About approval of the Program for the termination of use of ozone-depleting substances for 2016-2020 (the Phase 3)
For the purpose of accomplishment of obligations of the Kyrgyz Republic according to the Montreal protocol on the substances destroying ozone layer according to the Law of the Kyrgyz Republic "About protection of ozone layer" and articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:
1. Approve the Program for the termination of use of ozone-depleting substances for 2016-2020 (the Phase 3) (further - the Program) according to appendix.
2. To the state agency of environmental protection and forestry under the Government of the Kyrgyz Republic:
- form the interdepartmental coordination commission on program implementation;
- annually, no later than April 1 to inform the Government of the Kyrgyz Republic on the program implementation course.
- the order of the Government of the Kyrgyz Republic "About the State program on the termination of use of ozone-depleting substances" of April 29, 2002 No. 263;
- the order of the Government of the Kyrgyz Republic "About the termination of use of ozone-depleting substances" of July 11, 2008 No. 374.
4. This resolution becomes effective after ten days from the date of official publication.
5. To impose control of execution of this resolution on department of agro-industrial complex and ecology of Government office of the Kyrgyz Republic.

This Program for the termination of use of ozone-depleting substances for 2016 - 2020 (the Phase 3) (further - the Program) is directed to fulfillment of requirements of the Montreal protocol on the substances destroying ozone layer (further - the Montreal protocol) which party is the Kyrgyz Republic according to the Law of the Kyrgyz Republic "About ratification of the Vienna convention on protection of ozone layer and the Montreal protocol on the substances destroying ozone layer".
The program provides complete cessation of consumption (production, export and import) of all ozone-depleting substances (further - ORV) in the territory of the Kyrgyz Republic by 2020.
The purposes of the Program are:
- emission reduction of ORV and greenhouse gases;
- increase in energy efficiency of production cycles;
- increase in capacity of state bodies.
Tasks of the Program are:
- direct conclusion of hydrochlorofluorocarbons (further - GHFU), GHFU-22, GHFU-141b and GHFU-142b, from consumption in case of production of foam materials and in refrigeration equipment is preferential;
- transfer of innovative technologies within upgrade of the companies using GHFU in case of technological transactions and making polyurethane foam isolation (the preisolated pipes, sandwich panel), household, trading and industrial refrigeration equipment, and also performing repair and field service of the refrigerating and climatic equipment.

The Kyrgyz Republic did not make, does not make and does not plan production of ORV, the equipment and goods containing ORV which are controlled by the Montreal protocol, but imports them as in pure form, and in components.

For program implementation fulfillment of requirements of the Montreal protocol on the termination of consumption of GHFU according to the following schedule is planned:
- reducing level of consumption of GHFU for 10% in comparison with basic level since 2015 (at ORS ton 3,69 level);
- reducing level of consumption of GHFU for 35% in comparison with basic level since 2016 (at ORS ton 2,665 level);
- reducing level of consumption of GHFU on 67, % in comparison with basic level since 2018 (at ORS ton 1,332 level);
- reducing level of consumption of GHFU on 97, % in comparison with basic level since 2020 (at ORS ton 0,102 level);
- complete cessation of consumption of GHFU since 2025.
In this regard it is necessary:
- support modern experience of servicing, retrofit and conclusion from operation of the cooling equipment, including extraction and recirculation;
- consider impact on interests of end users;
- minimize adverse effects due to creation of certain inventory of ORV;
- strengthen international cooperation for the prevention of illegal trade of ORV;
- continue actions for increase in public awareness in the field of preserving ozone layer;
- continue carrying out the training program of technicians on servicing of the cooling equipment and specialists in fumigation of grain inventories, and also personnel of customs and boundary services, financial police for prevention of cases of illegal trade when moving ORV from the territory of one state on the territory of other state of the Eurasian Economic Union (further - EEU);
- consider the possibility of implementation of economic incentives for support of use of alternatives to the applied ORV;
- support and strengthen the institutional potential for management and control of actions for accomplishment of the Program.
Control of consumption of hydrofluorocarbons (GFU - coolant with considerable potential of warming) and measures for reducing their consumption, and also complete cessation of consumption of methylbromide, including use for quarantine processing of products and its processing before transportation, will be considered as one of the subsequent activities which can be realized before entry into force of restrictions on international agreements.
Operations according to the Program will be performed in coordination with other international agreements (The Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes and their removal, the Rotterdam convention on the procedure of previously proved consent concerning separate dangerous chemicals and pesticides in international trade, the Stockholm convention on resistant organic pollutants, the United Nations Framework Convention on climate change) which party is the Kyrgyz Republic, in accordance with the established procedure.
The action plan consists of three main components:
- normative legal actions;
- strengthening of technical potential;
- investing activities.
Within this Program project development of necessary regulatory legal acts, industry programs and action plans is planned what promotes the solution of such questions as:
- licensing and quoting of import of GHFU, strengthening of customs control;
- introduction of import ban of the equipment containing GHFU;
- organization of control of use of GHFU;
- utilization of GHFU both on large, and on ordinary objects;
- stimulation of use of ozone-safe coolants, including ammonia and carbon dioxide;
- training and obligatory certification of the specialists working with coolants.
Considering that the Kyrgyz Republic borders on People's Republic of China which is the GHFU prime manufacturer and the equipment containing GHFU, increase in system effectiveness of import control is necessary action.
One of measures for enhancement of system is implementation of the procedure of prior reasonable consent of authorized state bodies of the Kyrgyz Republic and People's Republic of China before issue of import licenses and actual receipt of ORV to the republic.
Now import and delivery of GHFU are made in small containers of single application which import to the Kyrgyz Republic it is difficult to control. For the solution of this problem it is necessary according to requirements of the legislation of state members of EEU since 2016 to impose import ban of coolants in containers of single application.
Increase in efficiency of actions for reducing consumption of GHFU requires adoption of strict rules on management of coolants in the field of large-scale assembly using the modern practice accepted for the equipment containing GHFU and practice for the equipment using industrial greenhouse gases, in particular GFU that requires implementation of system of accounting of assembly, obligatory maintaining the register in which detailed history of servicing and qualification requirements imposed when carrying out maintenance of the equipment will be reflected.
Also it is necessary to consider question of expansion of control of import of GFU and the equipment containing GFU and application of rules of management of coolants in relation to the equipment containing GFU according to technological practice of the advanced countries.
Based on experience of accomplishment of the previous programs, ensuring integrity of the existing system of licensing and import control which was rather effective is necessary.
At the same time, special attention needs to be paid to question of support and strengthening of capacity of the State Customs Service under the Government of the Kyrgyz Republic, State Border Service of the Kyrgyz Republic on the sites of frontier which are not covered by customs control
The most important requirement is the possibility for support and servicing of the current bank GHFU-soderzhashchego of the equipment. The training system to modern methods of servicing of the cooling equipment will allow to reduce leakages when servicing and recovery of coolants.

