This resolution partially shifts the Directive 2014/40/EU of the European parliament and Council of April 3, 2014 about rapprochement of the legislative, regulating and administrative regulations of the EU member states concerning production, representation in the market and sales of tobacco products and similar products and on cancellation of the Directive 2001/37/EU published in the Official magazine of the European Union (OJ) No. L 121 of April 29, 2014.

1. Approve:

Sanitary regulations about ingredients of tobacco products and similar products according to appendix No. 1;

Sanitary regulations about notification and submission of the reporting on tobacco products, similar products, devices and accessories to their use, gas station or heating according to appendix No. 2;

Sanitary regulations about placement in the market and realization of not fermented and fermented tobacco, tobacco products and similar products, devices and accessories to their use, gas station or heating, according to appendix No. 3.

2. This Resolution becomes effective within one year from the date of publication in the Official monitor of the Republic of Moldova, except for:

1) regulations of Items 3 and 4 of Sanitary regulations on ingredients of tobacco products and similar products in the relations of categories of products with characteristic menthol smell which will be applied since May 20, 2020;

2) the restriction set by the subitem 6) of Item 12 of Sanitary regulations on realization of not fermented and fermented tobacco, tobacco products and similar products which is not applied to the commercial units put in operation till July 1, 2016 during the reasonable period of functioning but no later than till January 1, 2019.

3. To impose control over the implementation of this Resolution on the Ministry of Health.

Sanitary regulations about ingredients of tobacco products and similar products

The sanitary regulations about ingredients of tobacco products and similar products partially state Article 7 of the Directive 2014/40/EU of the European Parliament and Council of April 3, 2014 about rapprochement of the legislative, regulating and administrative regulations of the EU member states concerning production, representation in the market and sales of tobacco products and similar products and on cancellation of the Directive 2001/37/CE (extends to EEP) published in the Official magazine of the European Union by L 127 of April 29, 2014.

1. The sanitary regulations about ingredients of tobacco products and similar products (further - Regulations) establish regulations on the ingredients prohibited to use in the tobacco products and similar products made in the Republic of Moldova and imported to the Republic of Moldova for the purpose of realization.

2. Provisions of these Regulations extend to all economic agents whose type of activity is production, import and realization of tobacco and tobacco products, irrespective of form of business and type of property.

3. The domestic and import tobacco products placed in the market of the Republic of Moldova shall not contain the ingredients included in the List of the ingredients/substances prohibited to use in tobacco products manufacture, given in appendix No. 1 to these Regulations and also other ingredients prohibited according to provisions of article 11 of the Law No. 278-XVI of December 14, 2007 on control over tobacco.

4. If tobacco products and similar products contain the ingredients prohibited by this Regulations, and also article 11 of the Law No. 278-XVI ot14 December, 2007 about control over tobacco, their placement in the market of the Republic of Moldova is forbidden.
