About approval of Veterinary sanitary standard about establishment of measures for control and fight against certain forms of transmissible gubkoobrazny encephalopathies at animals

According to provisions of article 1 of the Law No. 306/2018 on safety of foodstuff (The official monitor of the Republic of Moldova, 2019, Art. No. 59-65, 120), with subsequent changes, and article 29 of the Law No. 221-XVI of October 19, 2007 on veterinary and sanitary activities (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 125-129, 396), with subsequent changes and amendments, and also for the purpose of improvement of quality of the provided veterinary and sanitary services Government DECIDES:

1. Approve Veterinary sanitary standard about establishment of measures for control and fight against certain forms of transmissible gubkoobrazny encephalopathies at animals, according to appendix No. 1.

2. Recognize invalid some orders of the Government, according to appendix No. 2.

3. To impose control of execution of this resolution on the National agency on safety of foodstuff.

Veterinary sanitary standard about establishment of measures for control and fight against certain forms of transmissible gubkoobrazny encephalopathies at animals

This regulation shifts provisions of Regulations of the EU No. 999/2001 of the European Parliament and the Council of the European Union of the May 22, 2001 establishing the rule on prevention, control and eradication of some forms of transmissible gubkoobrazny encephalopathies published in the Official magazine of the European Union, the L147 series of May 31, 2001, page 1-40, with subsequent changes.

I. General provisions

1. The veterinary sanitary standard about establishment of measures for control and fight against certain forms of transmissible gubkoobrazny encephalopathies at animals (further - the Regulation) establishes provisions in the field of the prevention, control and eradication of transmissible gubkoobrazny encephalopathies (further - TGE) at live animals and in animal products.

2. The this Regulation is not applied to:

1) to the medical or cosmetic products, medical devices, raw materials or intermediate products received from it;

2) to products, not held for use as food, forages, fertilizers, and also to raw materials and intermediate products from it;

3) to the animal products intended for exhibitions, for the educational purposes, scientific research, specific researches or analyses provided that these products in resulting effect will not be used by people and animals or to be used in other purposes;

4) the live animal used for researches or intended for researches.

In order to avoid infection or substitution of live animals and animal products with the products provided in subitems 1) of this Item they shall be stored constantly separately, except for case when the corresponding live animals or animal products are made at least in the same conditions of protection of health from the point of view of the TGE forms.

3. In understanding of this Regulation the used concepts have the following value:

transmissible gubkoobrazny encephalopathies – the degenerative diseases of the central nervous system transmitted both to the person, and animals, caused by conditional transmissible agents - the prions which are characterized by nervous signs, the long incubatory period, slow development and lethal outcome;

forms of transmissible gubkoobrazny encephalopathies – all TGE forms, except for the forms appearing at the person;

competent authority – the National agency on safety of foodstuff (further – the Agency), territorial subdivisions of the Agency, the Republican veterinary and diagnostic center within legal competences;

category – one of the classification categories described in this Regulation Item 7;

the animal suspected on TGE infection – the live animal killed or destroyed who shows or showed neurologic signs or behavioural violation, or the progressive deterioration in general condition connected with disorder of the central nervous system and for which information collected based on clinical trial, response to treatment, pathoanatomical research or to - and the postcrushing laboratory analysis, does not allow to make other diagnosis.

Gubkoobrazny encephalopathies at cattle (further - GE KRS) shall be suspected at cattle which yielded positive result on rapid test for GE KRS;

sampling – the selection process of tests providing statistically correct representation from animals or the circle surrounding them or from animal products, for the purpose of determination of the diagnosis of disease, relationship degree, for observation of health or for monitoring of absence of microbiological agents or certain materials in animal products;

fertilizer – any substance containing the animal products utilized in the earth to provide growth of vegetation which remaining balance of biological conversion from biogas production or preparation of compost can also enter;

rapid test – the analysis method specified in this Regulation Item 30 which result becomes known within 24 hours;

the alternative test – the method of laboratory diagnostics allowing to establish the corresponding diagnostics for detection of materials with specific risk;

mechanically separated meat – the product received by removal of meat from myasonesushchy bones after the boning with use of mechanical means leading to loss or modification of structure of muscle fibers;

passive supervision – the reporting on all animals suspected of infection with the TGE form and also when availability of the TGE form cannot be excluded as a result of clinical inspection is performed laboratory testing of the corresponding animals;

active supervision – conducting testing on identification of the animals who are not registered as suspects of infection with the TGE form, and also the animals who underwent to forced slaughter, the animals after posthumous inspection who fell, animals, the killed healthy animals at whom there were disease signs, and the animals killed in connection with TGE case, in particular for the purpose of determination of evolution and distribution of the TGE forms;

fur animal – the animal who is grown up for fur production, is not intended for consumption by the person;

collagen – the products on the basis of proteins received from skin, bones and sinews of animals;

