2. To the head of the department of economy and finance of the Ministry of Defence of the Republic of Kazakhstan:
1) in the procedure established by the legislation to send this order to the Ministry of Justice of the Republic of Kazakhstan for state registration;
The copy of this order to send 2) within ten calendar days after state registration to periodic printing editions and to information system of law of Ad_let for official publication;
The order to place 3) after official publication on Internet resource of the Ministry of Defence of the Republic of Kazakhstan.
3. Declare invalid the order of the Minister of Defence of the Republic of Kazakhstan of July 13, 2015 No. 405 "About approval of Rules of carrying out and conditions of certification of civil servants of military units and organizations of the Armed Forces of the Republic of Kazakhstan containing at the expense of means of the government budget" (it is registered of August 25, 2015 No. 11941, is published in the Register of state registration of regulatory legal acts in information system of law of regulatory legal acts of the Republic of Kazakhstan of Ad_let on September 11, 2015).
4. To impose control of execution of this order on the supervising deputy defense secretary of the Republic of Kazakhstan.

1. These rules of carrying out and condition of certification of civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan (further - Rules) are developed according to Item 7 of Article 139 of the Labor code of the Republic of Kazakhstan and determine procedure and conditions of carrying out certification of civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan (further - workers).
2. Certification of civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan is performed for the purpose of determination of their professional and qualification training, business qualities, establishment of qualification categories (categories).
3. The main evaluation criterion in case of certification is the capability of civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan to carry out the obligations assigned to them.
4. Certifications are subject all civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan, except for the expectant mothers and civil servants who worked less than six months from the date of the occupation of this position.
5. Civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan undergo certification after each next three years of stay at work in organizations of Armed Forces of the Republic of Kazakhstan, but not earlier than six months from the date of the occupation of this position.
At the same time certification is carried out no later than six months from the date of approach of the specified term.
6. The civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan who are on vacation non-paid on child care before achievement of age by it three years are certified not earlier than in six months after appearance at work.
According to the statement of civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan for assignment of the next category certification is carried out before the expiration of the specified terms.
7. Certification includes number of consecutive stages:
1) the interview with the civil servant of military units and organizations of Armed Forces of the Republic of Kazakhstan held by certifying commission;
2) decision of certifying commission.
8. Carrying out certification will be organized by personnel service of the certifying body for the order of his head and includes the following events:
1) preparation of necessary documents for certified;
2) schedule development of carrying out certification;
3) determination of structure of certifying commissions;
4) the organization of explanatory work about the purposes and procedure for carrying out certification.
9. The personnel service once within six months determines civil servants of military units and organizations of the Armed Forces of the Republic of Kazakhstan which are subject to certification according to Item 8 of these rules.
10. The head of organization on representation of personnel service issues the order which the list of the certified persons, the schedule of carrying out certification and structure of certifying commission affirms.
11. The personnel service in writing notifies civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan on terms of carrying out certification not later than one month prior to its carrying out.
12. The direct head of the civil servant of military unit and the organization of Armed Forces of the Republic of Kazakhstan which is subject to certification draws up the office characteristic and sends it to personnel service not later than four weeks prior to meeting of certifying commission.
13. The office characteristic provides reasonable, objective assessment of professional, personal qualities and results of office activities of the certified person.
14. The personnel service informs the civil servant of military units and organizations of Armed Forces of the Republic of Kazakhstan of the office characteristic submitted on him not later than three weeks prior to meeting of certifying commission in time.
15. In case of disagreement with the office characteristic provided on it the certified person in writing declares the disagreement in personnel service.
16. The appraisal sheet on the civil servant of military units and organizations of Armed Forces of the Republic of Kazakhstan who is subject to certification is drawn up in form according to appendix 1 to these rules.
17. The estimative leaf on the civil servant of military units and organizations of Armed Forces of the Republic of Kazakhstan who is subject to certification is drawn up in form according to appendix 2 to these rules.
18. The personnel service directs collected certification materials to certifying commission.
19. The certifying commission is created by the head of organization on representation of its personnel service and consists of members and the secretary of the commission. From among members of certifying commission the chairman is appointed. The chairman of certifying commission directs its activities, presides over its meetings, plans its work, exercises general control and bears responsibility for activities and decisions made by it.
20. During the meeting the commission studies the provided materials, hears the certified person.
21. By results of studying of the provided materials and interview with the civil servant the commission accepts one of the following decisions:
1) corresponds to post;
2) is subject to repeated certification;
3) does not correspond to post.
22. In case of pronouncement of the positive decision the commission establishes (confirms) the corresponding qualification category (category) of the civil servant, or notes about lack of the bases for her (his) establishment.
23. The decision of certifying commission is made by open voting. In case of decision making concerning the civil servant of military units and organizations of Armed Forces of the Republic of Kazakhstan who is part of certifying commission, vote takes place without its participation.
24. Repeated certification is carried out in three months from the date of carrying out initial certification according to the procedure, determined by these rules. Certifying commission, having carried out repeated certification, accepts one of the following decisions:
1) corresponds to post;
2) does not correspond to post.
In case of compliance of the civil servant of post the commission passes the decision taking into account Item 27 of these rules.
25. Solutions of certifying commission are drawn up by the protocol which is signed by the chairman, members of certifying commission and the secretary who were present at its meeting.
26. Within three working days after signing of the protocol results of certification are told the certified person under list with issue of one copy of the appraisal sheet.
27. Solutions of certifying commission affirm the head of military unit (organization) in a month about what appears in the order on military unit (organization).
28. The approved solutions of certifying commission are entered in appraisal sheets of civil servants of military units and organizations of Armed Forces of the Republic of Kazakhstan.
29. The appraisal sheet of the civil servant of military units and organizations of Armed Forces of the Republic of Kazakhstan who underwent certification, and the office characteristic on it are stored in the personal record. The solution of certifying commission approved by the head of military units (organization) is also entered in the record of service of the civil servant of military units and organizations of Armed Forces of the Republic of Kazakhstan.
