About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – In the Law on foodstuff No. 78-XV of March 18, 2004 (Official monitor of the Republic of Moldova, 2004, Art. No. 83-87, 431), with subsequent changes, to make the following change and addition:
1. Add Article 14 with part (18) the following content:
"(18) Marketing and the advertisement concerning not recommended for preschool children and pupils of products shall not have character, attractive to children, and intend for them.".
2. Part (Article 15 to state 6) in the following edition:
"(6) production, realization and distribution not recommended for preschool children and pupils of foodstuff (including soft and energizing drinks Are prohibited) in organizations of general and vocational training, and also in camps of rest and improvement of children and teenagers irrespective of type of property and form of business.".
Art. II. – Article 23 of the Law on advertizing No. 1227-XIII of June 27, 1997 (1997, Art. No. 67-68, 555), with subsequent changes, to add the official monitor of the Republic of Moldova with part (4) the following content:
"(4) It is forbidden:
a) involvement and participation of persons which did not reach 18-year age, and also use of their images for the purpose of the advertizing and promotion which are not recommended for preschool children and pupils of foodstuff;
b) any advertizing and promotion not recommended for preschool children and pupils of foodstuff in organizations of general and vocational training, and also in camps of rest and improvement of children and teenagers irrespective of type of property and form of business.".
Art. III. – In the Code of the Republic of Moldova about offenses No. 218-XVI of October 24, 2008 (Official monitor of the Republic of Moldova, 2009, Art. No. 3-6, 15), with subsequent changes, to make the following changes and addition:
