Approve Regulations on the Ministry of Defence of Ukraine which is applied.

Regulations on the Ministry of Defence of Ukraine

1. The Ministry of Defence of Ukraine (Ministry of Defence) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine.

The Ministry of Defence is principal organ in system of the central executive bodies which provides forming and implements:

state policy on national security issues in the military sphere, the sphere of defense and military construction in peace time and the special period;

the state industrial policy, the state military-industrial policy, state policy in the field of oboronno - industrial complex, in aircraft manufacturing industry also provides forming and realization of state policy in the field of space activities (further - strategic industries).

The Ministry of Defence is the central executive body and military management under which supervision armed forces and State special transservice are.

The Ministry of Defence is authorized central executive body in the field of the state aircraft.

The Ministry of Defence is authorized body in the field of the state guaranteeing quality, principal organ in the field of implementation of defense purchases and the state customer in the field of defense.

2. The Ministry of Defence in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, international treaties of Ukraine, this Provision and other acts of the legislation.

3. The main objectives of the Ministry of Defence are:

1) ensuring forming and realization of state policy on national security issues in the military sphere, spheres of defense and military construction in peace time and the special period in the relation:

the organizations in forces of defense of measures of defense planning;

military policy;

military personnel policy;

military and technical policy in the field of defense;

2) forming of state policy in the field of defense on digital development, digital innovations, technologies in the field of defense;

3) ensuring forming and realization of state policy in the field of:

the state industrial policy, state policy on development of strategic industries, in particular military-industrial policy in defense industry complex;

innovative activities in strategic industries;

foreign economic activity concerning ensuring functioning and development of strategic industries of Ukraine, the State investment policy in strategic industries, scientific and technical activities in strategic industries, policy on import substitution and price policy in strategic industries;

implementation of management of the objects of state-owned property relating to the sphere of management of the Ministry of Defence in the procedure established by the legislation;

4) implementation of military-political and administrative management by Armed Forces;

5) coordination of activities of State special transservice for ensuring steady functioning of transport in peace time and during the special period;

6) ensuring forming and realization of state policy concerning national resistance;

7) implementation in accordance with the established procedure coordination of activities of state bodies and local government bodies for preparation of the state for defense;

8) providing within the powers provided by the law, realization of state policy on the defense questions connected with use of airspace of Ukraine and protection of sovereignty of the state;

9) ensuring forming and realization of state policy in the field of space activities;

10) participation within powers in ensuring forming and realization of state policy in the field of the European integration during execution of Ukraine of obligations according to international treaties of Ukraine in the negotiations aimed at providing development of contractual relations from the EU;

11) providing in strategic industries:

participations in forming of state policy on implementation of research, developmental, productive, financial and other activity of the companies, organizations and organizations relating to the sphere of management of the Ministry of Defence, support of innovations in defense industry complex and in other industries;

investment attraction in defense industry complex, in particular for implementation of the latest technologies, creation of competitive samples of high-technology industrial output, in particular military products, the conclusion of agreements within public-private partnership according to the legislation;

the solution of questions on the organization of activities of negotiation with foreign legal entities about receipt of compensations by Ukraine, the conclusion and accomplishment of compensation (offset) contracts with the purpose of ensuring coordination of military-economic, military-industrial and military and technical policy;

the organizations of work on creation of the equipment for needs of defense and safety of the state and other strategic industries;

implementation of cooperation with the international organizations, in particular the North Atlantic Treaty Organization (NATO), concerning development of strategic industries;

together with other central executive bodies according to the law and within powers of development of the international military-economic, military-industrial and military and technical cooperation, preparation and the conclusion of international treaties on these questions, realization of fundamentals of military and technical policy of Ukraine, military and technical cooperation with foreign states and development of defense industry complex.

4. The Ministry of Defence according to the tasks assigned to it:

1) develops drafts of the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine on the questions which are within its competence;

2) generalizes practice of application of the legislation on the questions which are within its competence develops suggestions for improvement of legal acts, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, in particular prepares offers on the Strategy of homeland security of Ukraine, to the Plan of defense of Ukraine, the National intelligence program and other documents for national security issues and defenses, doctrines, concepts, strategy and programs in the field of homeland security, and also about carrying out complex survey of the sector of safety and defense and submits them in accordance with the established procedure for consideration of the Cabinet of Ministers of Ukraine, provides their accomplishment;

3) performs preparation and representation to the Cabinet of Ministers of Ukraine of offers on application, cancellation and modification of special economic and other rationing measures (sanctions) submitted by the Cabinet of Ministers of Ukraine for consideration of the National Security and Defense Council of Ukraine according to the Law of Ukraine "About sanctions" and participates in forming, realization and monitoring of efficiency of the state sanctions policy on issues, being within its competence;

4) is performed by normative legal regulation of the questions which are within its competence;

5) creation and development of effective system of strategic communications in the Ministry of Defence and Armed Forces as the constituting nation-wide system of strategic communications coordinates, ensuring its resistance and adaptivity to response to challenges and threats;

6) participates in accomplishment of tasks of the state information policy in the field of defense, the information actions directed to increase in level of defense capability of the state and counteraction to information transactions of aggressor (opponent), and during action of legal regime of warlike situation coordinates components of forces of defense concerning ensuring forming and realization of the state information policy in the field of defense;

Prepares 7) within the powers provided by the law, notes and offers to the laws adopted by the Verkhovna Rada of Ukraine which arrived for the signature to the President of Ukraine;

8) performs intelligence and information and analytical activities for the benefit of homeland security and defense of the state;

9) participates in carrying out the analysis of military-political situation, forecasting, identification and determination of level of military threat of homeland security of Ukraine;