Control of consumption GFU and measures for reducing their consumption are considered as necessary action for further decrease in impact of the cooling sector on the environment and climate change.
The program provides implementation of measures for increase in ecological literacy of students in the educational organizations initial, average and higher education, and also in the general education organizations for protection of ozone layer and accomplishment of the international obligations for the Vienna convention on protection of ozone layer and the Montreal protocol.
Within program implementation rendering assistance to authorized state bodies in creation of system of obligatory certification of the specialists working with ORV, development of curricula, preparation of training programs and educational and methodical sets for ensuring educational process and creation of the industrial practice center equipped with the modern demonstration and training equipment is planned.
Availability of still considerable inventories of ORV keeps steady residual demand for coolants and thereof determines need of taking measures which can be broken into 2 main directions:
- strengthening of potential on extraction and recovery of coolants. Now about 50% of technicians are properly equipped and have access to the procedure of utilization, it is necessary to increase its quantity to 80%;
- creation of technical infrastructure of distribution of coolants, taking into account introduction of restrictions for amount of the imported containers with GHFU.
Within program implementation assistance to producers of refrigeration equipment and foam materials on transition to use of ozone-safe substances and technologies, rendering technical assistance to 1-2 pilot companies for development, adaptation and implementation of ozone-safe compoundings of components for production of foam materials is provided.
The program assumes GHFU conclusion from the address in the sector of production of foam materials (production sandwich panels and the preisolated pipes).
As an alternative GHFU-141b and GHFU-22 is supposed to use cyclopentane, and this option of technological conversion will be fulfilled on the example of 1-2 companies of the sector due to replacement or upgrade of the existing equipment.
Also, as an alternative GHFU-141b it is offered to use hydrocarbons, the liquefied carbon dioxide, water, methyl formiate, i.e. ecologically safe substances.
GHFU conclusion from the address in sectors of production and field service refrigerating (household, medical and trade) and the climatic equipment is performed in interaction with producers of refrigeration equipment, Republican public association Ekokholod and training centers under the State inspectorate for ecological and technical safety under the Government of the Kyrgyz Republic.
So far in the Kyrgyz Republic all equipment containing ORV upon termination of service life or after failure uncontrolledly is placed in places of warehousing of household and industrial wastes. ORV from this equipment arrive afterwards in the atmosphere.

In the period of 2016-2018 the corresponding projects of regulatory legal acts of the Kyrgyz Republic in the field of protection of ozone layer will be developed.

The curriculum of training of technical specialists will include information on ways of increase in efficiency of energy consumption of systems; safe handling of flammable and/or toxic coolants; and also about implementation of standards of safety in case of development, production and installation of the equipment.
Will be begun development and deployment of the standards of safety covering different aspects of the equipment, the used coolant and servicing. Retraining of specialists and technicians on servicing, heads of the companies and designers of buildings and architects on studying of standards of safety will be carried out.
The program it is provided the educational organizations of primary professional education by multimedia means for training of specialists on maintenance of refrigeration equipment.
The program plans implementation of pilot system of distribution of GHFU-22 through the single center for support of import ban of containers of single application. Through the single center distribution/sale of GHFU at special charging stations where small containers of reusable application are used will be made.
The program plans the organization of system of distribution GHFU-22 in two centers which will get out of the list of the companies conforming to requirements importing GHFU.
