According to the subitem 7) of article 7 of the Law of the Republic of Kazakhstan of November 24, 2015 "About informatization" I ORDER:

1. Approve the enclosed Rules of issue of the conclusions about hardware and software compliance to technical requirements for inclusion in the state register of cash registers.

2. To committee of communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan (Kazangap T. B.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information within ten calendar days from the date of receipt of the registered order for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of issue of the conclusions about hardware and software compliance to technical requirements for inclusion in the state register of cash registers

1. General provisions

1. These rules of issue of the conclusions about hardware and software compliance to technical requirements (further - Rules) are developed for inclusion in the state register of cash registers according to the subitem 7) of article 7 of the Law of the Republic of Kazakhstan of November 24, 2015 "About informatization" and determine procedure for issue of the conclusions about hardware and software compliance to technical requirements for inclusion in the state register of cash registers.

2. In these rules the following concepts and reducings are used:

1) authorized body in the field of informatization (further - authorized body) - the central executive body performing management and cross-industry coordination in the field of informatization and "the electronic government";

2) the hardware and software (further - the AIC) - set of the software and the technical means jointly applied to the solution of tasks of certain type;

3) the applicant - the physical person or legal entity which is owning or using the hardware and software, submitted the application for receipt of the conclusion about hardware and software compliance to technical requirements for inclusion in the state register of cash registers (further - the Applicant);

4) the digital signature - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

2. Procedure for issue of the conclusions about hardware and software compliance to technical requirements for inclusion in the state register of cash registers

3. For receipt of the conclusion about hardware and software compliance to technical requirements for inclusion in the state register the Applicant represents to authorized body or through the web portal of "the electronic government" www.e.gov.kz the completed questionnaire statement, in form, according to appendix 1 to these rules which is certified by the digital signature of the Applicant.

4. The authorized body checks correctness of filling of the questionnaire statement and, in case of factual determination of discrepancy to requirements of Item 3 of these rules, within two calendar days from the moment of receipt returns the questionnaire statement.

5. In case of compliance of the provided questionnaire statement to requirements, stipulated in Item 3 these rules, the authorized body within five calendar days from the moment of receipt of the questionnaire statement conducts examination on observance by the applicant of the technical requirements provided by Items 43-50 of appendix 1 to the order of the Minister of Finance of the Republic of Kazakhstan of December 30, 2008 No. 636 "About approval of technical requirements and forms of compliance to technical requirements of cash registers" (registered in the Register of state registration of regulatory legal acts for No. 5454) (further - technical requirements).

6. The applicant provides access to employees of authorized body to the AIC for carrying out inspection.

7. Following the results of the conducted examination by authorized body within two calendar days from the moment of inspection issues to the Applicant Zaklyucheniye about hardware and software compliance to technical requirements for inclusion in the state register (further - Zaklyucheniye) in form, according to appendix 2 to these rules or motivated refusal in case of not observance of technical requirements.

8. Issue of the conclusion by authorized body is performed within ten calendar days from the moment of receipt of the questionnaire of the statement specified in Item 3 of these rules.
