper activities within risk management (risk factors) for safety of flights;

2) analyzes the available data on safety of flights and it is convinced of realization of the corresponding strategic control measures of risks (risk factors) for safety of flights;

3) is estimated by impact of production changes or introduction of new technologies on safety of flights;

4) coordinates implementation of measures, the risks (risk factors) connected with control facilities for safety of flights, and provide immediate taking measures;

5) is analyzed by efficiency of specific control facilities of risks (risk factors) for safety of flights.

17. The head of inspectorate for safety of flights (the head on safety of flights) advises the first head and heads participating in safety of flights concerning safety management of flights, is responsible for implementation and effective functioning of SUBP of the supplier of servicing and for coordination of safety issues of flights and exchange of information about such questions among the staff of the organization and members of aviation community who are not belonging to it with which it interacts by provision of the aviation services. Functions of the head of inspectorate for safety of flights (the head on safety of flights) including include:

1) management of the plan of implementation of SUBP on behalf of the first head;

2) detection of dangers (dangerous factors) and risks assessment (risk factors) for safety of flights and assistance to these procedures;

3) control over implementation adjusting action - the supplier of servicing and assessment of their results;

4) periodic submission of reports to the first head about efficiency of safety of flights in the organization;

5) maintaining accounting records and documentation of SUBP;

6) planning and organization of training of employees of the supplier of servicing for safety of flights;

7) consultation provision - concerning safety of flights to the staff of the organization;

8) monitoring of problems of the flights connected with safety and their possible influence on the activities of the supplier of servicing connected with provision of the aviation services;

9) coordination of safety issues of flights on behalf of the first head with authorized body and authorized organization in the field of civil aviation, and also with other state authorities.

18. The supplier of servicing determines powers, responsibility and obligations of all personnel, including the management participating performed by function - in the field of safety of flights.

All powers, responsibility and obligations in the field of safety of flights are stated in documentation on SUBP of the supplier of servicing and are brought to the attention of all staff of the organization.

Responsibility of each head participating in safety, safety of flights and its obligation in this sphere are integral part of its job description.

19. The supplier of servicing is responsible for efficiency of safety of flights by the external organizations when the external organizations provide products and (or) services to the supplier of servicing for the purpose of maintenance of its activities.

SUBP of the supplier of servicing has interfaces with systems of safety of flights of any external the organizations, its aviation services promoting safe provision.

Chapter 5. Coordination of planning of actions on case of emergency environment

20. The supplier of servicing develops, claims and maintains relevance of the actions plan on case of the emergency environment (Emergency Response Plan - ERP) caused by the aviation incident or incident, emergency connected with operation of aircrafts, or other emergency situation, crisis or event in aircraft which require immediate actions.

The supplier of servicing provides proper coordination of the ERP with the external organizations with which it interacts by provision of the aviation services.

21. ERP of the supplier of servicing corresponds to scales of activities of the supplier of servicing and complexity of the aviation services provided to them.

ERP describes actions which will be taken during limited period of time in case of approach of emergency environment.

22. ERP is the integral component of risk management process (risk factors) of the supplier of servicing intended for taking measures in case of approach of emergency environment.

Scenarios in case of which violation of aviation activities of the supplier of servicing because of such emergencies as emergency situation in the field of public health care is probable including pandemic, are also properly considered in ERP.

Predictable emergencies which possibility comes to light within SUBP are provided in ERP.

23. The main objective of ERP consists in safe continuation of activities and in renewal of normal activities in the greatest possible short terms.

ERP provides the arranged and effective transition from normal to emergency activities and vice versa.

ERP shall be available to the relevant employees responsible for ERP realization, and also to the external organizations with which interaction is performed.

24. ERP includes:

1) distribution of obligations between employees of the supplier of servicing on case of emergency environment and authority delegation;

2) contact information for bystry communication with the relevant employees;

3) the period of time necessary for renewal of normal activities after approach of emergency environment;

4) the description of actions, and also actions of responsibles in case of emergency environment;

5) the description of interaction with the external organizations with which the supplier of servicing interacts by provision of the aviation services;

6) the description of interaction with the external organizations, such as emergency services which are not connected with aircraft.

25. The provided ERP of action on case of emergency environment are fulfilled by the supplier of servicing within the staged drills.

Types of doctrines and their frequency are determined by the supplier of servicing.

Conducting exercises allows to reveal shortcomings of ERP which can be eliminated before there comes the real emergency environment.

In case of identification of shortcomings of ERP by results of doctrines necessary actions for their immediate elimination and review of ERP are taken.

Chapter 6. Documentation on SUBP

26. Documentation on SUBP of the supplier of servicing includes:

1) RUBP;

2) the description of aviation system in which SUBP scope is designated;

3) register of dangers (dangerous factors) and reports on dangers (dangerous factors) and safety of flights;

4) SPI and related charts (matrixes);

5) accounting of complete risks assessments (risk factors) for safety of flights;

6) accounting of reviews of SUBP;

7) accounting of internal checks of SUBP;

8) accounting of activities for training of personnel concerning SUBP and safety of flights;

9) protocols of meetings of SRB and SAG;

10) actions for risk management (risk factors) and (or) on safety of flights;

11) the reporting under the internal investigations made by the supplier of servicing in the field of safety of flights;

12) the plan of implementation of SUBP (during initial implementation) or the plan of enhancement of SUBP (after initial implementation);

13) the analysis of shortcomings in support of the plan of implementation of SUBP.

Documentation on SUBP is constituted so that the description of activities for safety management of flights stated in it was clear to all employees of the supplier of servicing.

Documentation on SUBP is timely updated and stored with observance of the storage durations of documents established by the supplier of servicing within SUBP.

Documentation on SUBP is drawn up by separate documents or combines with other documents of the supplier of servicing. If in the existing documents provisions SUBP of the supplier of servicing are in detail stated, then the corresponding references to such documents are specified.

27. RUBP of the supplier of servicing is the main instrument of exchange of information on safety of flights between the supplier of servicing and the main concerned parties in the field of safety of flights.

RUBP also serves for submission of information on conceptual framework of SUBP both employees of the supplier of servicing, and the relevant external organizations.

For acceptance of RUBP as the official document the supplier of servicing sends RUBP for approval in authorized organization in the field of civil aviation. At the same time the supplier of servicing bears complete responsibility for quality and completeness of RUBP developed by it, and the personnel of the supplier of servicing examine and guided by RUBP.

Approval of RUBP of the supplier of servicing by authorized organization in the field of civil aviation is performed in the terms established according to the Administrative procedural Procedure Code of the Republic of Kazakhstan.

28. RUBP of the supplier of servicing contains:

1) statement of policy and purposes in the field of safety of flights;

2) requirements to SUBP, and also references to the existing normative legal requirements to SUBP;

3) the description of aviation system in which SUBP scope is determined;
