About approval of Provisional regulations for procedure and conditions of implementation of compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Kyrgyz Republic
For the purpose of implementation of article 8 of the Law of the Kyrgyz Republic "About medical insurance of citizens in the Kyrgyz Republic" for implementation of compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Kyrgyz Republic, and also their access to the medical services provided by the organizations of health care, working in system of the Single payer by acquisition of the policy of compulsory medical insurance within the Program of the State Guarantees (PSG) I order:
1. Approve the enclosed Provisional regulations for procedure and conditions of implementation of compulsory medical insurance of the foreign citizens and persons without citizenship who are temporarily staying or temporarily living in the Kyrgyz Republic.
2. To heads of the organizations of health care and territorial administrations of compulsory health insurance Fund under the Government of the Kyrgyz Republic in case of compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Kyrgyz Republic strictly to be guided by these Provisional regulations.
3. Declare invalid the order of Fund of compulsory medical insurance under the Government of the Kyrgyz Republic of November 3, 2015 No. 274 "About approval of Provisional regulations for procedure and conditions of implementation of compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Kyrgyz Republic".
4. To impose control of execution of this order on the deputy minister of health care of the Kyrgyz Republic A.Dzh. Murzaliyev and first deputy chairman of Fund of compulsory medical insurance under the Government of the Kyrgyz Republic A. S. Imanbayev.

1. These Provisional regulations are developed according to the Laws of the Kyrgyz Republic "About medical insurance of citizens in the Kyrgyz Republic", "About protection of public health in the Kyrgyz Republic", "About system of the Single payer in financing of health care of the Kyrgyz Republic", "About the organizations of health care in the Kyrgyz Republic", the orders of the Government of the Kyrgyz Republic of February 20, 2012 No. 133 "Regulations on Fonda of compulsory medical insurance under the Government of the Kyrgyz Republic", of February 28, 2012 No. 151 "About approval of the Regulations on the policy of compulsory medical insurance", the Program of the state guarantees for providing citizens in the Kyrgyz Republic the medical and sanitary help approved by the Government of the Kyrgyz Republic.
2. This provision regulates procedure of compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Kyrgyz Republic (further - foreign citizens).
3. For the purposes of compulsory medical insurance of foreign citizens, the following main terms and their determinations are applied:
fees on medical insurance - insurance payments on obligatory or to voluntary medical insurance, paid to the insurer;
insured person - person concerning whom fees on medical insurance to the insurer arrived;
compulsory medical insurance - the state form of social protection aimed at providing the rights of citizens in the Kyrgyz Republic in the field of health protection;
the organizations of health care - the organizations giving medical and sanitary help to citizens in the Kyrgyz Republic irrespective of forms of business, departmental accessory and forms of their property;
the policy of compulsory medical insurance - the document issued by compulsory health insurance Fund, granting the right to medical services in implementable state programs in system of compulsory medical insurance and the status of zastrakhovannost;
The program of the state guarantees are the guaranteed amounts, types and conditions of provision of the medical and sanitary help to citizens in the Kyrgyz Republic which provide realization of the rights of citizens in the Kyrgyz Republic on receipt of the medical and sanitary help in the organizations of health care, irrespective of the patterns of ownership participating in this program according to the legislation of the Kyrgyz Republic;
the insurer - the legal entity performing insurance activity in the field of medical insurance;
insurer - the physical person or legal entity making contribution payment on medical insurance;
insurance term - the period of stay of the foreign citizen in the Kyrgyz Republic for which the policy of compulsory medical insurance is acquired;
Fund of compulsory medical insurance under the Government of the Kyrgyz Republic - authorized state body of the Kyrgyz Republic in the field of compulsory medical insurance.
4. Insured event disorder of health of the insured person which came during action of the policy of compulsory medical insurance that demanded delivery of health care is recognized and entailed costs of the organizations of health care.
5. Foreign citizens, except for persons specified in Item 7 of this provision, not having the agreement of medical insurance signed with the insurer shall make payment of insurance premiums on compulsory medical insurance (for stay in the territory of the Kyrgyz Republic).
