I ORDER:

1. Bring in the order of the Minister of Education and Science of the Republic of Kazakhstan of April 13, 2015 No. 198 "About approval of standards of the state services rendered in the field of family and children" (registered in the Register of state registration of regulatory legal acts at No. 11184, published in information system of law of Ad_let of June 18, 2015) the following changes:

The Standard of the state service "Issue of References on Guardianship and Custody" approved by the specified order to be reworded as follows 1) according to appendix 1 to this order;

The Standard of the state service "Establishment of Guardianship Or Custody over the Orphan Child (Orphan Children) and Child(children), Without Parental Support" approved by the specified order to be reworded as follows 2) according to appendix 2 to this order;

The Standard of the state services "Issue of References in the Single Accumulation Pension Fund and (or) the Voluntary Accumulation Pension Fund, Banks, in Law-enforcement Bodies for the Order Property of Minor Children and Registrations of Inheritance to Minor Children" approved by the specified order to be reworded as follows 3) according to appendix 3 to this order;

The Standard of the state services "Issue of References of the Bodies Performing Functions on Guardianship Or Custody for Execution of Transactions with the Property Belonging on the Property Right to Minor Children" approved by the specified order to be reworded as follows 4) according to appendix 4 to this order;

The Standard of the state services "Purpose of Allowance Payment to Guardians or Custodians to Content of the Orphan Child (Orphan Children) and Child(children), Without Parental Support" approved by the specified order to be reworded as follows 5) according to appendix 5 to this order.

2. To committee on protection of the rights of children (Makenova A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and the Information system of law of Ad_let, and also in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on the Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-Minister of Education and Science of the Republic of Kazakhstan (Imangaliyeva E. N.).

4. This order becomes effective since March 1, 2016 and is subject to official publication.

Standard of the state service "Issue of References on Guardianship and Custody"

1. General provisions

1. The state service "Issue of References on Guardianship and Custody" (further – the state service).

2. The standard of the state service is developed by the Ministry of Education and Science of the Republic of Kazakhstan (further – the Ministry).

3. The state service appears local executive bodies of the cities of Astana and Almaty, areas and cities of regional value (further – the service provider).

Reception of an application and issue of result of rendering the state service are performed through:

1) non-commercial joint-stock company "Government for Citizens state corporation;

2) the web portal of "the electronic government" www.egov.kz (further – the portal).

2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the moment of delivery of documents in the State corporation, and also in case of the address on the portal – 5 minutes.

In case of lack of data on establishment of guardianship or custody over the orphan child (orphan children), child(children), without parental support, in information systems the term of rendering the state service – 3 working days (day of acceptance does not enter rendering the state service in time);

2) the most allowed time of expectation for delivery of documents uslugopoluchatel in the State corporation – 15 minutes;

3) the most allowed time of servicing of uslugopoluchatel in the State corporation – 15 minutes.

5. Form of rendering the state service – electronic (completely automated) and (or) paper.

6. Result of rendering the state service – the certificate of guardianship and custody in form according to appendix 1 to this standard of the state service.

7. The state service is rendered to free of charge physical persons (further – uslugopoluchatel).

8. Working schedule:

1) State corporation: Monday through Saturday inclusive according to the established working schedule from 9:00 till 20:00 o'clock without interruption for lunch, except for Sundays and holidays, according to the labor law.

Acceptance is performed according to the procedure of "electronic" queue, in place of registration of uslugopoluchatel, without the accelerated servicing, "booking" of electronic queue by means of the portal is possible.
