About approval of Rules of inclusion of projects in the card of industrialization and the card of support of entrepreneurship of regions

According to article 98 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of inclusion of projects in the card of industrialization and the card of support of entrepreneurship of regions.

2. Recognize to invalid:

1) the order of the Government of the Republic of Kazakhstan of May 25, 2012 No. 675 "About approval of Rules of inclusion of projects in republican and regional cards of industrialization" (SAPP of the Republic of Kazakhstan, 2012, No. 52, the Art. 707);

2) the order of the Government of the Republic of Kazakhstan of October 9, 2014 No. 1073 "About modification and amendments in the order of the Government of the Republic of Kazakhstan of May 25, 2012 No. 675 "About approval of Rules of inclusion of projects in republican and regional cards of industrialization" (SAPP of the Republic of Kazakhstan, 2014, No. 61, the Art. 575).

3. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of inclusion of projects in the card of industrialization and card of support of entrepreneurship of regions

1. General provisions

1. These rules of inclusion of projects in the card of industrialization and the card of support of entrepreneurship of regions (further – Rules) determine procedure for inclusion of projects in the card of industrialization and the card of support of entrepreneurship of regions.

2. In Rules the following basic concepts are used:

1) the industrial and innovative project – complex of the actions directed to transfer of technologies, creation of the new or advanced productions, technologies, goods, works and services realized during certain term of time (further – the project);

2) the card of industrialization is the instrument of monitoring (realization) of industrial and innovative system at the level of the republic and represents set of the industrial and innovative projects realized by subjects of industrial and innovative activities;

3) the card of support of entrepreneurship of the region is the instrument of monitoring (realization) of industrial and innovative system at the level of the region and represents set of the industrial and innovative projects realized by subjects of industrial and innovative activities;

4) the applicant – the physical/legal entity enabling planning and project implementation;

5) regional coordination council - the advisory advisory body created and at least 50% of total number headed by akims of areas, Nour-Sultan's cities, Almaty and Shymkent with participation of representatives of business community (further - council);

6) the industry commission on consideration of projects – the advisory advisory body created by the order of the head of the relevant industry state body of number of persons employed of state body and members of the business associations under approval representing the corresponding industry, considering projects, pretenduyemy for inclusion in the card of industrialization on specific industries (further – the industry commission);

7) authorized body - the central executive body performing management in the field of industrial development and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination and participation in realization of the state support of industrial and innovative activities;

8) the headquarters concerning the card of industrialization – the commission under authorized body concerning consideration of projects for inclusion in the map of industrialization with participation of heads of the interested industry commissions on consideration of projects, the staff of authorized body, the industry ministries and departments, national holdings and institutes of development, and also other interested organizations (further – the headquarters);

9) the commission on industrial development of the Republic of Kazakhstan - the advisory advisory body under authorized body formed for the purpose of development of recommendations and offers in the field of industrial development of the Republic of Kazakhstan (further - the commission);

10) local authorized body – the executive body of area (the city of republican value, the capital) performing functions of development, coordination, regulation and management in the field of entrepreneurship and the industry, participating in forming and realization of state policy in the field of the state support of industrial and innovative activities in the corresponding territory;

11) industry central executive body – the central executive body performing management of the corresponding industry (sphere) of public administration and also in limits, stipulated by the legislation, cross-industry coordination;

12) responsible state body – the state body responsible for project implementation;

13) regional chamber of entrepreneurs – the chamber of entrepreneurs of area, city of republican value and the capital which is a part of the system of National chamber of entrepreneurs of the Republic of Kazakhstan at the territorial level (further – regional chamber).

2. Procedure for inclusion of projects in the card of industrialization and card of support of entrepreneurship of regions

3. Inclusion of projects in the card of industrialization is made step by step:

1) the first stage – consideration of projects at the local level;

2) the second stage – consideration of projects at the central level;

3) the third stage – consideration of projects in authorized body;

4) the fourth stage – consideration of projects on the commission.

4. Inclusion of projects in the card of support of entrepreneurship of the region is made step by step:

1) the first stage – consideration of projects at the local level;

2) the second stage – consideration of projects at the central level on industry accessory without consideration on the industry commission.

5. Projects:

1) cost to 4, 5 billion tenges join in the card of support of entrepreneurship of the region;

2) 5 billion tenges are recommended by cost from 4, in the card of industrialization;

3) not requiring measures of the state support, do not join in the card of industrialization and cards of support of entrepreneurship of regions.

6. Selection of projects in the card of industrialization and cards of support of entrepreneurship of regions is performed according to priorities of the State program of industrial and innovative development of the Republic of Kazakhstan for 2020 - 2025 approved by the order of the Government of the Republic of Kazakhstan of December 31, 2019 No. 1050 (further - the Program).

7. The authorized body, other state bodies, and also local executive bodies of areas, cities of republican value, the capital by consideration, approval and provision of measures of the state support to subjects of industrial and innovative activities shall be guided by one of the following criteria:

1) innovation – orientation on increase in cost efficiency of activities by creation of new or advanced productions, technologies, goods, works and services taking into account providing ecological safety;

2) competitiveness - the benefit in comparison with similar industrial and innovative projects which is expressed in low cost of products, the rendered works and (or) the provided services, their demand and economic feasibility of their production, rendering or provision;

3) scale – the importance of implementation of the industrial and innovative project for industrial and innovative development of the Republic of Kazakhstan;

4) labor productivity - the production performance indicator characterizing the production counting on unit of the used resources representing ratio of production volume and costs of manpower;

5) exportooriyentirovannost - production orientation for export of products and services.

8. Drafts of the map of industrialization and cards of support of entrepreneurship of regions are selected taking into account the General scheme of the organization of the territory of the Republic of Kazakhstan.

9. Order taking is performed by local authorized body on permanent basis.

10. The applicant for inclusion of the project in the card of industrialization or the card of support of entrepreneurship represents purposely to local authorized body of the respective region the following documents on electronic and paper carriers:

1) the request in form according to appendix 1 to these rules;

2) the passport copy of the project approved by the applicant in form according to appendix 2 to these rules;

3) the copy of the scheduled plan of project implementation approved by the applicant in form according to appendix 3 to these rules;

4) copies of the documents confirming study of financing of the project (the memorandum and the agreement of intent and/or the decision on financing of the project);

5) project information in form, according to appendix 4 to these rules, for projects worth from 900 million tenges;

6) the slide presentation on 1 page which contains the following data: name of the project; project objective; applicant; place of realization; realization period; total cost of the project; structure of financing; the expected results; creation of workplaces for construction and operation;