Payment of insurance premiums on compulsory medical insurance is made in Fund of compulsory medical insurance, its territorial administrations and in the Centers of family medicine or electronic payment system through system the Internet (E-PAY).
6. If necessary, foreign citizens for receipt of the policy of compulsory medical insurance address to territorial administrations of Fund of compulsory medical insurance or to the organizations of health care of primary level.
The procedure for acquisition of the policy of compulsory health insurance is determined by the Government of the Kyrgyz Republic.
7. The foreign citizens who arrived to the Kyrgyz Republic for receipt of medical services within the program of the state guarantees in the organizations of health care working in system of the Single payer show the policy of compulsory medical insurance.
8. Are not subject to compulsory medical insurance:
- Heads of States and Governments of foreign states, heads and members of parliamentary, government and other official delegations, technicians of these delegations and foreign citizens who arrived to the Kyrgyz Republic by the invitation of the President of the Kyrgyz Republic, Jogorku Kenesh of the Kyrgyz Republic, the Government of the Kyrgyz Republic and also members of their families;
- the staff of the United Nations and its special facilities documented by travel documents of the United Nations;
- heads and staff of diplomatic representations and consular establishments, employees of the device of military attaches, trade missions of foreign states, and also members of their families;
- heads and the staff of representations, bodies of the international organizations and interstate educations which according to statutory documents of these organizations and educations or the corresponding international treaties of the Kyrgyz Republic use privileges and immunities, and also members of their families;
- persons which are part of crews of air civil courts of the international airlines and the motor transportation message, crews of trains of the international message;
- the members of crews of foreign military airplanes, the military personnel of foreign states who arrived to the Kyrgyz Republic for participation in joint military exercises;
- persons arriving to the Kyrgyz Republic for the purpose of implementation of boundary representative activities;
- the foreign citizens petitioning for provision of the status of the refugee by it or additional protection in the Kyrgyz Republic;
- the foreign citizens following en route through the territory of the Kyrgyz Republic by trains and autotransports of the international message, air civil courts of the international airlines.
9. The legal entities of the Kyrgyz Republic, citizens of the Kyrgyz Republic, foreign citizens who are legally staying in the Kyrgyz Republic, inviting foreign citizens to the Kyrgyz Republic having the right to acquire policies of compulsory medical insurance for benefit of foreign citizens.
10. Payment of insurance premiums for compulsory medical insurance is made one-timely for all term of insurance by cash in som either in freely convertible currency, or in non-cash form in the form of bank transfer, and also with use of bank payment card according to the legislation of the Kyrgyz Republic on the settlement account of compulsory health insurance Fund.
11. The term of insurance is established for temporary stay or temporary residence of the foreign citizen in the Kyrgyz Republic and it is specified in the document, confirming payment of insurance premiums on medical insurance and in the policy of compulsory medical insurance.
Action of the policy of compulsory medical insurance comes from the moment of payment of insurance premium.
12. Insured person in the presence of the policy of compulsory health insurance has the right:
- obtain information on amounts and types of medical care;
- require provision of medical care according to the Program of the state guarantees;
- report to the insurer about cases of failure to provide medical care or rendering incomplete or low-quality such help;
- require compensation of the damage caused to health because of the supplier of medical and other services, according to the procedure, established by the legislation of the Kyrgyz Republic.
13. To insured person in the presence of the agreement on voluntary medical insurance, medical care is provided in accordance with the terms and amounts of this agreement.
14. Insured person in case of the appeal to the organization of health care behind provision of medical care shall show the document confirming payment of insurance premiums on compulsory medical insurance or the policy of compulsory medical insurance.
15. Medical care to insured person is the organizations of health care, irrespective of patterns of ownership, signed the contract with Fund of compulsory medical insurance.
16. Rendering medical care to insured person is performed based on the document confirming payment of insurance premiums on compulsory medical insurance or the policy of compulsory medical insurance and verification of the status of zastrakhovannost.
17. Control of availability at the foreign citizens and persons without citizenship which are temporarily staying or temporarily living in the Kyrgyz Republic, the documents confirming medical insurance is assigned to Fund of compulsory medical insurance under the Government of the Kyrgyz Republic.
