About approval of the Procedure for laboratory providing quarantine phytosanitary measures

According to Item 24 of the Protocol on application of sanitary, veterinary and sanitary and quarantine phytosanitary measures (appendix No. 12 to the Agreement on the Eurasian Economic Union of May 29, 2014) and Item 18 of appendix No. 2 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Board of the Eurasian economic commission solved:

1. Approve the enclosed Procedure for laboratory providing quarantine phytosanitary measures.

2. This Decision becomes effective from the effective date decisions of Council of the Eurasian economic commission on approval of single quarantine phytosanitary requirements, but not earlier than after 30 calendar days from the date of official publication of this Decision.

Procedure for laboratory providing quarantine phytosanitary measures

I. General provisions

1. This Procedure is developed according to Item 24 of the Protocol on application of sanitary, veterinary and sanitary and quarantine phytosanitary measures (appendix No. 12 to the Agreement on the Eurasian Economic Union of May 29, 2014) and determines rules of laboratory providing quarantine phytosanitary measures.

2. This Procedure is applied by authorized bodies on quarantine of plants of state members of the Eurasian Economic Union (further respectively - authorized bodies, state members) and quarantine phytosanitary (test) laboratories.

3. For the purposes of this Procedure concepts which mean the following are used:

"diagnostics of harmful organism" - process of identification and identification of harmful organism;

"quarantine phytosanitary examination" - complex of procedures for research of samples (tests) of quarantine products (quarantine freights, quarantine materials, quarantine goods), quarantine objects and regulated not quarantine harmful organisms and issue of the conclusion about quarantine phytosanitary condition of quarantine products (quarantine freights, quarantine materials, quarantine goods);

"quarantine phytosanitary (test) laboratories" - the expert organizations which are structural divisions of authorized body or the organizations subordinated to authorized body, and also other organizations, accredited (certified) and (or) authorized according to the legislation of state members on accomplishment of researches in the field of quarantine of plants, having qualified specialists and equipped with the technical means necessary for carrying out research of quarantine phytosanitary condition of samples (tests) of quarantine products (quarantine freights, quarantine materials, quarantine goods);

"laboratory providing quarantine phytosanitary measures" - complex of procedures for selection, the address of samples (tests) of quarantine products (quarantine freights, quarantine materials, quarantine goods), quarantine objects and regulated not quarantine harmful organisms, to conducting quarantine phytosanitary examination of the specified samples (tests), documentation of results of quarantine phytosanitary examination, information, material and scientific methodically to ensuring activities of quarantine phytosanitary (test) laboratories;

sample (test) - the quantity of quarantine products which is selected from batch of quarantine products for conducting quarantine phytosanitary examination, struck (damaged) by wreckers and diseases parts of quarantine material, copies and medicines of quarantine objects, micromedicines of causative agents of diseases, wit, washouts from surface.

Other concepts used in this Procedure are applied in the values defined by the Agreement on the Eurasian Economic Union of May 29, 2014 and the International convention on quarantine and protection of plants (Rome, 1951).

II. Basic principles of the organization of laboratory providing quarantine phytosanitary measures

4. The basic principles of the organization of laboratory providing quarantine phytosanitary measures are:

a) optimization of placement and equipping of quarantine phytosanitary (test) laboratories;

b) completing of quarantine phytosanitary (test) laboratories by the qualified personnel performing quarantine phytosanitary examination, and increase in its professional level;

c) implementation of system of enciphering of samples (tests) of quarantine products (quarantine freight, quarantine material, quarantine goods), quarantine objects or regulated not quarantine harmful organisms (further - samples (tests)) for exception of possibility of the hidden substitution of samples (tests) and (or) misstatement of records about them in accounting or other documents, and also for ensuring objectivity and impartiality of the received results of quarantine phytosanitary examination;

d) harmonization of methods (techniques) of researches of samples (tests) with the international and regional standards on phytosanitary measures (diagnostic protocols);

e) ensuring efficiency of receipt of results of quarantine phytosanitary examination by application in work of express methods of the latest development;

e) exception of distribution of quarantine objects and regulated not quarantine harmful organisms in the course of conducting quarantine phytosanitary examination;

g) ensuring information exchange between quarantine phytosanitary (test) laboratories.

III. Organization of laboratory providing quarantine phytosanitary measures

5. Laboratory providing quarantine phytosanitary measures includes:

a) the address of samples (tests) (transfer by their authorized body to quarantine phytosanitary (test) laboratory and their movement within this laboratory);

b) conducting quarantine phytosanitary examination of samples (tests) using methods (techniques) or standards harmonized with the international and regional standards on phytosanitary measures (diagnostic protocols);

c) representation of quarantine phytosanitary (test) laboratory by the employee to the official of authorized body of the conclusion of quarantine phytosanitary examination;

d) the information, material and scientific and methodical support of quarantine phytosanitary (test) laboratories performed by authorized body.

6. Quarantine phytosanitary (test) laboratories are placed according to the legislation of state members taking into account types and amounts of the imported and moved quarantine products (quarantine freights, quarantine materials, quarantine goods), quarantine phytosanitary condition of the territory of administrative and territorial unit of state member in which such laboratories are placed.

7. Depending on types and amounts of the carried-out quarantine phytosanitary expertizes in quarantine phytosanitary (test) laboratory the corresponding methods of diagnostics are used, the quantity and purpose of necessary rooms and the equipment are determined, the qualified personnel is created, checking of the equipment is provided, the quality management system of the performed works is supported.

8. The quarantine phytosanitary examinations providing carrying out entomological, mycologic, bacteriological, virologic, nematologichesky and gerbologichesky researches of samples (tests) are carried out to terms according to appendix No. 1.

IV. Selection and address of samples (tests)

9. Sampling (tests) is performed by officials of authorized body and (or) according to the decision of authorized body - specialists of quarantine phytosanitary (test) laboratory.
