1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of June 3, 2015 No. 445 "About approval of Rules of appointment and payment of special public welfare payment" (registered in the Register of state registration of regulatory legal acts for No. 11745, published in information system of law of Ad_let on August 5, 2015) the following change:

The rules of appointment and payment of special public welfare payment approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to department of the public assistance of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan of Zhakupova S. K.

4. This order becomes effective since March 1, 2016 and is subject to official publication.

Rules of appointment and payment of special public welfare payment

1. General provisions

1. These rules of appointment and payment of special public welfare payment (further - Rules) are developed according to the Law of the Republic of Kazakhstan of April 5, 1999 "About special public welfare payment in the Republic of Kazakhstan" (further - the Law) determine procedure for appointment and payment of special public welfare payment.

2. In these rules the following basic concepts are used:

1) The Government for Citizens State corporation (further - the State corporation) - the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services and issue of their results to uslugopoluchatel by the principle of "one window", and also ensuring rendering the state services electronically;

2) the special commissions - the commissions created by decisions of akims of the corresponding administrative and territorial units for establishment of length of service to persons who worked at least 6 months during the period from June 22, 1941 to May 9, 1945;

3) special public welfare payment (further - benefit) - the money payment to the citizens having entitlement to benefit, provided irrespective of other types of benefits;

4) the receiver of benefit (further - the receiver) - physical person which is granted allowance;

5) authorized organization for issue of benefit - the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company;

6) authorized body to destination benefits - territorial subdivision of Committee of work, social protection and migration of the Ministry of health and social development of the Republic of Kazakhstan;

7) division of medico-social examination (further - division of MSE) - the structural division of authorized body to destination benefits which is carrying out medico-social expertize;

8) departments of the State corporation - city, district departments of the State corporation;

9) branch of the State corporation - regional, the cities of Astana and Almaty branches of the State corporation;

10) the central executive body - the state body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination in the field of social protection of the population;

11) the applicant - the physical person addressing for purpose of benefit;

12) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

13) electronic prototype of case (further - EMD) - the electronic prototype of case of the receiver of benefit created by the State corporation.

3. To receivers to whom the allowance is granted till January 1, 2001 reassignment of benefit is made on the bases provided by the Law.

4. The benefit is paid monthly for current month and for observance of conditions on which the allowance is granted from the moment of emergence of the right to its obtaining in the sizes established by the Law.

In case of the death of the receiver, the benefit is paid till month of death inclusive.

In case of departure of the receiver of benefit for the permanent place residence out of limits of the Republic of Kazakhstan, allowance payment is made till month of removal from registration at the place of residence.

2. Procedure for purpose of benefit from the republican budget

The citizens having the right to benefit on the bases specified in article 4 of the Law for purpose of benefit represent to department of the State corporation at the place of residence the statement in form according to appendix 1 to these rules and for identification - the identity document (the identity certificate, the certificate of birth, the certificate of the stateless person, the residence permit of the foreigner who is constantly living in the Republic of Kazakhstan) with appendix of the following documents:

1) the documents confirming the right to benefit;

2) data on bank account number in authorized organization for issue of benefits.

In case of reception of an application from the information system "State Database of Physical Persons" the Ministries of Justice of the Republic of Kazakhstan (further - IS "GBDFL") are requested and enclosed to the application:

1) the data proving the applicant's identity;

2) data on registration on the permanent residence.

In case of discrepancy (absence) of data in IS "GBDFL" the following documents are enclosed to the application:

copy of the identity document (identity certificate, certificate of the stateless person, residence permit of the foreigner);

the document confirming registration on the permanent residence (the address reference or the reference of rural akims, for residents Baikonur - the reference of department of accounting and registration of citizens of housing of the city of Baikonur of the Russian Federation).

6. For purpose of benefit, specified in subitems 1-1), 7), 8), 8-1), 9), 10) of article 4 of the Law, data from state bodies and (or) the organizations according to appendix 2 to these rules are requested.