forage in the form of canned food for pets – the forage for pets which underwent thermal treatment and stored in hermetically sealed reservoirs;

the processed forage for pets – the forage for pets which underwent the thermal treatment at temperature at least 90 °C, such as dehydration or fermentation guaranteeing that this forage does not represent any unacceptable risk for public health and animals;

local case of gubkoobrazny encephalopathy at cattle – GE KRS case revealed at animal concerning whom it was not accurately confirmed that it resulted from infection before import of live animal;

cohort – the group of cattle consisting of the animals who were born in the same livestock for 12 months before or 12 months is later than the birth of the infected animals, or animals who are grown up together with the infected animals irrespective of time which they spent together in the first year of their life and who could use the same forage, as the infected animals in the first year of their life;

indicative case – the first animal in economy or in epidemiologically certain group at which TGE infection was confirmed;

TGE at small ruminants – TGE case found in sheep or goat after confirmation of the test for presence of abnormal protein of PrP;

fasten case – the confirmed case of infection of TGE revealed at sheep or goat when the diagnosis of GE KRS was excluded according to the criteria formulated in the Technical guidance of the International help laboratory according to the characteristic of strains of TGE at small ruminants (further – the Technical guidance);

fasten classical case – fasten the confirmed case, classified as classical according to the criteria formulated in the Technical guidance of the International help laboratory according to the characteristic of strains of TGE at small ruminants;

fasten atypical case – fasten the confirmed case which differs from classical fasten, according to the criteria formulated in the Technical guidance of the International help laboratory according to the characteristic of strains of TGE at small ruminants;

the genotype of prionny protein – at sheep, combination of two alleles, each allele is determined depending on the amino acid coded by codons 136, 154 and 171 genes of prionny protein; GE KRS case - GE KRS case confirmed with the Republican veterinary and diagnostic center according to the methods and records provided in Sections 2 and 3 of Chapter VI;

classical case of GE KRS – GE KRS case classified as such according to the criteria established in the method used by the International help laboratory for classification of TGE isolates at cattle;

atypical case of GE KRS – case of GE KRS which cannot be classified as classical according to the criteria established in the method used by the International help laboratory for classification of TGE isolates at cattle;

sheep and goats are younger than 18 months – sheep and goats whose age is supported by the registers or the turnover documents provided by the Law No. 231-XVI of July 20, 2006 on identification and registration of animals (The official monitor of the Republic of Moldova, 2013, Art. No. 126-130, 623), with subsequent changes at which more than two permanent cutters were cut through through gum.

II. Measures for biosafety

4. For the purpose of implementation of measures for biosafety provisions of the Order of the Government No. 1099 of September 29, 2008 are applied. "About approval of veterinary sanitary standards on conducting veterinary sanitary inspections when importing animals" (The official monitor of the Republic of Moldova, 2008, Art. No. 180-181, 1104), with subsequent changes, and the Orders of the Government No. 1408 of December 10, 2008. "About approval of some veterinary sanitary standards" (The official monitor of the Republic of Moldova, 2008, Art. No. 230-232, 1442), with subsequent changes.

5. Measures for biosafety include complex of the organizational and technical procedures approved by the Agency and regulated by the Technical guidance which application will allow to prevent introduction and spread of disease.

6. The agency shall provide that personnel of its territorial subdivisions, and also diagnostic laboratories, faculties of veterinary medicine and zootechnics, official veterinarians, the authorized freely practicing veterinarians, the personnel of slaughterhouses, cattle breeders and owners of animals, persons working with animals were instructed rather clinical signs, epidemiology, labor safety and in case of the personnel responsible for conducting checks, concerning interpretation of results of laboratory analyses on TGE.

III. Determination of the status on GE KRS and its prevention

Section 1. Classification of GE KRS

7. The status of the country or region shall be determined by GE KRS based on one of the following three categories:

1) insignificant risk of GE KRS:

a) the country or the region where risk analysis for the purpose of identification of the following risk factors was carried out:

- presence or lack of the GE KRS activator and in case of presence its distribution based on results of supervising activities;

- production of meat and bone meal or cracklings from the infected GE KRS ruminant local population;

- the imported meat and bone meal;

- the imported large horned animals, sheep and goats;

- the imported forages for animals and fodder ingredients;

- the imported animal products for consumption by the person which may contain fabrics, and also skull, except for the lower jaw, and including brain and eyes, spinal cord of animals at the age of 12 months, backbone, except for tail vertebrae, back and cross cervical, chest and lumbar vertebrae, and also sacral medial crest and wings of sacral bones, including glands of back basis of animals at the age of over 30 months, tonsils, intestines from duodenum to rectum and mesentery of animal all age which could feed with the products received from KRS:

- the skull, including brain and eyes, almonds and spinal cord of animals is aged more senior than 12 months or at what through gum permanent cutters, and also the spleen and podvzdoshny gut which occurred from sheep and goats of all age were cut through;
