According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" the Board of National Bank of the Republic of Kazakhstan DECIDES:

1. Bring in the resolution of Board of National Bank of the Republic of Kazakhstan of April 30, 2015 No. 71 "About approval of standards of the state services of National Bank of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts at No. 11534, published on July 15, 2015 in information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan) the following changes and amendments:

in Item 1:

42) and 43) to exclude subitems;

add with subitems 56), 57), 58) and 59) of the following content:

"56) the standard of the state service "Licensing for the right of implementation of Islamic insurance activity on industry "life insurance" according to appendix 56 to this resolution;

57) the standard of the state service "Licensing for the right of implementation of Islamic insurance (reinsurance) activity on industry "general insurance" according to appendix 57 to this resolution;

58) the standard of the state Service "Licensing for the Right of Implementation of Islamic Insurance Activity by the Types of Compulsory Insurance Established by the Laws of the Republic of Kazakhstan and Which Are Separate Classes of Insurance" according to appendix 58 to this resolution;

59) the standard of the state service "Licensing for the Right of Implementation of Activities for Islamic Reinsurance" according to appendix 59 to this resolution.";

add with appendix 56 according to appendix 1 to this resolution;

add with appendix 57 according to appendix 2 to this resolution;

add with appendix 58 according to appendix 3 to this resolution;

add with appendix 59 according to appendix 4 to this resolution.

2. To provide to management of quality control of the state services (Badyrlenov Zh. R.) in the procedure established by the legislation:

1) together with Legal support department (Dosmukhambetov N. M.) state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of this resolution on official publication in information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan;

3) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication.

3. To department of the international relations and public relations (Kazybayev A. K.) provide the direction of this resolution on official publication in periodic printing editions within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan.

4. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Galiyeva D. T.

5. This resolution becomes effective after ten calendar days after day of its first official publication, except for paragraphs of the fourth, fifth, sixth, seventh, eighth, ninth, tenth, eleventh and twelfth Item 1 of this resolution which become effective after twenty one calendar days after day of its first official publication.

The standard of the state service "Licensing for the right of implementation of Islamic insurance activity on industry "life insurance"

1. General provisions

1. The state service "Licensing for the right of implementation of Islamic insurance activity on industry "life insurance" (further - the state service).

2. The standard of the state service is developed by National Bank of the Republic of Kazakhstan.

3. The state service appears National Bank of the Republic of Kazakhstan (further - the service provider).

Reception of applications and issue of results of rendering the state service is performed through office of the service provider.

2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the moment of delivery of document package to the service provider:

when licensing - within 30 (thirty) working days;

in case of renewal of the license - within 3 (three) working days;

in case of renewal of the license in case of reorganization of uslugopoluchatel in the form of allocation or separation - no later than 30 (thirty) working days;

in case of issue of duplicates of the license - within 2 (two) working days;

2) the most allowed time of servicing of uslugopoluchatel - 15 (fifteen) minutes.

The service provider within 2 (two) working days from the moment of receipt of documents of uslugopoluchatel checks completeness of the submitted documents.

In case of factual determination of incompleteness of the submitted documents the service provider within 2 (two) working days from the moment of receipt of documents of uslugopoluchatel gives written motivated refusal in further review of the statement.

5. Form of rendering the state service: paper.

6. Result of rendering the state service - licensing, renewal, issue of duplicates of the license, or the motivated answer about refusal in rendering the state service, in cases and on the bases, stipulated in Item 10 these standards of the state service.

Form of provision of result of rendering the state service: paper.

7. The state service is rendered on paid basis to legal entities (further - uslugopoluchatel). When rendering the state service the license fee is paid for the occupation right by separate types of activity:

1) the license fee when licensing for the occupation right this type of activity constitutes 50 monthly settlement indicators (further - MRP);

2) the license fee for renewal of the license constitutes 10 percent from rate when licensing, but no more than 4 MRP;

3) the license fee for issue of the duplicate of the license - 100 percent from rate when licensing.

Payment of the license fee is performed in cash or non-cash form through the banks of the second level or the organization performing separate types of banking activities.

8. The working schedule of the service provider - Monday through Friday from 9:00 till 18:00 o'clock with lunch break from 13:00 till 14:00 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

The schedule of reception of applications and issue of results of rendering the state service - from 9:00 till 17:30 o'clock with lunch break from 13:00 till 14:30 o'clock.

The state service is rendered without expectation in queue, without making an appointment and the accelerated servicing.

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel to the service provider:

for receipt of the license:

1) the statement for licensing in form according to appendix 1 to this standard of the state service;

2) the copy of the document confirming payment of the license fee for the occupation right with separate types of activity;

3) the documents testimonial of accomplishment of all organizational and technical actions, including concerning financial accounting and the automation of conducting financial accounting conforming to requirements of regulatory legal acts of National Bank of the Republic of Kazakhstan;

4) the copy of the charter with all changes and amendments in it (in the presence of those), notarially attested in case of non-presentation of originals for reconciliation;

5) documents of persons offered to positions of leading employees of the Islamic insurance (reinsurance) organization according to requirements of article 34 of the Law of the Republic of Kazakhstan of December 18, 2000 "About insurance activity" (further - the Law);

6) copies of the documents confirming payment of the authorized capital which minimum size is established by the Instruction about establishment of prudential standard rates and other regulations and limits, obligatory to observance, for the insurance (reinsurance) organization and insurance group including the minimum sizes of the authorized capital, guarantee fund, margin of the solvency and terms of submission of reports on accomplishment of prudential standard rates approved by the resolution of Board of the Agency of the Republic of Kazakhstan on regulation and supervision of the financial market and the financial organizations of August 22, 2008 No. 131, registered in the Register of state registration of regulatory legal acts at No. 5331.
