About approval of Rules of forming and maintaining the card of energy efficiency, selection and inclusion of projects in the card of energy efficiency

According to Item 17-2) of article 5 of the Law of the Republic of Kazakhstan of January 13, 2012 "About energy saving and increases in energy efficiency" I ORDER:

1. Approve Rules of forming and maintaining the card of energy efficiency, selection and inclusion of projects in the card of energy efficiency.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication and extends to the relations which arose since January 1, 2016.

Rules of forming and maintaining card of energy efficiency, selection and inclusion of projects in the card of energy efficiency

Chapter 1. General provisions

1. These rules of forming and maintaining the card of energy efficiency, selection and inclusion of projects in the card of energy efficiency (further - Rules) are developed according to subitem 17-2) of article 5 of the Law of the Republic of Kazakhstan of January 13, 2012 "About energy saving and increase in energy efficiency" (further - the Law) and determine procedure for forming and maintaining the card of energy efficiency, selection and inclusion of projects in the card of energy efficiency.

2. In these rules the following basic concepts are used:

1) the State energy register - the systematized code of information on subjects of the State energy register;

2) subjects of the State energy register are the individual entrepreneurs and legal entities consuming energy resources in amount, equivalent one thousand five hundred and more tons of conditional fuel a year and also public institutions, subjects of the quasi-public sector and natural monopolies;

3) the contractor – the legal entity who is carrying out complex of the actions directed to energy saving and increase in energy efficiency;

4) the applicant – the physical person or legal entity which provided the project for inclusion in the card of energy efficiency;

5) examination – process of assessment and the analysis provided by the Applicant of documents regarding compliance to the established criteria in the field of energy saving and increase in energy efficiency;

6) energy efficiency (further – energy efficiency) – the quantitative relation of amount of the provided services, works, the turned-out products (goods) or the made energy resources to the initial energy resources spent for it

7) the card of energy efficiency – the single republican list of projects in the field of energy saving and increase in energy efficiency with indication of sources of financing, schedules and actions plans on their realization;

8) the project in the field of energy saving and increase in energy efficiency (further – the project) – complex of the actions directed to energy saving and increase in energy efficiency, realized during the certain period of time;

9) national institute of development in the field of energy saving and increase in energy efficiency – the legal entity, fifty and more percent of voting shares (shares in the authorized capital) which belong to the state.

Chapter 2. Procedure for forming and maintaining card of energy efficiency

3. The national institute of development in the field of energy saving and increase in energy efficiency (further - NIREE) creates and keeps the card of energy efficiency, performs selection and inclusion of projects in the card of energy efficiency.

4. The map of energy efficiency is created and kept in form, according to appendix 1 to these rules.

5. Consideration, selection and inclusion of projects in the card of energy efficiency is performed by NIREE on permanent basis.

6. NIREE requests and obtains information necessary for forming and maintaining the card of energy efficiency from subjects of the State energy register (further - GER) and other legal entities.

7. The card of energy efficiency is placed on the NIREE Internet resource.

Chapter 3. Procedure for consideration, selection and inclusion of projects in card of energy efficiency

8. NIREE based on information analysis on forming and maintaining GER and other information recommends to subjects of GER and other legal entities to file documents for inclusion of the project in the card of energy efficiency.

9. The applicant for inclusion of the project in the card of energy efficiency submits to NIREE on the electronic medium the following documents:

1) the statement according to appendix 2 to these rules;

2) the passport of the project approved by the head of the organization or person replacing it according to appendix 3 to these rules;

3) copies of the documents confirming study of financing of the project (memorandums and agreements of intent and (or) decisions on financing of the project) (in the presence);

4) the copy of the conclusion on energy saving and increase in energy efficiency (in the presence);

5) copies of the documents confirming reliability of calculations of required investments and economy to the provided actions (the feasibility statement, financial and economic reasons, commercial offers) (in the presence).

10. NIREE considers the submitted documents within 5 (five) working days from the date of revenues to completeness and accuracy of the information.

In case of factual determination of incompleteness and (or) unauthenticity of information, NIREE in the specified terms returns documents of the Applicant with indication of return reasons.

The applicant after obtaining from NIREE of documents, removes return reasons and repeatedly brings in NIREE.

11. In case of compliance of documents to the established requirements, the project is registered in the Magazine of registration for inclusion of projects in the card of energy efficiency which is kept in form according to appendix of 4 these rules.

12. NIREE within 30 (thirty) working days from the date of registration of the project in the magazine of registration carries out expertize regarding compliance to criteria of innovation, scale and competence.

13. Examination is performed on the following structure:

1) effect of energy saving in natural and monetary value;

2) innovative component of the project;

3) payback period;

4) consideration on need of compliance of actions to requirements of the current legislation of the Republic of Kazakhstan, to national standards of the Republic of Kazakhstan, construction regulations and rules of the Republic of Kazakhstan, construction regulations of the Republic of Kazakhstan;

5) general conclusions and recommendations about the project.

Experimental testimony signed by the first head of NIREE, or replacement his face is result of examination.

14. Experimental testimony is drawn up in duplicate and within 2 (two) working days from the moment of its carrying out one copy goes to the Applicant, one copy remains in NIREE.

15. By results of examination, NIREE on the recommended projects for inclusion in the card of energy efficiency accepts one of the following decisions:

1) in the presence of financing sources the project joins in the card of energy efficiency;

2) in the absence of sources of financing the investment attraction issue by search of domestic and international investors, financial institutions, power service companies and other organizations is handled.

16. Projects are excluded from the card of energy efficiency by the solution of NIREE in case of non-execution by the applicant of the actions specified in the passport of the project.
